ORDINANCE NO. 050 - 1997
AN ORDINANCE AMENDING ORDINANCE NO. 008-1988, AS AMENDED BY
ORDINANCE NOS. 007-1991 AND 020-1992, RELATING TO THE UPPER KEYS HEALTH
CARE TAXING DISTRICT, PROVIDING FOR TERMINATION OF THE TAXING AUTHORITY
FOR THE DISTRICT; PROVIDING FOR SUBSEQUENT REFERENDUM FOR RENEWING THE
AD VALOREM LEVY FOR THE DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR
INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, on January 19, 1988, the Board of County Commissioners established the Upper
Keys Health Care Taxing District (UKHCTD) to provide a means of increasing facility upgrading within
the District to decrease reliance upon areas outside of Monroe County for certain types of health
care, while at the same time assuring accessibility and transport for those instances w§rpglh acre

WHEREAS, by referendum on March 8, 1988, the registered voters of the Districg�cOhorizZits
creation and ad valorem taxation for the purposes of the District; and -L-+ 3 a

WHEREAS, amending Ordinance No. 007-1991 was passed by the Bopd o'f- C&fcOhty;(Z"')

Commissioners to provide for expanded citizen participation on the UKHCTD Advisory Board, as well
as providing for further budget and equipment utilization control; and
WHEREAS, Ordinance No. 020-1992 was passed by the Board of County Commissioners
extending the taxing authority of the UKHCTD an additional five years; and
WHEREAS, registered voters of the District authorized the extension of ad valorem collection
for an additional five years by referendum on September 1, 1992; and
WHEREAS, the taxing authority of the UKHCTD expires in March of 1998; and
WHEREAS, it is no longer necessary to continue to assess an ad valorem levy to provide
funding for the District; and
WHEREAS, the Board of County Commissioners deems it necessary to continue the UKHCTD to
continue to carry out the purposes established in Ordinance No. 008-1988 as amended by
Ordinance No. 007-1991 and Ordinance No. 020-1992; now, therefore
that:
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
Section 1. Section 6 - Powers and Duties, subsection 7 of Ordinance No. 008-1988, as
amended by Ordinance Nos. 007-1991 and 020-1992 is hereby amended to read as follows:
7. Effective upon the date of termination of the District Taxing Powers and Levy
under Ordinance No. 008-1988, as amended by Ordinance Nos. 007-1991 and 020-
1992, the District shall have no power to impose a tax on the assessed valuation of
taxable real property in the District unless and until a referendum within the District
shall endow the governing board of the District with taxing powers, provided that such
referendum states specific utilization of any such tax levy.
Section 2. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 5. This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with
said Office.
