Ordinance 032-1997County Attorney ORDINANCE NO. 032 -1997 AN ORDINANCE OF THE BOAD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, IMPOSING AN ADDITIONAL COST OF $15.00 IN CASES WHERE A PERSON, AFTER AUGUST 1, 1997, IS FOUND GUILTY OF ANY MISDEMEANOR WHERE THE UNLAWFUL USE OF DRUGS OR ALCOHOL IS INVOLVED; PROVIDING THAT FOR EACH $15.00 COLLECTED, $14.00 WILL GO TO LOCAL SUBSTANCE ABUSE TREATMENT PROGRAMS AND $1.00 TO THE CLERK OF THE COURT AS A SERVICE CHARGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: Section 1. This Ordinance is adopted under the authority of Sec. 939.017, F.S. Section 2. When any person, on or after August 1, 1997, is found guilty of any misdemeanor under the laws of Florida in which the unlawful use of drugs or alcohol is involved, there is hereby imposed an additional cost in the case, in addition to any other cost required to be imposed by law, in the sum of $15.00. Under no condition may Monroe Coun� be held liable for the payment of the sum. Section 3. The Clerk of the Court must collect the $15.00 and forward $14.00 thereof to the Board of County Commissioners of Monroe County to be deposited to the credit of 4tke Monroe County Alcoholic and Other Drug Abuse Trust Fund for allocation to Ideal substgppe r�- r abuse programs under Sec. 893.165, F.S. The Clerk will retain the remaining $1.00 of each $15.00 collected as a service charge of the Clerk's Office. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. ($15.00 fee under Sec. 939.017, FS) Section 5. If any section, subsection, sentence, clause, item, change or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 6. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 7. The Clerk of the Board is hereby directed to forward a copy of this Ordinance to Municipal Code Corporation for incorporation into the Monroe County Code of Ordinances.
