AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS ADOPTING A LAND USE DISTRICT
MAP AMENDMENT CHANGING THE LAND USE
DESIGNATION FOR THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION'S PROPERTY LEGALLY
DESCRIBED AS LOTS D1-D16, LOTS 1-25: AND

WHEREAS, Section 9.5-511(c), Monroe County Code of Ordiiianc-
es (Code), provides that the land development regulations (Chap-
ter 9.5 of the Code), including the land use district maps, may
be amended or changed at any time; and
WHEREAS, the Board of County Commissioners on February 28,
1986, designated Lots D1-D16, Lots 1-25 and Tracts A, B, C and D
of Little Crawl Key Subdivision, Little Crawl Key, Section 35,
Township 65 South, Range 33 East, Real Estate Numbers
360230-000100 through 360230-004600, 099770-000000 and
099780-000000 as Destination Resort (DR); and
WHEREAS, the applicant has requested a map amendment for the
above described property to change its land use district designa-
tion from Destination Resort (DR) to Parks and Refuge (PR); and

WHEREAS, the Planning and Environmental Resources Departments
have reviewed the proposed land use district map changes and
recommended approval; and
WHEREAS, during the amendment process, the Development Review
Committee, after due notice and public participation in the hear-
ing process, has reviewed the proposed land use district map
changes and recommended approval; and
WHEREAS, during the amendment process, the Monroe County
Planning Commission, sitting as the local planning agency, after
due notice and public participation in the hearing process, has
reviewed the proposed land use district map changes and the recom-
mendations of the Planning and Environmental Resources Depart-
ments and the Development Review Committee; and
WHEREAS, the Planning Commission adopted the following
findings of fact and conclusions of law:
1. The Parks and Refuge designation makes the property's zoning
consistent with the Monroe Countv Year 2010 Comprehensive
Plan and its Future Land Use Map.
2. The permitted uses in the Parks and Refuge district are more
compatible with surrounding properties than are the uses in
Destination Resort.

WHEREAS, the Planning Commission has found these recommenda-
tions to be consistent with the Monroe County Comprehensive Plan
and recommends that the Monroe County Board of Commissioners
approve the applicant's request to rezone the property from Desti-
nation Resort (DR) to Parks and Refuge (PR); and
WHEREAS, the Monroe County Board of Commissioners, after due
notice and public participation in the hearing process, has re-
viewed all of the above recommendations; and
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF MONROE COUNTY, FLORIDA: THAT
Section 1. This Board specifically adopts the findings of
fact and conclusions of law reached by the Planning Commission as
our own; and therefore
Section 2. The previously described property, as shown on
the attached map, which is hereby incorporated by reference, and
attached as exhibit 1, shows that the property is currently desig-
nated as Destination Resort (DR) and shall now be designated as
Parks and Refuge (PR).
