A RESOLUTION ADOPTING AND APPROVING AMENDMENT THREE TO THE MONROE COUNTY'S STATE HOUSING INITIATIVE PARTNERSHIP (SHIP) LOCAL HOUSING ASSISTANCE PLAN FOR STATE FISCAL YEARS 1998-1999,1999-2000, AND 2000-2001 WHEREAS, Monroe County and the Florida Housing Finance Corporation has approved the County's State Housing Initiative Partnership (SHIP) Local Housing Assistance Plan for State Fiscal Years 1998-1999, 1999-2000, 2000-2001 inclusive of amendments one and two; and WHEREAS, the County may amend the Plan in accordance with Florida Statute Chapter 420; and WHEREAS, the additional receipt of state funds, current state requirements for expenditure of funds for very-low and low income households, current housing market and costs for new/rehabilitation construction requires an amendment to the Plan; and WHEREAS, the SHIP Administrator on behalf of the County has conducted three public hearings to consider the proposed attached Amendment Three. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THE FOLLOWING SECTIONS ARE HEREBY ADOPTED AND APPROVED: Section 1. The attached Monroe County Local Housing Assistance Plan for the State Fiscal Years 1998-1999, 1999-2000, and 2000-2001 as amended per Amendment Three which incorporates previous Amendment One and Amendment Two. Section 2. The Chairman of the Board of Commissioners, on behalf of Monroe County, is granted the authority to execute all documents and certifications that may be required for submission and approval of the amended Local Housing Assistance Plan to the Florida Housing Finance Corporation and any applicable required changes that may be forthcoming from the Florida Housing Finance Corporation's review and approval process. I. PROGRAM DESCRIPTION a. Monroe County is the legal: entity that has prepared this Local Housing Assistance Plan in coordination and participation with the State's Housing Initiative Partnership (SHIP) Plan. The Plan is in compliance with Florida Statute 420.907 and the Florida Administrative Code (Rule 67-37). b. The design and implementation of the SHIP Program in Monroe County has a number of unique considerations: (1) The only county in the State of Florida whose entire geographical area has been declared an "Area of Critical State Concern" pursuant to Chapter 163.3244, Florida Statutes. (2) The only county in the State of Florida that has an executed Memorandum of Understanding with the State of Florida that requires the elimination of "one" existing residential cesspool prior to issuance of "one" new residential building permit. The eliminated cesspool must be in the same geographical area as the proposed new residential building permit. (Upper, Middle or Lower Keys). (3) State approved Rate of Growth Ordinance (RaGa) which allocates only 255 residential building permits inclusive of an affordable housing set-aside. (Per state approved bonus points for environmental work items such additional insulation, solar hot water, cisterns, 155 mile wind loads, raised elevation above required flood level, etc.) Annual permits reduced to 204. Currently only 88 annually approved due cesspit credit calculations. (4) The 1997 Florida Price Level Index published annually by the State of Florida has Monroe County for twelve straight years ranked with the highest cost of living of any of the sixty-seven counties. Within the indices used "housing" accounts for 37.86%. Monroe County ranked 27.45% higher in housing costs than the state average. The local SHIP program must cover over 100 plus linear miles of unincorporated county area and four incorporated areas. The housing needs within Monroe County far exceed the revenues available under the SHIP funding formula. The local SHIP Plan Page 1 of 28 program is designed to assist in leveraging other available housing funding, both under the Home Ownership and Rental strategies. c. The state fiscal years addressed in Monroe County's Local Housing Assistance Plan are fiscal years 1998-1999, 1999-2000, and 2000-2001. d. Advertisements of public meetings were placed in three separate newspapers serving Monroe County. Three public meetings were conducted countywide. (1) Old City Hall, Key West, Mile Marker 0, (2) Marathon Public Library, Mile Marker 48.5, and (3) Islamorada Public Library, Mile Marker 81.5. All facilities were handicap accessible. Proposed strategies and budget allocations were distributed and discussed. Draft copies of the Plan were posted at all county public libraries. Public input was incorporated into the 3-yr. plan. Three public hearings were advertised and conducted countywide to provide 1999 plan amendment three public input. Draft copies of the 1999 plan amendment were posted in all county public libraries. e. Support services for the implementation of Monroe County's SHIP program will continue