Monroe County, FL and FDOT, Case No. 17-CA-82-K M • Monroe County v. Coher & Coher Invest. Co. Ltd., Case No. 18-CA-674-P a Cases for Closed Sessions 1. AshBritt, Inc. v. Monroe County & FDOT, 16t" Cir. 17-CA-802-K. AshBritt sued 0 the County for breach of contract and for breach of implied covenant of good It faith and fair dealing. The County answered and moved for summary judgment (MSJ). On 8/31/22, AshBritt issued a revised settlement offer, which was discussed with the BOCC in closed session. On 12/2/22, the Florida Commission on Ethics voted unanimously to approve the draft advisory opinion in filed number 2791, which is relevant to AshBritt's settlement offer. On 12/7/22, ° the BOCC held a closed session. Another closed session is set for 2/15/23. 2. Monroe County v. Coher & Coher Invest. Co., Ltd., 16t" Cir. 18-CA-674-P. Code U lien foreclosure arising out of ten (10) code enforcement cases. The parties entered into a settlement agreement on 8/25/21. The owner $1,102,922.18 at the time of the agreement because each lot/unit was treated as a separate case. In the settlement agreement, the County agreed to accept and the property owners agreed to pay a total of $36,986.09, with an immediate payment of $15,000 followed by equal monthly installments until the full settlement amount was paid. The settlement agreement provided that if the property owner failed to pay in full, the fine would revert back to the full amount. The property owner made the initial payment of$15,000, and then two additional payments of$1,835 each, but has defaulted on the balance of the payments. The owner has made a revised offer to resolve the case. Closed session to be held on 2/15/23. 1 Packet Pg. 2507 0.1.a Other Cases of Interest at Trial Court Level 3. Peter & Olivia Poto v. Monroe County, 22-CA-709-K, quiet title and specific performance action by buyers of a property where seller had sold development rights to one lot and entered into a unity of title as part of the County's Less than Fee program. On 1/18/23, the County filed a Motion to Dismiss, which is set for hearing on 3/27/23. 4. Sunset Garden Estate Land Trust v. Monroe County, 19-CA-460-R Property owner filed a complaint alleging that various state laws including the Right to Farm Act, , preempt the County's land development regulations from applying to its parcel and Q seeking judicial declarations that its alleged agricultural activities are immune from the County's land development regulations. On 12/1/22, the court granted the County's motion for leave to file a counterclaim for declaratory and injunctive relief against the Land Trust. On 12/9/22, plaintiffs moved for summary judgment and some discovery motions against the County. The motion for summary judgment CL is set for hearing on 2/1/23. 5. Burke Construction Group, Inc. v. Monroe County, CA-M 19-80 (state court case). On 7/11/19, Burke Construction Group sued to challenge the County's bid protest procedure and decisions to award contracts for the Marathon Library and Cudjoe Fire Station projects to other contractors. The County answered and is engaged in discovery. 0 U 6. Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K. Declaratory Judgment N suit filed by Roy's against County as part of its eviction suit against its tenant. On 10/4/18, the County countersued the trailer park and the park residents, seeking an injunction prohibiting occupancy at the park until serious fire and life safety issues have been addressed, and for appointment of a receiver, and a declaratory relief cause of action to determine whether the owner or tenants are responsible for the code violations. The park owner has submitted an application to the Planning t Department to redevelop the park for affordable housing. The Planning Commission CL hearing was held on 12/14/2022. The public hearing on the owner's application scheduled for the 1/18/23 BOCC meeting was continued until May. 0 7. Galleon Bay Corp. v. Monroe County and State of Florida — 02-CA-595-K. This takings case resulted in a final judgment in the amount of $480,511. A Satisfaction of Judgment was issued. The parties are engaged in discovery on the only 0 remaining issue of attorneys' fees. The County's motion to compel discovery is U set for hearing on 2/21/23. A deposition of Vivienne Schleu is scheduled for 2/24/23. c� 8. Manuel Melo v. Monroe County, 22-CA-091-P. On 2/24/22, Plaintiff found to invalidate a Final Order of the Code Compliance Special Magistrate that was entered in CE17110041 in 2019. The order found Plaintiff in violation for clearing his property, which is endangered species habitat, without a permit. The County's motion to dismiss was heard on 12/9/22. On 1/9/23, the County submitted a proposed order granting its motion to dismiss and Plaintiff filed a notice of voluntary dismissal in response. 