At the March 24, 1994 meeting, the Board granted approval of the following:
Addendum to a Lease Agreement between Monroe County and Charles Pierce, for
hangar space at the Marathon Airport.
Amendment #002 to the Alliance for Aging, Inc., amending Rate Agreement #US-351.
Resolution No. 116-1994, authorizing the filing of a Grant Application with the Florida
Department of Environmental Protection, Boating Improvement Fund, and directing the
execution of same by the proper authorities for the installation of 18 channel markers in
Indian Key Channel.
Resolution No. 117-1994, authorizing the filing of a Grant Application with the Florida
Department of Environmental Protection, Boating Improvement Fund, and directing the
execution of same by the proper authorities for the emergency removal of derelict vessel
DV091457 in Cudjoe Key.
Amendment to the Agreement between Monroe County, the City of Key West, and the
Florida Department of Environmental Protection, Boating Improvement Fund for the
removal of Derelict Vessels, correcting the list of vessels removed.
Attached hereto are two certified copies of the subject Resolutions for your files, as well
as well as a fully-executed duplicate original of the Lease Agreement for return to Mr.
Pierce.
ADDENDUM TO LEASE AGREEMENT
THIS ADDENDUM to the original Lease Agreement, dated March
7, 1986, is hereby made and entered into this ~ day of
(h~ 1994, by and between the County of
Monroe, Lessor, and Charles Pierce, Lessee, whose mailing address
is Hurricane Harbour, #1-47 Street, Marathon, Florida, 33050.
The original Lease Agreement is amended as follows:
(1) Paragraph 1 is hereby amended to read as follows:
1. The Lessee shall have the right to use the leased
premises solely for the storage of aircraft. Any other use of
said premises shall be considered a material breach of this
lease.
(2) Paragraph F is hereby amended to read as follows:
F.(a)
Indemnification/Hold Harmless:
Lessee covenants
and agrees to indemnify and hold harmless Lessor from any and all
claims for bodily injury (including death), personal injury, and
property damage (including property owned by Monroe County) and
any other losses, damages and expenses (including attorney's
fees) which arise out of, in connection with, or by reason of the
Lessee utilizing the property governed by this lease agreement.
The extent of liability is in no way limited to, reduced, or
lessened by the insurance requirements contained elsewhere within
this agreement.
F. (b)
General Insurance Requirements:
Prior to Lessee
taking possession of the property owned by the Lessor, Lessee
shall obtain, at his own expense, insurance as specified in the
attached schedules, which are made part of this lease agreement.
Lessee will not be permitted to occupy or use the leased
property until satisfactory evidence of the required insurance
has been furnished to the Lessor as specified below.
Lessee shall maintain the required insurance, throughout the
entire term of this lease agreement, and any extensions, as
specified in the attached schedules. Failure to comply with this
provision may result in the irrrrnediate termination of the lease
agreement and the return of all property owned by the Lessor.
Lessee shall provide, to the Lessor, as satisfactory
evidence of the required insurance, either:
* Certificate of Insurance
or
* A Certified copy of the actual insurance policy
The Lessor, at its sole option, has the right to request a
certified copy of any or all insurance policies required by this
contract.
All insurance policies must specify that they are not
subject to cancellation, non-renewal, material change, or
reduction in coverage unless a minimum of thirty (30) days prior
notification is given to the Lessor by the insurer.
The acceptance and/or approval of Lessee's insurance shall
not be construed as relieving Lessee from any liability or
obligation assumed under this contract or imposed by law.
The Monroe County Board of County Corrrrnissioners, its
employees and officials will be included as "Additional Insured"
on all policies. Lessee shall carry its insurance with
insurance companies authorized to do business in the State of
Florida.
Any deviations from these General Insurance Requirements
must be requested in writing on the County prepared form entitled
.
"Request for Waiver of Insurance Requirements" and approved by
Monroe COllnty Risk Management.
(3) Paragraph G(5), extension of term is amended to extend
the lease for an additional period of five (5) years, commencing
on March 8, 1991, through March 7, 1996, subject to a review of
rates and charges.
(4) In all other respects, the original Lease Agreement,
dated March 7, 1986, remains in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this
Lease to be executed as of the day and year first above written.

Prior to the commencement of work governed by this contract, the Contractor shall ohtain
General Liability Insurance. Coverage shall be maintained throughout the life onlle contract and
include, as a minimum:
· Premises Operations
· Products and Completed Operations
· OIanket Contractual Liability
· Personal Injury Liability
· Expanded Definition of Property Damage
The minimum limits acceptable shall be:
$300,000 Combined Single Limit (CSL)
Ifsplit limits are provided, the minimum limits acceptable shall be:
$100,000 per Person
$300,000 per Occurrence
$ 50,000 Property Damage
An Occurrence Fonn policy is preferred. If coverage is provided on a Claims Made policy, its
provisions should include coverage for claims filed on or afler the enective datc of this contract.
In addition, the period for which claims may be reported should extend for a minimum of twclve
(12) months following the acceptance of work by the County.
The Monroe County Board of County Commissioners shall be named as Additional Insured on all
policies issued to satisfY the above requirements.