to be through the Special Programs Office, Monroe County Housing Authority. This office has provided continued affordable housing support services through the HOME Program, Single Family Mortgage Revenue Bond (MRB) Program, Community Development Block Grant Program, and U.S. HUD's rental rehabilitation program. This office also coordinates with the City of Key West in providing housing for eligible AIDs' clients through AIDs, Help, Inc. and HUD's HOPWA Program. The Special Programs Office provides administrative support to the Monroe County Housing Finance Authority. Other referenced local support services through SPO are Consumer Credit Counseling Services of South Florida, Inc. and Habitat for Humanity. II. INTERLOCAL AGREEMENT. Since the initiation of Monroe County's local SHIP program in 1993, the program has been for countywide participants within the unincorporated and incorporated areas of the county. There is not any need for interlocal agreements. III. LOCAL HOUSING PARTNERSHIPS. a. The countywide landscape of financial institutions continues to vary through mergers, expansions, and acquisitions. Institutional needs or lack of need for Community Reinvestment Act requirements also vary. The county's success in the implementation of first time home buyers' opportunities under the county's HOME, SHIP and MRB programs has made all the lending institutions in Monroe County, participants in our Local Housing Partnership. Each financial institution located in Monroe County has participated in this Partnership through HOME and SHIP. Housing developers have participated by processing building permits through ROGO and providing turn- key housing units to an eligible HOME or SHIP program participant. Clients have been Plan Page 2 of 28 referred and assisted through Consumer Credit Counseling Services. U.S. Congressional assistance has expedited the process of obtaining U.S. Navy housing both for rental and home ownership. The Homeless Coalition has had specific units allocated to their use in the U.S. Navy excess property process (BRAC). The most recent initiative was the establishment by Fannie Mae of a South Florida Partnership Office that included Monroe County. A training session was conducted March 23, 1998 that included bankers, mortgage companies, Realtors and local government that introduced and made available to Monroe County a series of Fannie Mae products such as (1) Financing Home Repairs and Renovations up to $50,000, (2) Nonprofit Borrowers for Lease-Purchase Mortgage Loans, and (3) Community mortgages for low and moderate income households (3% down and generous L TVs). b. Monroe County has been able to combine local housing partnership resources to assist in reducing certain costs of housing. . The Monroe County Land Authority for Monroe County $1,573,600 (acquisition of property for affordable housing under the County's Plan 2000, Housing Element.) . The Monroe County Land Authority for City of Key West $1.956,000 (acquisition of property for affordable housing under the City's Plan 2000, Housing Element) . The Monroe County Housing Finance Authority $ 75,000 (Direct financial support to rental affordable housing units) . Monroe County $ 135,000 ($35,OOO-support to 1st Time Homebuyer Program and $100,000 to cesspool replacement. (low-income homeowners) . Florida Department of Environmental Protection $ 100,000 (Cesspool replacement for low-income homeowners) . City of Key West's Mayor's Revolving Loan Fund $ 500,000 (Rehabilitation of low-income homer owners' property . Habitat of Humanity $ 25,000 (Direct assistance/materials/equipment-elderly low income) . The Monroe County Land Authority for the City of Key West $2,718,000 for proposed affordable housing rental properties . The Monroe County Land Authority for the Bahama Conch $ 89,000 Community Land Trust, 227 Virginia St. Property purchase . FEMA Unmet Needs Funding affordable housing/MCHA $1,865,000 Financial institutions have provided portfolio loans to clients without sufficient job history, credit rating, etc. that would allow selling the mortgage on the secondary market. The Monroe County Housing Finance Authority made available Single Family Mortgage Revenue Bonds, Series 1997 through participating lenders. Plan Page 3 of 28 IV. STRATEGIES (includes application form requirements per each strategy) HOME OWNERSHIP STRATEGIES (Minimum of 65% of annual SHIP allocations) 1. Home Owner Cesspool Replacement and Septic Upgrade. State Health Department Compliance county and state mandated. Health & Safety. Fiscal Years: 1998-1999, 1999-2000, 2000-2001. Client Base: Very-low, low, and moderate income home owner households. Selection Criteria: Per date of issuance of State's Health Department's Compliance Letter and return date of Monroe County's Replacement