2 Packet Pg. 2508 0.1.a 9. Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc., 17-CA-631-K. The County sued both SVFD and Wi-Fi to invalidate a lease between SVFD and Wi-Fi on the grounds that SVFD had not approved the lease in an open meeting. The County prevailed and the lease was invalidated. Wi-Fi has a separate suit pending against the SVFD that is holding up the transfer of the property to the County. Mediation between Wi-Fi, the SVFD, and the County is ongoing to resolve the separate claim and the County's judgment for attorneys' fees and costs for $217,159.86. At Wi-Fi's request, Fortress Secured, LLC submitted a public private partnership (P3) proposal that would serve as the basis for settlement. On 1/18/23, the BOCC approved an interim agreement with Fortress Secured, LLC to design, build and finance a replacement fire station on Sugarloaf Key at the current location a of the Sugarloaf Volunteer Fire Department Station #10. A final agreement would contemplate resolution of all related claims and result in a transfer of the property from the SVFD to the County. It 10.TommyAlfonso on behalf of T.A., a Minor, v. Monroe County, Florida, 22-CA-108-K. 0 Parent of minor sues alleging that child was injured on an observation deck at the back of Bernstein Park. Discovery is ongoing. 11.Burkhardt v. Monroe County, No. 22-cv-10041 (S.D. Fla.). On 4/28/22, Plaintiff filed a Complaint in state court seeking to declare whether Plaintiff has a right to engage in commercial fishing uses on his Big Pine Key property. The complaint also ssought to invalidate the Habitat Conservation Plan and Incidental Take Permit issued by U USFWS. On 5/25/22, the County removed the action to federal court because the litigation presents a federal question. Plaintiff filed an amended complaint on Q 12/19/22 that did not raise a federal question. The federal court relinquished jurisdiction back to the state court on 1/9/23. On 1/17/23, the County filed its answer to the amended complaint. 12.Mark Thompson v. Monroe County and City of Key West, 22-CA-113-K. On 2/24/22, 0 Plaintiff, a former pumpout boat employee, filed a complaint suing Monroe County t under the Jones Act for injuries arising during his employment. On 6/1/22, Plaintiff filed an amended complaint, adding the City of Key West as a party. The County has requested defense and indemnification from the City pursuant to the terms of an interlocal agreement. On 8/22/22, the Court assigned a projected trial date of 12/6/23. The parties took the deposition of the Key West boat captain on 12/21/22 and the deposition of the plaintiff Mark Thompson on 12/22/22. A mediation is scheduled for 3/28/23. c0 Appellate Cases of Interest 1. Ray Rey & Ramille Rey v. Monroe County, 22-AP-2-P. On 3/1/22, the owners filed a notice of appeal of the Final Order of the Special Magistrate that found them in violation due to improvements to a nonconforming lower enclosure. Briefing is complete. Awaiting a ruling or the scheduling of oral argument. 3 Packet Pg. 2509 0.1.a 2. Maschal et al. v. Monroe County and FKAA(now known as Crawford et al. v. Monroe County and FKAA), CA K 19-186 (Third DCA Case No. 22-754) — Suit against Monroe County and FKAA by Banks Prevatt and 11 other individuals seeking similar relief to the Delaney lawsuit, which the County won. On 9/30/21, the Court dismissed the Plaintiffs' Second Amended Complaint, but also granted the Plaintiffs' motion to file a supplementary complaint. On 10/11/21, Plaintiffs filed a different supplementary complaint. On 4/4/22, the Court denied the Plaintiff's motion for reconsideration and granted the County and FKAA's motion for reconsideration, thus denying the Plaintiff's motion to file a supplementary complaint. On 5/3/22, the Plaintiffs appealed to the Third DCA. Appellants filed their initial brief on 9/8/22. County and FKAA filed their answer brief on 12/21/22. On 1/13/23, the Third DCA Q granted the appellants' request for extension of time to file a reply brief to 3/6/23, with no further extensions allowed. 3. Joeandy Herrera & Jessica Herrera v. Monroe County, 21-AP-0007-P. On 9/2/21, the property owners filed a notice of appeal of the Final Order of the Special Magistrate that found them in violation for building activity without a permit. The initial brief was filed on 7/20/22. The County's answer brief was due on 10/29/22. However, on 10/24/22, the County filed an unopposed motion to stay the appeal, until the court could rule in the Stone case (below), which involves the same legal issue. Awaiting a hearing or ruling on the motion. 