Community Services ORDNANCE N0038 -1997 - AN ORDINANCE AMENDING ORDINANCE NO. 018-1995 IN ORDER` THAT PARKING TICKETS MAY BE ISSUED FOR VIOLATIONS OF SEC. 15. _ OF RESOLUTION N0.330 -1997; PROVIDING FOR SEVERABILITY; - PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT__- _ HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE_ry COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE. - DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Section 1 of Ordinance No. 018-1995 is hereby amended to read: Section 2. The noncriminal civil penalty for a violation of Sec. 44- 15 of Resolution No. 442-1997 parking in a no parking area at the Marathon Airport or parking a vehicle in an area at the Marathon Airport reserved for vehicles of a different type or category or reserved for vehicles leased, licensed or permitted by the County, is $20.00. A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of this section may issue a ticket, in the form used by the County for parking violations, to the driver or, if the vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the parking ticket is as provided in Sec. 316.1967, Florida statutes. All parking ticket penalties collected under this section must be remitted to the Marathon Airport account and may be used for any lawful purpose at that Airport. Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition to amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance must be filed in the Office of the Secretary of State, State of Florida, but will not take effect until 90 days from the date of adoption by this Board.
