INTRODUCTION Riverview Consultants, Inc. (RCI), a Minority owned and operated management consulting firm, located in Jacksonville, Florida, is interested in continuing its provision of Disadvantaged Business Enterprise (DBE) Program support services to Key West International Airport and Florida Keys Marathon Airport (the Airports) via a sub consultant agreement with URS Corporation (URS). The Phase I, Development, portion of RCl's DBE Programs support services subcontract via URS will expire on August 31,2003. We anticipate a smooth and uninterrupted transition into the Phase II, Implementation Assistance, portion of RCl's DBE services subcontract via URS beginning on October 1, 2003. We propose to serve as the DBELO's support services staff (Phase II) per this agreement. Riverview Consultants, Inc., one of the few firms in the country that recently served as an official SBA Private Certifier of small disadvantaged businesses, provides these Minority Business Enterprise Program services: . Conducting M/DBE Staff Training; seminars and workshops. . Preparing M/DBE Program Plans & Procedures Manuals. . Assisting with pre-bid and pre-construction conferences. . Identifying, recruiting and certifying M/DBE firms. . Providing post-award project monitoring to ensure compliance. . Conducting "Good Faith Efforts" Audits of Prime Contractors. . Conducting internal program assessments including Desk Audits, and making compliance recommendations to governmental agencies. . Providing AlP Contracts' Financial Administration Assistance II. OUR UNDERSTANDING OF THE NEED The Airports are preparing to spend approximately $8,000,000 in construction projects via FAA's Airport Improvement Program (AlP). Those dollars may be spent to expand/repair Terminals and/or Parking Garages; Runways; Aprons; Access Roads; etc., infrastructure and other construction projects geared to meet the needs of the growing Monroe County Airports area. These projects will provide an opportunity for local entrepreneurs, large and small, to participate in the business activities at the Airports. The federal government has determined that, historically, disadvantaged businesses have not received a proportionate share of construction and professional service opportunities on previous DOT/FAA funded projects. This fact prompted the Board and the Airport Manager to research, develop and enact specific overall goals for DBE participation on all FAA funded airport projects. These goals, however, address only one side of the limited DBE participation equation, Le., the access to opportunity. The other equally important sides to this equation are (1) limitations about the awareness of these opportunities; (2) management and financial deficiencies which impede timely and successful performance on contracts/subcontracts available from the Airports' DBE Program; (3) an effective Monitoring process to ensure that DBEs are being utilized as proposed; (4) the Prompt Payment Process to DBEs; (5) the presentation of timely and accurate DBE Programs reports to FAA; and other U.S. DOT compliance issues. Filling the information void would not, in and of itself, increase the participation of DBEs on the Airports' FAA funded projects unless technical, management, and financial deficiencies are addressed. These deficiencies include: . Limited management know-how and the absence of management services and technical assistance when the business was initially organized. . Low education levels and low managerial skills in key areas of the business. . The absence of adequate capital. . The absence of effective communication skills in the presentation of specific capital needs. . The absence of proper business accounting and inventory control systems to maintain a viable business. . The inability to locate financial resources compatible with individual business needs. . Inexperience with the Airports' procurement policies; and bidding procedures and requirements in general; and specific DBE Program requirements. We do understand that the Airports' Disadvantaged Business Enterprise Department, similar to most Minority Program staffs, is insufficiently staffed to devote the man-hours which are necessary to provide management and technical assistance to DBE firms while maintaining control of the Department's other daily DBE compliance issues. Hence, the need for a consultant Supportive Services Team exists to provide assistance to the Airports' DBELO. Our keen awareness of this situation is due to our extensive participation as DBE/MBE supportive service consultants on several similar tasks with the Federal Aviation Administration, the Federal Transportation Administration and with private corporations. Riverview Consultants, Inc.'s (RCI) primary focus for this assignment is to provide staff extension and support to Monroe County Airports' DBELOs with the implementation of its Disadvantaged Business Enterprise Program. However, specific staff support responsibilities would involve the development and implementation of a Bonding & Technical Assistance component that will enhance DBE participation