application for very low and low income households. Moderate households only when during the time frame of application to contract, the low income household becomes moderate or purchase of a house through SHIP 1 st Time Homebuyer program. Recapture Provision: Assistance up to ($8,000) shall a direct grant. Assistance in the amount of ($8,001) or more shall be in the form of a loan. Ten years. zero interest. Forgiven 1/10th per year. Balance due/payable upon sale or title transfer. Indebtedness shall be forgiven prior to the tenth year if a central sewer system is available and the mortgagor connects up to the system. Strategy Leverage Funds: Sm. Cities, CDBG Program FI. Dept. of Environmental Protection funding State Budget appropriation Monroe County General Revenue Funds This strategy is currently in effect through joint agreement of the Governor's office and Monroe County per a Memorandum of Understanding between the state and county, July 22 , 1999 County Ordinance replacing County Ordinance 03-1997 and County Resolution 257-1997 amended as of July 21,1999. Currently, two hundred twenty one (221) applications have been received and are being processed for HQS inspections and issuance of Health Department Permits for aerobic treatment systems. As of July 31, 1999, eighty -one (81) have permits or contracts. SHIP funds to be allocated to this strategy in this three-year plan will continue to be combined with other available leveraged funding. 2. Emergency and/or Rehabilitation Home Owner Repairs. Health & Safety Work items. (i.e. electrical, plumbing, sewer system upgrades, roof, water connection, structural repairs, other exteriorlinterior repairs under HUD Housing Quality Standards. 1998-1999, 1999-2000, 2000-2001. Very-low and low income households. Initiation of SHIP FY application cycle on a first-come-first qualified basis until yearly funding expended. Recapture Provision: Grant available up to $8,500 for very-low income households and $7,500 for low income households.. Loans available up to $25,000 Fiscal Years: Client Base: Selection Criteria: Plan Page 4 of 28 for low income households and $35,000 for very low income households. The mortgage/note will be for a Twenty (20) year period, zero interest. It will be forgiven five (5%) per year based on mortgage covenantcompliance. Balance due and payable upon sale or transfer of property. Strategy Leverage Funds: Mayor's Revolving Loan Program Habitat for Humanity, CDBG Housing Funds This strategy is currently in effect with the county's existing SHIP Assistance Plan. It has served a number of clients with emergency health and safety situations requiring immediate assistance. The strategy will continue to function on a timely client response time to immediate health and safety issues. Where repairs are extensive, home equity loans are pursued. This strategy now incorporates the Plan's Home Ownership Contingency Strategy. 3. First Time Home Buyer Program Fiscal Years: 1998-1999,1999-2000, and 2000-2001. Client Base: Low Income and Moderate Income households. Selection Criteria Application and Lottery System. Recapture Provision: Funding secured by a mortgage and note. Due and payable upon sale or transfer of property or at the end of thirty years whichever is first. Loans are at zero percent and for a thirty year term. Mortgage/note are Fannie Mae approved. Minimum 3% down. PITI cannot exceed 30% of the gross family income unless their is agreement between the first mortgagee and the SHIP Administrator that in meeting the program's fiduciary responsibilities a higher percent of gross family income may be expended for PITI. Maximum loan amount is up to $20,000 per property for eligible moderate income households and up to $36,000 per property for eligible low income households. The property must be the principal and primary residence of the borrower and eligible for homestead exemption status. Funding may be for down payment assistance, closing costs, HQS rehabilitation requirements, and reduction assistance of PITI front-end ratio to 30%. Strategy Leverage Funds: Affordable Housing Program, First Mortgage Product. Single Family, Mortgage Revenue Bond programs. This is an existing SHIP strategy. Over 50% of all residential real estate sales in the county have been secondary homes. This strategy allows for a small number of low and moderate income residents to obtain home ownership and stabilize their employment and community involvement. It is officially recognized that current state imposed sales price maximums significantly limit the implementation of this strategy. 