4. Steve Stone v. Monroe County, 21-AP-8-P (Third DCA Case No. 3D22-2177). On U 9/2/21, the property owner filed a notice of appeal of the Final Order of the Special Magistrate that found him in violation for building activity without a permit. The initial a brief was filed on 1/24/22. The County filed its answer brief on 3/25/22. On 5/31/22, the property owner filed his reply brief. On 6/8/22, the court denied the motion of Keyw Kiwi Corp., appellant in the appeal listed below, seeking leave to file an amicus brief in the Stone case. Oral argument was held on 7/25/22. On 11/18/2022, the Court issued an opinion, reversing the Final Order of the Special Magistrate. On 0 12/19/2022, the County filed an appeal in the Third District Court of Appeal. CL 5. Keyw Kiwi Corp. v. Monroe County, 22-AP-2-K. On 3/1/22, the owner filed a notice of appeal of the Final Order of the Special Magistrate that found it in violation of building activity without a permit. On 3/16/22, the Court entered an order staying the appeal pending the outcome in Stone v. Monroe County (above) because that appeal also involves a similar statute of limitations issue. 0 Administrative Law Cases U 6. Key Cow, LLC, et al. v. Monroe County and Department of Economic Opportunity, DOAH 22-3858 (new case). A petition seeking review of a Final Order of DEO approving Monroe County Ordinance No. 016-2022, which amended the Monroe County Land Development Regulations to create Section 130-140, establishing the Safe Harbor Community Center Overlay District. On 1/19/23, the challenge was dismissed by the petitioners. 4 Packet Pg. 2510 0.1.a 7. Diane Beruldsen, et al v. Monroe County, DOAH 21-1657GM. Administrative petition challenging Ordinance 05-2021, amending Comp Plan to authorize 300 early evacuation ROGOs that are to be used as exchange for existing affordable ROGOs was filed on 5/21/21. The reclaimed ROGOs would be used for administrative relief. The challenge is being held in abeyance until the related Cities' challenge is resolved by the Third District in Case No. 3D20-1921, Mattino et al. v. City of Marathon, et al. (3D20-1921/SC22-1422 and SC22-1424). On 8/3/22, the Third District issued its decision reversing the DEO order approving the comprehensive plan amendments as to Marathon and Islamorada but affirming as to the City of Key West. On 1/13/23, the Supreme Court denied petitions for review filed by the City of Marathon and Village of Islamorada. The Beruldsen DOAH proceeding was being held a in abeyance pending the final outcome of the cities challenge, with the parties CU agreeing that the Mattino decision applies equally to the County's acceptance of the additional ROGOs. The Beruldsen challenge will be dismissed with the County agreeing to rescind Ordinance 05-2021. 0 8. Lower Density for Lower Sugarloaf, LLC, et al. v. Monroe County Planning Commission, DOAH 21-494/21-CA-574-K. On 2/5/21 , a group of property owners neighboring the proposed affordable-employee housing development filed an appeal to DOAH, seeking to quash or reverse the Planning Commission's granting of a Major Conditional Use permit to applicant Lower Keys Community Center Corp., and also on 2/5/21, filed a parallel appeal of Resolution No. P36-20 to the BOCC sitting as an appellate body under Chapter 139 of the Land Development Code. On U 3/22/21, the developers intervened. The appellants on 4/6/21 filed a motion for the DOAH ALJ to stay the DOAH proceeding, which the DOAH ALJ denied on 4/26/21. a After argument on 7/13/21, the ALJ issued a final order on 7/22/21, upholding the Planning Commission's decision to approve the project's major conditional use permit. On 8/23/21, the property owners filed a petition for writ of certiorari in Circuit Court. On 9/24/21, Lower Keys Community Center filed a response to the petition, in which the Monroe County Planning Commission joined. On 1/13/23, Petitioners 0 filed a notice of voluntary dismissal following a settlement between Petitioners and Respondent Lower Keys Community Center Corporation. 9. 6-7-8 US 1, LLC v. Monroe County Planning Department. On 5/7/21, the property owner filed an appeal to the Planning Commission of the Department's 4/7/21 letter of understanding regarding the attempted use of storage/shipping containers at its Key Largo property in the SC land use district (Property Identification No. 00149430- 000000). The Department determined that the storage/shipping containers used for c0 commercial storage at the property were not subject to the property owner's conditional use approval or building permit for the parcel, are structures that require a permit and compliance with the Comprehensive Plan, LDC, Chapter 6 of the County Code, the Florida Building Code, local and FEMA flood regulations, and constitute non-residential floor area as defined in the LDC and are subject to NROGO. The owner's appeal of the Department's analysis and conclusions was heard at the Planning