ITEM BACKGROUND: The Key West International Airport (KWIA) is in the pre-construction phase of the Aircraft Overflow Apron and Mitigation Project. In order to perform the work required to complete the project, the County is required to obtain a permit from the South Florida Water Management District(SFWMD) for the mitigation component of the project. To obtain the permit from the SFWMD, the County has to submit proof of ownership for the areas upon which environmental mitigation work is being proposed. The proof of ownership, in this instance, is being provided through an Ownership and Encumbrance Report prepared by O'Neal Surveying and Mapping (OSM). In the encumbrance report, the County learned for the first time that the City of Key West owned a 50 foot strip of land that runs east—west just to the north of the runway. Both of the sites on the airport that are being proposed for use as mitigation land lie partially within the 50 foot strip. The City of Key West has agreed to quit claim the strip to the county, at no cost, so that the County has clear title to the mitigation sites. Clear title is necessary in order to obtain the SFWMD permit required for the Aircraft Overflow Apron and Mitigation Project. It should be noted that since the conveyance of the strip is at no cost, the provisions of F.S. 125.355 are not triggered by this transaction. The documents are being finalized as of the agenda deadline so revised back up may be substituted at some point. Staff has been advised that the Key West City Commission is expected to approve the transfer at its meeting on December 6, 2022.