4. Home Ownership Development Strategy (Acquisition, Construction, Permanent Financing) Fiscal Years: 1998-1999,1999-2000, and 2000-2001. Plan Page 5 of 28 Client Base: Governmental agencies, not for profit organizations with an active 501 (c) (3) status for the purpose of the development of affordable housing and whose client base shall be very low and low income households. Selection Criteria: Initiation of SHIP FY application cycle on a first come-first qualified basis until yearly funding expended. SHIP Administrator must approved Developer's client selection process for compliance with the SHIP Program. Recapture Provision: Funds available for Development strategy shall be up to $60,000 per approved unit. Upon the completion of the use of funds for acquisition and construction financing, those funds required for permanent financing shall be secured by a mortgage and note, due and payable upon sale or transfer of property or at the end of thirty years whichever is first. Loans are at zero percent and for a thirty year term. Mortgage/note are Fannie Mae approved. Minimum 3% down. PITI cannot exceed 30% of the gross family income unless there is agreement between the first mortgagee and the SHIP Administrator that in meeting the program's fiduciary responsibilities a higher percent of gross family income may be expended for PITI. The property must be the principal and primary residence of the borrower and eligible for homestead exemption status. Funds required for permanent financing at the time of closing may be for down payment assistance, closing costs, and reduction assistance of PITI front-end ratio to 30%. All other development funds advanced to the organization shall be returned to the local SHIP Trust Fund at the time of sale/closing. 5. Disaster Mitigation/Recovery Strategy (Home Ownership) In the event of a state or federal disaster declaration affecting all or part of Monroe County, the SHIP Administrator on behalf of the Board of County Commissioners shall be authorized to: 1. Request and administer additional state funds to assist with disaster mitigation/recovery . 2. Use unencumbered local SHIP funds to meet the priorities of the Disaster Mitigation/ Recovery Strategy in an amount not to exceed twenty percent ( 20%) of the state's annual SHIP funding allocation. Unencumbered funds are subject to state program requirements from the allocated funding year. 3) Execute subordination documents of existing clients' SHIP mortgages and notes for the purpose of refinancing to provide needed dwelling rehabilitation/reconstruction and household goods replacement. Priorities of this strategy are as follows: (Work completed under this strategy shall be to required code) Plan Page 6 of 28 1. Tree and debris removal required to make low income home ownership units accessible to the low income occupants. 2 To locate temporary rental housing and provide required repairs to make the units habitable for those home owners whose dwellings are uninhabitable and have qualified for FEMA rental assistance. 3. Purchase emergency supplies to weatherproof damaged units occupied by low income households and post disaster assistance for non-insured required household repairs. Fiscal Years: Client Base: Selection Criteria: 1998-1999, 1999-2000,2000-2001. Very-low, low, median income households adjusted by family size. Priority consideration to very-low and low income households on a first come-first qualified basis per application verification. Recapture Provision: Grant only. Up to $10,000 per qualified unit (homeownership) Any subsequent reimbursement of local SHIP disaster mitigation recovery funds from private, state or federal sources shall be used in accordance with the approved Housing Assistance Plan strategies. Strategy Leverage Funds: FEMA housing assistance, private insurance and state disaster funds. RENTAL STRATEGIES 1. Rental Construction. (new or rehabilitation). Annual rental housing dedicated to very-low and low income eligible households. Fiscal Years: 1998-1999,1999-2000, and 2000-2001. Client Base: Very-low and low income households Selection Criteria: Priority 1. Existing or proposed units participating under state or federal rental assistance program. Priority 2. Conversion of dwelling or non-dwelling structures to annual rentals by not-for profits. Priority 3. New or conversion of existing property to annual rentals by for-profit entity. Individual applicants of eligible sponsors under the listed priorities shall be selected on a "first qualified" basis. Recapture Provision: Up to $10,000 per rental unit. Where the entity applying is a public agency with existing affordability criteria that is equal to or greater than the SHIP Program rental criteria a copy of the executed affordability agreement accompanied by an affidavit of compliance for a minimum of fifteen years shall be on file. Annual re- certification of applicable tenants' income shall be provided to the SHIP Administrator. Plan Page 7 of 28 Where