Ordinance 002-1996 ORDINANCE NO. 002 -1996 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, ESTABLISHING A FIVE ($5.00) DOLLAR SERVICE CHARGE ON ALL CIVIL CIRCUIT COURT PROCEEDINGS IN THE SIXTEENTH JUDICIAL CIRCUIT TO DEFRAY THE COST OF MEDIATION AND ARBITRATION SERVICES; ESTABLISHING A FORTY-FIVE ($45.00) DOLLAR SERVICE CHARGE ON ANY PETITION FOR A MODIFICATION OF A FINAL JUDGMENT OF DISSOLUTION TO DEFRAY THE COST OF FAMILY MEDIATION SERVICES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Monroe County has established arbitration and mediation programs to assist parties in resolving controversies and obviating the need for litigation; and WH EREAS, Florida Statutes 44.108 provides that mediation should be accessible to all parties regardless of financial status; and WHEREAS, Florida Statutes 44.108 also provides that each board of county commissioners may support mediation and arbitration services by appropriating moneys from county revenues and by levying service charges as outlined in Florida Statutes 44.1 08( 1) through (3); and WHEREAS, Florida Statute 44. 108 ( 1) authorizes the levying of a service charge of no more than five ($5.00) dollars on any circuit court proceeding to support mediation and arbitration services; and WHEREAS, Florida Statute 44.108(3) authorizes the levying of a service charge of no more than forty-five ($45.00) dollars on any petition for a modification of a final judgment of dissolution to support family mediation services; and WHEREAS, the Board of County Commissioners believes that the levying of these service charges would serve the public good, now, therefore, -,. -Tl L::; '-,'.:' ~ 2:. .';.,- '" r- ^ r' :r: fT) BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF~ROEi:..COUmY, _'c. ::x. ., ~ "n FLORIDA that: ,.~ 01~' z:C-, ',.) ~ ::t:> i-r"j - 00 c-; -" .h:. CJ ~- :::0 00 ~_--=J SECTION 1. The Clerk of the Court must collect a service charge of five ($5.00) dollars on any circuit court proceeding commenced in the 16th Judicial Circuit. SECTION 2. All funds derived from the imposition of the service charge set forth in Section 1 above shall be deposited in the court's mediation-arbitration account fund to be used to fund the circuit civil mediation services under the direction of the Chief Judge of the 16th Judicial Circuit. One ($1.00) dollar of each charge collected shall be forwarded to the Office of the State Courts Administrator for deposit in the state mediation and arbitration trust fund and the remainder utilized to fund the circuit civil mediation services. SECTION 3. The Clerk of the Court must collect a service charge of forty-five ($45.00) dollars on any petition for a modification of a final judgment of dissolution filed in the 16th Judicial Circuit. SECTION 4. All funds derived from the imposition of the service charge set forth in Section 3 above shall be deposited in the court's family mediation account to be used to fund the family mediation services under the supervision of the Chief Judge of the 16th Judicial Circuit. One ($1.00) dollar of each charge collected shall be forwarded to the Office of the State Courts Administrator for deposit in the state mediation and arbitration trust fund and the remainder utilized to fund family mediation services. SECTION 5. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. SECTION 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. SECTION 7. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition to amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. 2 SECTION 5. This Ordinance must be filed in the Office of the Secretary of State, State of Florida, but will not take effect until 90 days from the date of adoption by this Board. WHEREAS, Monroe County has established arbitration and mediation programs to assist parties in resolving controversies and obviating the need for litigation; and WHEREAS, Florida Statutes 44.108 provides that mediation should be accessible to all parties regardless of financial status; and WHEREAS, Florida Statutes 44.108 also provides that each board of county commissioners may support mediation and arbitration services by appropriating moneys from county revenues and by levying service charges as outlined in Florida Statutes 44.108(1) through (3); and WHEREAS, Florida Statute 44.108(1) authorizes the levying of a service charge of no more than five ($5.00) dollars on any circuit court proceeding to support mediation and arbitration services; and WHEREAS, Florida Statute 44.108(3) authorizes the levying of a service charge of no more than forty-five ($45.00) dollars on any petition for a modification of a final judgment of dissolution to support family mediation services; and WHEREAS, the Board of County Commissioners believes that the levying of these service charges would serve the public good, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that: SECTION 1. The Clerk of the Court must collect a service charge of five ($5.00) dollars on any circuit court proceeding commenced in the 16th Judicial Circuit. SECTION 2. All funds derived from the imposition of the service charge set forth in Section 1 above shall be deposited in the court's mediation-arbitration account fund to be used to fund the circuit civil mediation services under the direction of the Chief Judge of the 16th Judicial Circuit. One ($1.00) dollar of each charge collected shall be forwarded to the Office of the State Courts Administrator for deposit in the state mediation and arbitration trust fund and the remainder utilized to fund the circuit civil mediation services. SECTION 3. The Clerk of the Court must collect a service charge of forty-five ($45.00) dollars on any petition for a modification of a final judgment of dissolution filed in the 16th Judicial Circuit. SECTION 4. All funds derived from the imposition of the service charge set forth in Section 3 above shall be deposited in the court's family mediation account to be used to fund the family mediation services under the supervision of the Chief Judge of the 16th Judicial Circuit. One ($1.00) dollar of each charge collected shall be forwarded to the Office of the State Courts Administrator for deposit in the state mediation and arbitration trust fund and the remainder utilized to fund family mediation services. SECTION 5. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. • SECTION 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are • hereby repealed to the extent of said conflict. SECTION 7. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition to amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. 2 • SECTION 5. This Ordinance must be filed in the Office of the Secretary of State, State of Florida, but will not take effect until 90 days from the date of adoption by this Board.
