PROPERTY, KNOWN AS 11 OCEAN SPRAY TRAILER PARKI1, AND LEGALLY DESCRIBED AS SOUTHEASTERLY HALF OF LOT 19, AND ALL OF LOT 20, BLOCK 45, MALONEY SUBDIVISION, SECTION 35, TOWNSHIP 67 SOUTH, RANGE 25 EAST, MILE MARKER 4.8, STOCK ISLAND, FROM URBAN RESIDENTIAL MOBILE HOME (URM) TO URBAN RESIDENTIAL MOBILE HOME-LIMITED (URM-L) j TRANSMITTING THESE AMENDMENTS TO THE STATE LAND PLANNING AGENCY FOR APPROVALj PROVIDING FOR SEVERABILITYj AND PROVIDING FOR AN EFFECTIVE DATE. ":~" ~ "n ter 9.5 of the Code), including the land use district l'3lapS;; may \0 .,<, ';0 rT1 G o ::n '-::J be amended or changed at any timej and -0 U1 .:.:. v.J WHEREAS, the Board of County Commissioners on February 28, 1986, designated the subject property, better known as 110cean Spray Trailer Park" legally described as the southeasterly half of Lot 19 and all of Lot 20, Block 45, Maloney Subdivision, Section 35, Township 67 South, Range 25 East, Stock Island, Talla- hassee Meridian, Monroe County, Florida as shown on the shaded Page 1 PLANDEPT.20G/TXTAMAP Initials part of Exhibit I, as Urban Residential Mobile Home. Estate Number is 00125750-000000; and The Real WHEREAS, the county sponsored a map amendment for the above described properties to change its land use district designation from Urban Residential Mobile Home (URM) to Urban Residential Mobile Home-Limited (URM-L); and WHEREAS, the Planning Department's staff has reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hear- ing process, has reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district map changes, and the recommendations of the Planning Department and the Development Review Committee; and Page 2 PLANDEPT.20G/TXTAMAP Initials WHEREAS, the Planning Commission has found them to be consis- tent with the Monroe County Comprehensive Plan and has made a recommendation that the Monroe County Board of Commissioners rezone the properties from Urban Residential Mobile Home (URM) to Urban Residential Mobile Home-Limited (URM-L) i and WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has re- viewed all of the above recommendations and now legislatively acts thereoni and WHEREAS, F.S. 380.0552(9) requires that the state land plan- ning agency must approve all proposed land use district map chang- es before such changes may become effectivei NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUN- TY, FLORIDA: THAT Section 1. This Board specifically adopts the findings of facts and conclusions of law reached by the Planning Commission as our owni and therefore Section 2. The previously described properties, as shown on the attached map, which is hereby incorporated by reference, and attached as Exhibit 1, shows that the properties are current- Page 3 PLANDEPT.20G/TXTAMAP Initials ly designated as Urban Residential Mobile Home (URM) and which designation is hereby repealed. Section 3. The land use district map shall be amended changing the zoning category from Urban Residential Mobile Home (URM) to Urban Residential Mobile Home-Limited (URM-L) for the shaded portion of the property as shown in Exhibit 1. Section 4. If any section, subsection, sentence, clause, item, change, or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalid- ity. Section 5. This ordinance is hereby transmitted to the state land planning agency for approval or disapproval pursuant to F.S.380.0552(9). Page 4 PLANDEPT.20G/TXTAMAP Initials Section 6. This ordinance shall be filed in the Office of the Secretary of State of the State of Floridat but shall not be deemed effective until approved by the state land planning agency.
