Ordinance 016-1996 Contractors Examining Board ORDINANCE NO 016 -1996 AN ORDINANCE AMENDING SEC. 6-59(I)(g), MONROE COUNTY CODE, PROVIDING FOR PROOF OF WORKER'S COMPENSATION INSURANCE, PUBLIC LIABILITY INSURANCE AND PROPERTY DAMAGE INSURANCE AS PREREQUISITE TO ISSUANCE OF OR RENEWAL OF CERTIFICATE OF COMPETENCY; AMENDING SEC. 6-64(c)(2), TO INCLUDE THE REQUIREMENT THAT WORKER'S COMPENSATION INSURANCE OR EXECUTED EXEMPTION BE INCLUDED WITH INSURANCE REQUIREMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING A N -� EFFECTIVE DATE. b z oi r— BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS' OF= MCEROE-n i c� COUNTY, FLORIDA, that: Section 1. Sec. 6-59(I)(g), Monroe County Code, is hereby amended to9ead tv as follows: The initial certificate of competency will be issued by the contractor's examining board. Renewals will be issued by the building official. As a prerequisite to the initial issuance or the renewal of a certificate of competency, the applicant shall submit a certificate of - insurance attesting to the fact that the applicant has obtained worker's compensation insurance as required by Chapter 440, Public Liability Insurance, and Property Damage Insurance for the safety and welfare of the public, in the amount set forth in Sec. 6-64(c)(2). Section 2. Sec. 6-64(c)(2) shall be amended to read as follows: Fails to maintain at all times with an insurance company, authorized to do business in the state, the limits of insurance required by any other applicable law or authority having jurisdiction but not less than worker's compensation insurance or executed exemption; public liability insurance for general and building contractors in the amount of three hundred thousand dollars ($300,000.00), for electrical contractors in the amount of one hundred thousand dollars ($100,000.00) per person and three hundred thousand dollars ($300,000.00) aggregate, and for all other licensed contractors, including specialty contractors in the amount of one hundred thousand dollars ($100,000.00); and property damage insurance coverage in the amounts of fifty thousand dollars ($50,000.00) for general and building contractors, five hundred thousand dollars ($500,000.00) for electrical contractors, and twenty five thousand dollars ($25,000.00) for residential contractors and all other contractors, including specialty contractors; and to file certificates, signed by the qualified agent of the insured, with the secretary of the contractors examining board showing the type of policy, the policy number, the name of the insurer, the effective date of the policy, an agreement by the insurer to give thirty (30) days' written notice by registered mail to the secretary of the examining board of the intent to cancel the policy for any reason. The building official may reinstate such revoked certificate of competency at such time as the contractor again supplies full insurance coverage as required by this article. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. •Section 5. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Monroe County Code, is hereby amended to read as follows: The initial certificate of competency will be issued by the contractor's examining board, Renewals will be issued by the building official. As a prerequisite to the initial issuance or the renewal of a certificate of competency, the applicant shall submit a certificate of insurance attestina to the fact that the applicant has obtained worker's compensation insurance as reauired by Chapter 440, Public Liabilitv Insurance. and Propertv Damaae Insurance for the safety and welfare of the public, in the amount set forth in Sec. 6-64(clt2). Section 2, Sec. 6-64(c) (2) shall be amended to read as follows: Fails to maintain at all times with an insurance company, authorized to do business in the state, the limits of insurance required by any other applicable law or authority having jurisdiction but not less than worker's compensation insurance or executed exemption; public liability insurance for general and building contractors in the amount of three hundred thousand dollars ($300,000,00), for electrical contractors in the amount of one hundred thousand dollars ($100,000.00) per person and three hundred thousand dollars ($300,000.00) aggregate, and for all other licensed contractors, including specialty contractors in the amount of one hundred thousand dollars ($100,000.00); and property damage insurance coverage in the amounts of fifty thousand dollars ($50.000.00) for general and building contractors. five hundred thousand dollars ($500,000.00) for electrical contractors, and twenty five thousand dollars ($25,000.00) for residential contractors and all other contractors, including specialty contractors; and to file certificates, signed by the qualified agent of the insured, with the secretary of the contractors examining board showing the type of policy, the policy number. the name of the insurer, the effective date of the policy, an agreement by the insurer to give thirty (3D) days' written notice by registered mail to the secretary of the examining board of the intent to cancel the policy for any reason, The building official may reinstate such revoked certificate of competency at such time as the contractor again supplies full insurance coverage as required by this article. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict, . Section 5. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code, Section 6. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