during the design, construction management, and contract construction portions of the Airport AlP tasks, particularly its anticipated $8,000,000 new Airport Improvement Projects (AlPs). The problems encountered with developing techniques for any DBE Supportive Services Program geared toward the Airports' FAA funded construction projects, and professional service tasks are astronomical. Given the fact that the level of construction experience required by the Airports' AlP tasks is not a common occurrence, only a few local DBE contractors have had actual experience in construction projects of this magnitude, and/or the rigors of the Airports' requirements for standards of work. An intensive recruitment of DBE contractors in all areas of construction and engineering/ professional services shall be conducted. 2 Certification determinations and capability reviews shall be conducted for these firms also. RCI's supportive services team will augment the DBELO's effort to serve as a link between the majority and minority contractors who bid on the Airports' AlPs and other DBE projects in the area. Supportive services for these DBE contractors are vital because DBEs, generally, do not utilize typical business skills that are essential to the effective operations of a business. Financial data necessary to secure bonding and loans is virtually nonexistent or has been postponed due to poor bookkeeping and other business management practices. Applicable Laws and Reaulations We have a working knowledge of each Airport's DBE Program requirements; and we are aware of the normal DBE identification and certification problems as well as other legal and administrative problems unique to the Airports' DBE Programs. We are, therefore, committing the same key personnel used on previous successful projects to man this task in order that we may decrease the frequency of problems, and quickly resolve those problems as they arise. Our entire team is familiar with federal, state and local laws regarding Minority Programs' implementation, but we are willing to familiarize ourselves with applicable Monroe County Airports regulations and any new and innovative strategies which will enable us to become more valuable "team" players. Rei's approaches for addressing these issues, as well as other standard needs, are discussed in detail in item IV... METHODOLOGY. III. PURPOSES. SCOPE & OBJECTIVES A. PURPOSES The major purposes of this assignment are to: (1) Assist the Airports' DBELO and designated staff with the development of a strong Disadvantaged Business vendor base with the specific task of identifying capable ""ready, willing and able" DBEs who can perform successfully on the Airports' engineering & professional service (E&PS) and construction contracts per 49 CFR guidelines; and incorporate these procedures into the Airports' regular Purchasing process. (2) Update a separate E&PS/Construction DBE Directory; (3) Conduct "Needs Assessments" of local DBEs; (4) Prepare DBE Profiles of local DBEs; (5) Prepare annual DBE Goal and Methodology Updates; (6) Prepare periodic Procedures Manual Updates; 3 (7) Prepare annual DBE Concession Updates; (8) Establish and maintain a separate DBE Concessions Directory; (9) Collect and review the appropriate DBE program information which can facilitate decision-making and overall project management in accordance with applicable federal, state, and local DBE Program regulations; (10) Provide Bonding and Technical Assistance to local DBEs; and (11) Promote the Airports' DBE Program to prime and subcontractors, and to the entire DBE community; B. SCOPE OF SERVICES We propose to perform these DBE Program Consultant services via a four (4) year Pilot Program beginning October 1, 2003 and ending September 30, 2007.. .or through the existence of URS Corporation's contract with the Airport. The Board may, at its own discretion, exercise its option to renew the contract for an additional five (5) years. The specific objectives for the successful implementation of these portions of the Airports' Disadvantaged Business Enterprise Program are: Serve as liaison between contractors and subcontractors; and between DBE Program participants and the Airports' officials. Identify potential DBE contracting opportunities at the Airport. Develop a methodology for the Airports to disseminate information on available business opportunities to the local DBE community. Match the Airports contracting opportunities with viable DBEs. Prepare Monthly Reports to the Airports' DBELO. Attend periodic meetings with the Airports' staff. - Assist the Interim DBELO with the establishment of overall annual DBE goals U& methodologies. Serve as the Airports' liaison for the United Certification Program (UCP). Administrative/Liaison: - Acting as Liaison between Contractors and Subcontractors; and between DBE Program Participants and the Airports' Officials. Identifying DBE Contracting Opportunities at the Airport. Develop a methodology for the Airports to disseminate information on available business opportunities to the local DBE community. Matching the Airports contracting opportunities with viable DBEs. Monthly Reports to URS for submittal to the Airport Managers. - Attend periodic meetings with the Airports' staff. - Assist the DBELOs with the establishment of overall annual DBE goals. Prepare/update the Airports' FY2004 DBE Plans Develop a checklist for the DBELO to determine the eligibility of firms. 