HomeMy WebLinkAboutResolution 347-2003 Petitioners Norman, Sessi and Macias RESOLUTION NO. 347 - 2003 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, RENOUNCING AND DISCLAIMING ANY RIGHT OF THE COUNTY AND THE PUBLIC IN AND TO A PORTION OF LA PALOMA ROAD, WINSTON WATERWAYS SUBDIVISION, KEY LARGO, MONROE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways, and WHEREAS, due notice has been published and a public hearing has been held in accordance with Chapter 336, Florida Statutes, and WHEREAS, at said public hearing the Board considered the argument of all parties present wishing to speak on the matter, and all premises considered concerning the renouncing and disclaiming of any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat, and WHEREAS, the Board has determined that vacation of the said road is for the general public welfare, and conforms to the requirement of Fla. Stat. Sees. 336.09 and 336.10 ; now, therefore, BE IT RESOLVED THAT THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, hereby renounces and disclaims any right of the County and the public in and to the following described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat, to-wit: SESSI PARCEL A PORTION OF LA PALOMA ROAD AS SHOWN ON THE AMENDED PLAT OF WINSTON WATERWAYS NO.2, AS RECORDED IN PLAT BOOK 6, AT PAGE 27 OF THE PUBLIC RECORDS OF MONROE COUNTY, FLORIDA, AND BEING CONTIGUOUS TO LOT 32 AND THE NORTH ONE HALF OF LOT 33, BLOCK 1, AMENDED PLAT OF WINSTON WATERWAYS, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 4, AT PAGE 144 OF THE PUBLIC RECORDS OF MONROE COUNTY, FLORIDA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF LOT 34, BLOCK 1 ON THE EASTERLY RIGHT-OF-WAY LINE OF LA PALOMA ROAD; THENCE RUN NORTH ALONG THE EASTERLY RIGHT-OF-WAY LINE OF LA PALOMA ROAD AND THE WESTERLY LINES OF LOT 34 AND THE SOUTH ONE HALF OF LOT 33, BLOCK 1, OF SAID AMENDED PLAT OF WINSTON WATERWAYS, FOR A DISTANCE OF 75.11 FEET TO THE SOUTHWEST CORNER OF THE NORTH ONE HALF OF SAID LOT 33, BLOCK 1 AND THE POINT OF BEGINNING OF THE PORTION OF SAID LA PALOMA ROAD HEREINAFTER DESCRIBED; FROM SAID POINT OF BEGINNING RUN WEST ON THE WESTERLY PROJECTION OF THE SOUTH LINE OF THE NORTH ONE HALF OF SAID LOT 33, BLOCK 1 FOR A DISTANCE OF 24.72 FEET TO A POINT 50 FEET SOUTHEASTERLY OF AND PARALLEL TO THE NORTHWESTERLY RIGHT- OF-WAY LINE OF LA PALOMA ROAD AS SHOWN ON SAID PLAT BOOK 6, PAGE 27; THENCE RUN N 18013'52" E FOR A DISTANCE OF 79.00 FEET TO THE NORTHWEST CORNER OF LOT 32, BLOCK 1 ON THE EAST RIGHT-OF-WAY LINE OF LA PALOMA ROAD; THENCE RUN SOUTH ALONG THE EAST RIGHT-OF-WAY LINE OF LA PALOMA ROAD AND THE WEST LINE OF LOT 32 AND THE NORTH ONE HALF OF LOT 33, BLOCK 1 FOR A DISTANCE OF 75.04 FEET BACK TO THE POINT OF BEGINNING.
