AN ORDINANCE OF THE BOARD OF COUNTY =' o
COMMISSIONERS OF MONROE COUNTY, FLORIDA, •
AMENDING CHAPTER 6.3 OF THE MONROE
COUNTY CODE, REDUCING THE WAITING PERIOD z .
FOR FORECLOSURE UPON CODE ENFORCEMENT m
LIENS; PROVIDING FOR LIEN FORECLOSURE BY THE -- N
COUNTY ATTORNEY; EXTENDING THE DURATION OF •
CODE ENFORCEMENT LIENS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH;
PROVIDING FOR INCORPORATION INTO THE
MONROE COUNTY CODE OF ORDINANCES; AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Legislature of the State of Florida has amended Florida Statute
Sections 162.09(3) and 162.10; and
WHEREAS, Monroe County wishes to amend its relevant Code sections to
comport with the above referenced Legislative amendments; and
WHEREAS, Monroe County, Florida, hereby amends Monroe County Code
Section 6.3 to comport with said Legislative amendments to Chapter 162, Florida
Statutes; NOW THEREFORE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA,THAT:
Section 1. Monroe County Code Section 6.3-6(3)(c), Administrative fines;
liens, is amended as follows:
6.3-6(3)(c)
(3) Any previous violations committed by the
violator.
(c) A certified copy of an order imposing a fine
may be recorded in the public records and
thereafter shall constitute a lien against the land on
which the violation exists and upon any other real or

Highway, Marathon, Monroe County, Florida, the Board of County Commissioners of
Monroe County, Florida, intends to consider the adoption of the following County
ordinance:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, AMENDING CHAPTER 6.3 OF THE MONROE
COUNTY CODE, REDUCING THE WAITING PERIOD FOR FORECLOSURE UPON
CODE ENFORCEMENT LIENS; PROVIDING FOR LIEN FORECLOSURE BY THE
COUNTY ATTORNEY; EXTENDING THE DURATION OF CODE ENFORCEMENT
LIENS; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION
INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING FOR
AN EFFECTIVE DATE
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person
decided to appeal any decision made by the Board with respect to any matter
considered at such hearings or meetings, he will need a record of the proceedings,
and that, for such purpose, he may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which
the appeal is to be based.
Copies of the above-referenced ordinance are available for review at the
various public libraries in Monroe County, Florida.

CODE ENFORCEMENT LIENS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH;
PROVIDING FOR INCORPORATION INTO THE
MONROE COUNTY CODE OF ORDINANCES; AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Legislature of the State of Florida has amended Florida Statute
Sections 162.09 (3) and 162.10; and
WHEREAS, Monroe County wishes to amend its relevant Code sections to
comport with the above referenced Legislative amendments; and
WHEREAS, Monroe County, Florida, hereby amends Monroe County Code
Section 6.3 to comport with said Legislative amendments to Chapter 162, Florida
Statutes; NOW THEREFORE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA. THAT:
Section 1.
Monroe County Code Section 6.3-6(3)(c), Administrative fines;
liens, is amended as follows:
6.3-6(3) (c)
(3) Any previous violations committed by the
violator.
(c) A certified copy of an order imposing a fine
may be recorded in the public records and
thereafter shall constitute a lien against the land on
which the violation exists and upon any other real or
personal property owned by the violator; and it may
be enforced in the same manner as a court
judgment by the sheriffs of this state. including levy
against the personal property. but shall not be
deemed to be a court judgment except for
enforcement purposes. After six three f# ill months
from the filing of any such lien which remains
unpaid. the code enforcement board may
authorize the attorney retained for the coda
enforcement board County Attornev to foreclose on
the lien. No lien created pursuant to the provisions
of this chapter may be foreclosed on real property
which is a homestead under section 4. article X of
the state constitution.
Section 2.
Monroe County Code Section 6.3-7. Duration of lien. is amended
as follows:
6.3-7. Duration of lien.
No lien provided under this chapter, or under
chapter 162. Florida Statutes. shall continue for a
period longer than five..twentv +at (20) years after the
certified copy of an order imposing a fine has been
recorded unless within that time an action to
foreclose on the lien is commenced in a court of
competent jurisdiction. The continuation of the liens
effected by the commencement of the action shall
not be good against creditors or subsequent
purchasers for valuable considerations without
notice, unless a notice of lis pendens is recorded.
Section 3.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
Section 4.
If any section, subsection. sentence, clause, item, change or
provision of this ordinance is held invalid, the remainder of this ordinance shall not be
affected by such invalidity.
Section 5.
This ordinance shall take effect immediately upon receipt of
official notice from the Office of the Secretary of State of the State of Florida that this
ordinance has been filed with said Office.

The Clerk of the Board is hereby directed to forward a copy of this
Ordinance to Municipal Code Corporation for incorporation into the Monroe County
Code of Ordinances.