4 Outreach/Certification: Identifying local trade associations and technical assistance agencies, etc. Conducting DBE Recruitment, Certification, and Recertification activities. Developing/updating Monroe County Airports' Directory of Certified DBEs. Promoting the Airports' DBE Program to interested agencies, civic groups, etc. Developing a program to assist new, start-up firms in fields in which DBE participation has been historically low. Developing a DBE certification eligibility checklist. Compiling a mailing list for DBEs. Conducting DBE desk audits, on-site visits and compliance investigations. DBE Program Monitoring: Conduct "Good Faith Efforts" Audits. Conduct DBE Program contract compliance monitoring for each AlP. Develop the program and analysis procedure to comply with the methodology for determining, meeting and counting overall annual DBE goals. Management & Technical Assistance: Establishing a program to provide help for DBEs to improve long-term development, increase opportunities, handle increasingly significant projects and achieve self- sufficiency. Establishing an information center designed to increase the awareness of DBEs toward potential contracts and contract procedures. Crafting an information and communication program on contracting procedures. Reporting: - Developing a program to conduct audits and reviews of each Airport's contracts to ensure compliance to the Plan. Detailing overall DBE Program performance. Noting monthly individual AlP contracts' Administrative status. Highlighting monthly DBE monitoring status. Listing future contracting activities. Appeals: Providing assistance to the DBELO's efforts in: Identifying grievance issues. Forwarding grievance issues to the County Attomey and B.O.C.C.. 5 IV. METHODOLOGY A. Identifyina Capable Firms: Riverview Consultants will assist each Airport's staff with the identification of firms to participate in the Bonding & Technical Assistance Program and on each Airports' AlP tasks. These "select" DBE firms will be surveyed to obtain information such as the number of years in business, largest contract performed, number of employees, subcontracting experience, bonding capacity, etc. Interviews will be also conducted to determine their interim needs for supportive services. The survey information obtained about each firm will be organized into sections based on trade and/or provision of goods and services and placed in each firm's file. We will also implement procedures to be used in the monthly update of this information as the DBEs progress through the Program. B. Outreach: Riverview Consultants, Inc. proposes outreach activities to DBE firms through the implementation of the following activities: · Contacting these DBE firms via letter & phone calls to arrange meetings at the firm's office. . Developing and maintaining a working relationship with DBEs. · Arranging meetings with Purchasing and DBE Program officials from the Airports and local majority corporations to discuss the procurement opportunities available to the "select" DBEs at the Airports and at the respective corporations. C. Manaaement & Technical Assistance: Riverview Consultants will approach this contract as an individually unique and challenging opportunity to assist the Airports' staffs in addressing local Disadvantaged Business Enterprise needs via this Program. We have found that there is no substitute for an aggressive field operation that outreaches to the DBE firms as opposed to waiting for them to "come into the office." We, therefore, encourage you to implement the Bonding and Technical Assistance component in order to successfully assist DBEs in the manner that will be most beneficial to them. The effective provision of management and technical assistance by Riverview Consultants, Inc.'s staff will assure a successful DBE Program for each Airport D. Reportina and Performance Reauirements: Riverview Consultants, Inc. will report all problems or problem areas encountered, recommending, where possible, solutions that could alleviate the problem(s). Time given and/or intensity of effort devoted to this task will depend on the circumstances/needs of the DBE firms as directed/coordinated via each Airports' staff. These services, to the greatest practical extent, will be rendered on a one-to- one contact basis between Riverview Consultants, Inc.'s staff and the individual DBE firms. Previous governmental Minority/Women (MWBE) Program legislation has given rise to the formation of 51 per centum, 49 per centum owners with a minority 6 or female figurehead "acting" as the party who manages and controls the business on a day-to-day basis. RCI's staff has the experience and expertise to identify and eliminate those "fronts", thereby ensuring that