C6 WHEREAS, Section 9.5-511(c), Monroe County Code of Ordinanc- es (Code), provides that the land development regulations (Chap- ter 9.5 of the Code), including the land use district maps, may be amended or changed at any time; and WHEREAS, the Board of County Commissioners on February 28, 1986, designated the Flamingo Inn Motel located in Dorsett Subdivision on Lots 15, 16, the southern 25 feet of lot 17 and Old State Road 4A adjacent to lot 15 at mile marker 59.5 on Grassy Key, Monroe County, Florida as Improved Subdivision (IS); and WHEREAS, the applicant has requested a map amendment for the above described property to change its land use district designa- tion from Improved Subdivision (IS) to Suburban Commercial (SC); and Page 1 FLAMINGO.22/TXTAMAP Initials WHEREAS, the Planning and Environmental Resources Departments have reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hear- ing process, has reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district map changes and the recom- mendations of the Planning and Environmental Resources Depart- ments and the Development Review Committee and recommended ap- proval; and WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has re- viewed all of the above recommendations; and WHEREAS, the Monroe County Board of Commissioners adopts the following findings of fact: 1. Based on site plans provided by the applicant and a site visit performed by staff, the property contains a 12-room motel that has existed since the mid-19701s; and Page 2 FLAMINGO.22/TXTAMAP Initials 2. The existing zoning of the property is Improved Subdivision, which does not permit motels; and 3. The comprehensive plan states that existing hotels and motels are to be included in the Mixed Use/Commercial future land use category; and 4. The Suburban Commercial zoning district is compatible with the Mixed Use/Commercial future land use category, while Improved Subdivision is not; and 5. The existing uses surrounding the motel include medium to high density, permanent and transient residential uses; and WHEREAS, the Monroe County Board of Commissioners adopts the following conclusions of law; 1. Improved Subdivision zoning of this property was an error and makes the Flamingo Inn a nonconforming use; and 2. Suburban Commercial zoning of this property is appropriate and is consistent with the overall goals, objectives and policies of the Monroe County Year 2010 Comprehensive Plan. 3. The Mixed Use/Commercial FLUM designation of this property does not have an adverse impact on the community character; and Page 3 FLAMINGO.22/TXTAMAP Initials NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUNTY, FLORIDA: THAT Section 1. This Board specifically adopts the findings of facts and conclusions of law stated above; and therefore Section 2. The previously described property, as shown on the attached map, which is hereby incorporated by reference, and attached as exhibit 1, shows that the property is currently desig- nated as Improved Subdivision (IS) and shall now be designated as Suburban Commercial (SC).
