ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE
DIRECTOR OF GROWTH MANAGEMENT IN LAND USE
DISTRICT MAP BOUNDARY INTERPRETATION NUMBER
107 REGARDING A PORTION OF THE NE 1,14 OF SECTION 34,
TOWNSHIP 67 SOUTH, RANGE 26 EAST, GEIGER KEY,
MONROE COUNTY, FLORIDA, AT APPROXIMA TEL Y MILE
MARKER 10, AND HAVING THE FOLLOWING REAL ESTATE
NUMBER: 00146240-000 I 00.

WHEREAS, the property is described as a portion of the NE 1,14 of Section 34, Township
67 South, Range 26 East, Monroe County, Florida, and more particularly described as follows:
Beginning at the North 1,14 comer of said Section 34; thence S 890 46' 29" E along the North
line of the NE 1,14 of said Section 34 for 124.45 feet; thence S 000 13' 31" W for 15.45 feet;
thence S 410 33' 38" E along an existing channel for 21.14 feet to the mean high water line
(N.G.V.D. Elev. + 1.10'); thence meander said mean high water line South westerly for 339
feet more or less to the West line of the NE 1,14 of said Section 34; thence N 000 13' 31" W
along the West line of the NE 1,14 of said Section 34 for 338.07 feet to the Point of
Beginning. Containing 0.63 acres, more or less. Identified by RE: #00146240-000100;
and
WHEREAS, the above-described property was zoned RU-5, mobile home residential
district, prior September 15, 1986; and
WHEREAS, the Land Use District Map signed by Charles Pattison designates the above-
described property as both Military Facilities (MF) and Urban Residential Mobile Home (URM);
and
WHEREAS, the base map used to formulate the Pattison Maps did not show property
lines. Therefore, boundaries were drawn leaving some properties in two zoning districts when the

intent was to include the entire parcel in one land use district. In this case the subject property
described by metes and bounds should have been located entirely in the URM land use district; and
WHEREAS, the Land Use District Map signed by Donald Craig designates the above-
described property as Military Facilities (MF); and
WHEREAS, the future land use map (FLUM) of the Year 20 I 0 Comprehensive Plan
designates the property Military (M). The scale of the FLUM (I" equals 2000') makes it difficult
to be site specific. The intent of the FLUM was to follow the Craig Maps zoning boundary line.
However, the Craig Maps were intended to follow the Pattison Map boundary lines. The mistake
on the Craig Map was transferred to the FLUM and therefore a portion of land identified under RE:
#00146240-000 I 00 was not included as Residential High (RH); and
WHEREAS, the purpose of the Military land use category is to provide for federally
owned lands used for Military purposes. The MF zoning designation on the Craig Maps is
inconsistent with the purpose of the Military land use category because the subject property has
been in private ownership since 1983; and
WHEREAS, the purpose of the URM land use district is to recognize the existence of
established mobile home parks and subdivisions. The purpose of the RH category is to provide for
high-density single-family, multi-family, and institutional residential development, including
mobile and manufactured homes. The subject property meets the purpose for the URM and RH
categories; and
WHEREAS, the Urban Residential Mobile Home (URM) Land Use District and the
Residential High (RH) Future Land Use District are the correct Land Use Designations for the
above-described property; NOW
THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, then:
The action of the Director of Growth Management, Timothy J. McGarry, recommending approval
of the district boundary change in Land Use District Map Boundary Interpretation Number 107,
dated September 17, 1999, is hereby found to be in conformance with the standards set forth in
Section 9.5-3(m)(2), of Monroe County Code; and is therefore approved.
The above-described property shall be designated as Urban Residential Mobile Home (URM)
District, not Military Facilities (MF).
The above conclusion of law is predicated upon the findings of fact and conclusions of law
outlined in the staff recommendation, which this Board hereby adopts as its own.

The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the
Monroe County Planning Department.
The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the
Florida Department of Community Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting held on the 14th day of October, 1999.