the Airports' DBE Program benefits only those firms for which the Program is intended. The fact that many DBE firms are under-publicized, under-capitalized, and have limited bonding capacity is felt enormously when DBEs are forced to compete against well-established non-minority companies and well-financed and organized 51 %/49% companies with vast resources. Riverview Consultants, Inc.'s supportive services efforts are not shortsighted on this socioeconomic, highly political problem, and the need for the Airports' Disadvantaged Business Enterprise Program to: . Identify legitimate DBE firms who are capable of providing goods and services. . Conduct reviews of ongoing purchases of goods and services and/or contracts to assure that each Airport and participating majority firms achieve DBE goals. . Prepare and circulate viable directories of DBEs. . Work with other officials to coordinate the Airports' DBE Program goals requirements for certain goods and services to be matched with and performed by capable DBEs to meet those specified requirements. . Provide meaningful management and technical assistance to DBE firms competing for and securing contracts or providing goods and services to each Airport and to local majority firms. v. PHASE II - PROJECT TIME SCHEDULE Months 1-3 (October thru December 2003) · Conduct one (1) DBE Program workshop (October 2003) to introduce the Airport's DBE Program and staff to the DBE community; encourage potential DBEs to apply for DBE certification; to inform the entire community of the Airports' upcoming AlP tasks; and RCI's local Program Assistant who will provide a local presence for the Airports' DBE and Economic Development Programs. . Identify, recruit and certify thirty (30) local DBEs. . Update the Airports' Construction DBE Directories. . Provide DBE Program assistance for the FY '03 AlP tasks: o Ensure proper DBE language in the RFBs o Conduct "Good-Faith Effort Audits of Prime contractors o Conduct Pre-bid and Pre-construction DBE Program compliance issues and other 49 CFR, Part 26 compliance requirements. · Assist the County's Purchasing Director with the incorporation of the DBE Program; and the incorporation of the Business Development Program (later) into the Airports' Purchasing Policies & Procedures. 7 Months 4-15 (January 2004 thru December 2004) . Update the Airports' DBE Programs.. .Construction & Concessions Methodologies. . Work with the Airports' staff to determine optimum goals for months 1-6. . Review FAA forms, in-house documents and monthly report formats. . Develop a Preliminary Small Business Assistance Program. . Develop a Preliminary Bonding & Technical Assistance Procedures Manual. . Finalize forms, report documents, Procedures Manual. · Assist the DBELOs and other staff with the determination of selected DBE firms for the Bonding & Technical Assistance Program. · Conduct Needs Assessment Reviews of each firm; discuss with appropriate Airport staff and finalize each firm's Needs Assessment Report. . Prepare and conduct 4 seminars for the selected DBEs. · Prepare and conduct one-on-one meetings with each DBE firm immediately after the seminars. · Prepare a status file for each firm; update monthly; and include as part of the monthly report to the appropriate Airport staff. MANAGEMENT/CONSULTANT INTERFACE The Consultant's level of effort for this task is, of course, commensurate with the Airports' perceived need(s) and willingness to provide sufficient staff and financial resources for the task. We request the Airports' appointment of a "Management Team" for the Consultants to report to/work with, and provide direction to the Consultant throughout this level of effort. Our experience on previous and similar projects spurs our requirement of a five (5) day turn around on matters of policy from the Management Team in order to avoid unnecessary delays that could disrupt the Consultant's schedule. The Consultant shall keep the Team abreast of all scope of service items on a regular basis via ten (10) schedule meetings, e-mail, fax, and telephone calls as necessary. 8 VII. PROJECT TEAM A. All of our key personnel have extensive experience in large-scale construction projects and many have specific experience in monitoring Minority Programs' participation on Federal Aviation Administration, State DOT, and Municipal construction projects as illustrated by our proposed Organizational Chart. Backaround and Related Experience We are committing a seasoned support services team with extensive Minority Programs' hands-on construction, and EEO/AA monitoring experience to the County's DBE Program. This will not be a learning experience for our team since the team's combined related experience exceeds 50 years spanning the past 20 years. RCI shall reduce the Principal/Project Administrator annual fees to offset necessary travel and salary increases to other consultants. Our fee includes all expenses that will be incurred during the performance of this project including Direct & Indirect Labor, Travel, supplies, computer time, communication costs, document production, and insurance.
