Section 6-42(a), Monroe County Code, is hereby ahie~ded t71 reaCPas follows: (a) The county, the state, the United States, all corporote municipalities situated wholly 'tlithin the boundaries of the county, the city electric system, the Florida Keys Aqueduct Authority, the county school district, other governmental entities, which have provided to the county fee exemptions for development, environmental or similar permits, and the fire departments and volunteer emergency medical departments, shall be exempt from the requirements for a building fee for construction in the county. (a) The following governmental entities are exempt from County building permit fees but only if the listed entity does not charge the County a fee (including an impact fee) for development. environmental, or similar permits. or for right-of- way use: (i) (ii) (iii) the State of Florida (including the South Florida Water Management District and the South Florida Regional Planning Council); the United States; the municipalities wholly located within the County; City Electric System; Florida Keys Electric Co-op; Florida Keys Aqueduct Authority. (iv) (v) (vi) The following entities are exempt from the County building permit fees: (i) Monroe County; (ii) the volunteer fire departments; and (iii) the volunteer emergency medical departments. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 3. If any section, subsection, sentence, clause, item, change or provision of this ordinance is held invalid. the remainder of this ordinance shall not be affected by such invalidity. Section 4. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 5. The Clerk of the Board is hereby directed to forward a copy of this Ordinance to Municipal Code Corporation for incorporation into the Monroe County Code of Ordinances. Section 6-42(a), Monroe County Code, is hereby amended to read as follows: (a) The county. tho state, the United States, all corporate municipalities situated wholly within the boundaries of the county. the city electric system, tho Florida Keys Aqueduct ,4.uthorily, tho county school district, other govemmental entities, '""hich have provided to the county foe exemptions for development, environmental or similar permits, and the firo dopartments and volunteer emergency medical departments, shall be exempt from the requirements for a building fee for construction in tho county. (a) The following govemmental entities are exempt from County building permit fees but only if the listed entity does not charge the County a fee (including an impact fee) tor development, environmental. or similar permits, or tor right-ot- way use: (i) (ii) (iii) the State ot Florida (including the South Florida Water Management District and the South Florida Regional Planning Council); the United States; the municipalities wholly located within the County; City Electric System; Florida Keys Electric Co-op; Florida Keys Aqueduct Authority. (iv) (v) (vi) The following entities are exempt from the County building permit fees: (i) Monroe County; (ii) the volunteer fire departments; and (iii) the volunteer emergency medical departments. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 3. If any section, subsection, sentence, clause, item, change or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 5. The Clerk of the Board is hereby directed to forward a copy of this Ordinance to Municipal Code Corporation for incorporation into the Monroe County Code of Ordinances.