the property is owned fee simple a fifteen year mortgage and note will be placed on the property with the affordability criteria covenants. The mortgage shall be forgiven 1/15th each year of compliance. Balance is due payable upon other use conversion, sale or transfer of property. Mortgage and note may be assumed by new owners accepting the covenants of the existing mortgage. Strategy Leverage Funds: U.S. HUD CGP funding, HOME Rental funding. CRA construction to permanent loan Fannie Mae Investor Mortgage programs FEMA Funding This is an existing SHIP strategy that has been expanded to include new construction as well as rehabilitation. Currently Group Homes have applied under this strategy. They still will be able to compete under this strategy but now will have their own set- aside. 2. Special Needs Housing, Group Home Construction. (new or rehabilitation). Fiscal Years: 1998-1999, 1999-2000, and 2000-2001. Client Base: Very-low and low income households. Selection Criteria: Priority 1. Long-term care facility. Priority 2. Highest percentage of very-low income clients. Priority 3. First-time SHIP assistance. Priority 4. Number clients served by facility. (When applications should be ranked equal, a lottery drawing will be conducted.) Individual applicants of eligible sponsors under the listed priorities shall be selected on a "first qualified" basis. Recapture Provision: Assistance for one facility/one provider that is less than $8,000 shall be in the form of a grant. Assistance for one facility/one provider that is greater than $8,000 shall be in the form of a mortgage and note. Annual re-certification of applicable tenants' income shall be provided to the SHIP Administrator. Where the property is owned fee simple, a fifteen year mortgage and note will be placed on the property with the affordability criteria covenants. The mortgage shall be forgiven 1/15th each year of compliance. Balance is due payable upon other use conversion, sale or transfer of properly. Mortgage and note may be assumed by new owners accepting the covenants of the mortgage. Where the facility is on leased property an annual affidavit of affordability and compliance shall be provided to the SHIP Administrator. No one provider shall be eligible to receive more than $24,000 in one fiscal year, unless there are not any other qualified applications. Strategy Leverage Funds: State of Florida, Children and Family Services funds U.S. HUD Grants, Foundation funds This a new strategy. Previously Special Needs housing (group homes) applied under the generic Rental Rehabilitation Strategy. The written SHIP application process will be followed. Plan Page 8 of 28 3. Rental Development Strategy (Acquisition, Construction, Permanent Financing) Selection Criteria: 1998-1999,1999-2000, and 2000-2001. Governmental agencies or not for profit organizations with an active 501 (c) (3) status for the purpose of the development of affordable rental housing and whose client base shall be very low and low income households. Initiation of SHIP FY application cycle on a first come-first qualified basis until yearly funding expended. Fiscal Years: Client Base: Recapture Provision: Upon the completion of the use of funds for acquisition and Assistance for one facility/one provider that is less than $6,500 shall be in the form of a grant. The maximum per provider per unit shall be up to $50,000 with a total annual amount not to exceed $100,000. Annual re-certification of applicable tenants' income shall be provided to the SHIP Administrator. Disaster Mitigation/Recovery Strategy (Rental) In the event of a state or federal disaster declaration affecting all or part of Monroe County, the SHIP Administrator on behalf of the Board of County Commissioners shall be authorized to: 1. Request and administer additional state funds to assist with disaster mitigation/recovery . 2. Use unencumbered local SHIP funds to meet the priorities of the Disaster Mitigation/ Recovery Strategy in an amount not to exceed twenty percent ( 20%) of the state's annual SHIP funding allocation. Unencumbered funds are subject to state program requirements from the allocated funding year. 3) Execute subordination documents of existing clients' SHIP mortgages and notes for the purpose of refinancing to provide needed dwelling rehabilitation/reconstruction and household goods replacement. Priorities of this strategy are as follows: (Work completed under this strategy shall be to required code) Plan Page 9 of 28 1. Tree and debris removal required to make low income rental and home ownership units accessible to the low income occupants. 2 To locate temporary rental housing and provide required repairs to make the units habitable for those residents ( renters) whose dwellings are uninhabitable and have qualified for FEMA rental assistance. Rents of assisted units shall not exceed the SHIP program's established rents. 