Addendum No. 1 Addendum No.1-4/6/2022 Key West International Airport Noise Insulation Program Construction of KWBTS Final Phase Item Refer to: Description GEN Addendum Information This Addendum is issued for the purpose of modifying and/or clarifying the Bidding Documents and shall be constructed as being as much a part of the Bidding Documents as though originally contained therein. 001 Mandatory Pre-Bid The mandatory online Pre-Bid Meeting was held on March 31,2022 at 1:00 pm. A copy Meeting of the Pre-Bid Meeting Minutes, Pre-Bid Meeting Slide Presentation, Pre-Bid Meeting List of Attendees are included as part of this addendum.The slide presentation has been updated since the meeting to conform with this addendum. Modified information is labeled. 002 Volume 1 Bidding and Section 90-06 has been revised to comply with the requirements of FAA Advisory Circular Contract Requirements 150-5370-10H. General Provision 90-06 Partial Payments Delete Section 90-06"Progress Payments" in its entirety. Replace with Section 90-06"Progress Payments" included as part of this addendum. 003 Volume 1 Bidding and Question:"In follow up to the comment made by DEC in the Mandatory Pre-Bid meeting Contract Requirements yesterday regarding the 15%requirement that the awarded general contractor perform Bidder Question that amount of labor with its own forces it is my understanding after reading that requirement again that supervision is not consider labor and cannot be used to reach that labor total.The clause in the contract references workmen under his/her immediate superintendence." Response: VOLUME 1 SECTION B INSTRUCTIONS TO BIDDERS,23.SUBLETTING OR ASSIGNING OF CONTRACT: Delete Text: "Unless otherwise stipulated in the proposal or special provisions and with the assistance of workmen under his/her immediate superintendence and reported on his/her payroll,contract work of a value not less than fifteen percent(15%)of the total contract amount must be performed by the General Contractor." Page 1 of 2 004 Volume 4 Construction Question:Unit B105,the outside unit calls for 18,000 Btu/Dual Zone but the inside calls Drawings for(2)6000 Btus.Can you please find out from the engineer if it is(2)9,000 Btus for the Bidder Question inside or 12,000 Btus for the outside. Response:The schedule on the drawing is correct.The outside unit is an 18,000 btu/h unit matched with (2)6,000 btu/h inside units.The reason the outside unit is 18,000 btu/h is because that is the smallest multi-zone unit.As long as the inside unit total capacity is 50%or more of the outside unit the selection will work. In this case we have 12,000 btu/h of inside unit&18,000 btu/h of outside unit. 005 Volume 4 Construction On each Sheet Al for all 18 Units,delete the Window Schedule and Door Schedule in its Drawings entirety. Replace with Building A B C Window and Door Schedule included as part of this addendum. Partial payments will be made at least once each month as the Work progresses. Said payments will be based upon estimates prepared by the Program Manager of the value of the work performed and materials complete in place in accordance with the Contract, Plans, and Specifications. Such partial payments may also include the delivered actual cost of those materials stockpiled and stored in accordance with the subsection titled PAYMENT FOR MATERIALS ON HAND of this section. No partial payment will be made when the amount due the Contractor since the last estimate amounts to less than five hundred dollars. From the total of the amount determined to be payable on a partial payment, 10 percent of such total amount will be deducted and retained by the Owner for protection of the Owner's interests. Unless otherwise instructed by the Owner, the amount retained by the Owner will be in effect until the final payment is made except as follows: (1) Contractor may request release of retainage on work that has been partially accepted by the Owner in accordance with subsection 50-14 titled PARTIAL ACCEPTANCE. Contractor must provide a certified invoice to the RPR that supports the value of retainage held by the Owner for partially accepted work. (2) In lieu of retainage, the Contractor may exercise at its option the establishment of an escrow account per subsection 90-08 titled PAYMENT OF WITHHELD FUNDS. The Contractor is required to pay all subcontractors for satisfactory performance of their contracts no later than 30 days after the Contractor has received a partial payment. Contractor must provide the Owner evidence of prompt and full payment of retainage held by the prime Contractor to the subcontractor within 30 days after the subcontractor's work is satisfactorily completed. A subcontractor's work is satisfactorily completed when all the tasks called for in the subcontract have been accomplished and documented as required by the Owner. When the Owner has made an incremental acceptance of a portion of a prime contract, the work of a subcontractor covered by that acceptance is deemed to be satisfactorily completed. When at least 95% of the work has been completed to the satisfaction of the Program Manager, the Program Manager shall, at the Owner's discretion and with the consent of the surety, prepare estimates of both the contract value and the cost of the remaining work to be done. The Owner may retain an amount not less than twice the contract value or estimated cost, whichever is greater, of the work remaining to be done. The remainder, less all previous payments and deductions, will then be certified for payment to the Contractor. It is understood and agreed that the Contractor shall not be entitled to demand or receive partial payment based on quantities of work in excess of those provided in the proposal or covered by approved change orders or supplemental agreements, except when such excess quantities have been determined by the Program Manager to be a part of the final quantity for the item of work in question. No partial payment shall bind the Owner to the acceptance of any materials or work in place as to quality or quantity. All partial payments are subject to correction at the time of final payment as provided in subsection 90-09 titled ACCEPTANCE AND FINAL PAYMENT.
