Ordinance 036-1996Building Department ORDINANCE NO. 036 _1996 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AMENDING SECTION 6-44, MONROE COUNTY CODE, DELETING A PROVISION CONCERNING INSPECTION FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE 3 -n c� z r. f,, WHEREAS, Section 6-44, Monroe County Code, requires wor . which rs — ben z y. '-- � concealed before inspection to either be exposed for inspection or tE be--certi d bFan - o architect or engineer that said work is in conformance with appropriate Code provoons h& a provision for inspection fees to be charged pursuant to Section 6-41; and WHEREAS, Section 6-41, Monroe County Code, already provides for fees where inspections are required; and WHEREAS, no inspections are required if an architect's or engineer's certification is provided; NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: Section 1. Section 6-44, Monroe County Code, shall be revised to read as follows: If any work is concealed before an inspection has been made and the work approved, the work must either be exposed, inspected and approved, or an architect's or engineer's certification that the concealed work is in conformance with the appropriate code shall be provided to the Building Official before any further work at the site may continue. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Amend MCC 6-44 Section 3. If any section, subsection, sentence, clause, item, change or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 5. The Clerk of the Board is hereby directed to forward a copy of this Ordinance to Municipal Code Corporation for incorporation into the Monroe County Code of Ordinances.