3. Purchase emergency supplies to weatherproof damaged units occupied by low income households and post disaster assistance for non-insured required household repairs. Selection Criteria: 1998-1999, 1999-2000, 2000-2001. Very-low, low, median income households adjusted by family size. Priority consideration to very-low and low income households on a first come-first qualified basis per application verification. Fiscal Years: Client Base: Recapture Provision: Grant only. Up to $10,000 per qualified unit (rental). Any subsequent reimbursement of local SHIP disaster mitigation recovery funds from private, state or federal sources shall be used in accordance with the approved Housing Assistance Plan strategies. Strategy Leverage Funds: FEMA housing assistance, private insurance and state disaster funds. 5. Rental Contingency Strategy. Under rental Strategy 1 both new and rehabilitation rental opportunities are available. Previous use of this strategy has expended all of the strategy allocated funds. Should future implementation of this strategy indicate otherwise, the contingency strategy would expand the use of this strategy to moderate income. Should the contingency strategy become necessary it will be adopted by Amendment to the Plan. Monroe County's Affordable Housing Incentive Plan Strategy. (Updated as of July 1999) The County Commission has reviewed the goals and progress of its previously adopted Housing Incentive Plan and documented these goals and progress in its SHIP Annual Reports to the State of Florida. Implementation of the incentives have been recorded where actions of the BOCC and the members of the SHIP Partnership have directly affected the implementation of the Housing Incentives Plan. The County's Housing Incentive plan has been updated through July 1999, as to Monroe County's status of completion and compliance in accordance with the County Resolution 51-1998 and all subsequent BOCC approved Plan amendments. Copies of the County's Three Year Local Housing Assistance Plan, its Housing Incentive Plan and all Plan amendments have been made available countywide through the public library system. VIII. ADMINISTRATIVE EXPENSES a. The Monroe County Local Housing Assistance Plan shall be continued to be administered by the Special Programs Office, Monroe County Housing Authority, pursuant to the Governmental Interlocal Agreement approved by BOCC Resolution 162-1993, April 14, 1993, until further written notification to the Florida Housing Finance Corporation by the Board of County Commissioners, Monroe County. The Director of the Special Programs Office shall be Monroe County's official SHIP Program Administrator responsible to the Florida Housing Finance Corporation's SHIP Program, until further written notification from the County Administrator. The SHIP Administrator shall: (1) be responsible for the implementation of the Local Housing Assistance Plan and to meet the county's responsibilities under the State Housing Initiatives Partnership Program's regulations and reporting requirements. At a minimum this consists of: · A minimum of 65% of annual SHIP funds must be spent on eligible home ownership activities · A minimum of 75% of funds must be spent on eligible construction activities. · At least 30% of the annual allocation must be reserved for very low-income households (up to 50% of median income) · An additional 30% of the annual allocation must be reserved for low-income households (51 % to 80% median income) · SHIP funds may not be used to assist mobile homes or manufactured housing; unless the manufactured buildings are approved and permitted by DCA insignia. · Maximum Purchase Price must not exceed 90% of Monroe County's Median Area Purchase Price as established by U.S. Dept. of Treasury or as approved by FHFC. (2) after 90-calendar days from the publication of local Housing Assistance Funding Availability, have the authority to re-allocate the SHIP dollars within the specific HOME OWNERSHIP STRATEGIES and within the specific RENTAL STRATEGIES as the Administrator deems necessary to meet actual needs of applications received without SHIP Plan amendment or BOCC budget revision approval based on timely compliance with the applicable state SHIP Rule and Florida Statute, to meet the requirements of a minimum expenditure of 65% of annual SHIP allocations on HOME OWNERSHIP, 75% on Construction, 30% of annual SHIP allocations on very low income recipients and additional 30% of annual SHIP allocations on low income recipients. Any applicable program income/recaptured funds shall be subject to a five percent (5%) administrative costs in their re-allocation to eligible clients through approved strategies.