Commission's November meeting. The Planning Commission affirmed on a vote of 3-2. Time for an appeal will start once PC Chair signs resolution memorializing the vote. 5 Packet Pg. 2511 0.1.a Vacation Rental Cases 10.Coral Hammock Rental, et al. v. Monroe County, 20-AP-11-K. On 10/29/20, the Special Magistrate heard 47 vacation rental violation cases arising from Coral Hammock, found 45 properties in violation, and assessed fines of $224,329, plus costs. Twenty-Six of the 45 property owners found in violation appealed the final order to the Circuit Court. The appeals were consolidated for purposes of briefing common issues of law. Extensive briefs were filed and oral argument was held on 10/13/22 before Sr. Judge James M. Barton II. On 11/18/22, Judge Barton issued an opinion holding the owners are not prohibited from using their attached units in , the MU district for vacation rentals, reversing the Final Orders, and instructing that Q the owners be allowed to apply for a vacation rental permit or exemption. On 12/27/22, the court denied the County's motion for rehearing or reconsideration. On 1/25/23, the County filed a petition for certiorari review in the Third District. Class Action Lawsuits where Monroe County is a Party CL 11.Monroe County v. Purdue Pharma L.P. et al., No. 4:19-cv-10049. This case was filed by Monroe County against opioid manufacturers/marketers and distributors on 4/3/19. The complaint sought damages including punitive damages, attorneys'fees, costs, and injunctive relief. The case is part of multi-district litigation under a judge in Cleveland, Ohio. On 9/15/21, the BOCC approved a resolution that expressed approval for a settlement formula. On 12/14/22, the County received the first c0 installment of payments, in the amount of $78,103.08, from five manufacturer defendants and the distributor defendants. N N 12.Monroe County v. 3M, et al., 16t" Jud. Cir. Case No. 22-CA-618-K/2:22-cv-03680 CU - RMG, consolidated into 2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers of aqueous film-forming foam (AFFF) containing per-and polyfluoroalkyl substances (PFAS) to recover damages for investigation, remediation, removal, disposal, treatment and monitoring of water and soil created t by defendants' products. PFAS had been detected at the Monroe County Fire Training Academy on Grassy Key. On 10/7/22, defendants removed the case to the U.S. District Court for the Southern District of Florida. On 10/26/22, the County's case was transferred and consolidated with other similar cases in the Multi District Litigation (MDL) case pending in the District of South Carolina before Hon. Richard M. Gergel. 0 U c� Packet Pg. 2512 0.1.a Constitutional Officer Cases 13.League of Women Voters of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv- 00186, USDC/NDFL, 11t" Cir. Ct. App. Case No. 22-11143, Suit against the State and the Supervisors of Election for all 67 counties challenging SIB 90, elections legislation enacted in 2021. Griffin and other SOEs retained outside counsel. The County Attorney's Office is assisting in the defense. The other cases shown below raise similar challenges to SIB 90. Supervisor Griffin has also been specifically named as a defendant in those cases. All cases were consolidated and tried earlier this year. The Court entered a 288-page Final Order on 3/31/22 for all cases. The , Secretary of State and several other defendants filed an appeal of this Order on Q 4/7/22. The appeal of the four cases (case listed above, and three cases listed below) was consolidated under the case of League of Women Voters et al. v. Florida Secretary of State et al., 11t" Cir. Case no. 22-11143. On 5/6/22, the appellate court stayed Judge Walker's final Order. For now, the provisions that Judge Walker had invalidated are again in effect and remained so through the 2022 election. The Secretary of State filed its initial brief on 7/11/22. Supervisor Griffin filed this petition in response to subpoena issued in Dominion Voting Systems v. My Pillow, Inc. and Lindell, 1:21-cv-00445-CJN (D.D.C. 2021). On 9/7/22, the Supervisor of Elections (SOE) was served with a subpoena from Defendants, My Pillow and Lindell, seeking forensic images of the County's voting system; access information including MAC and IP addresses, user names 0 and passwords; documentation regarding that system; and other documents. The t County Attorney's Office served objections on 9/20/22 and filed a motion to quash in the Southern District of Florida on 9/30/22. The motion was heard on 11/2/22. On 12/21/22, the court issued an order quashing the subpoena. The Office is also currently representing the County as a defendant in 7 mortgage foreclosure cases, where the County holds an interest in the property, usually as a result of an inferior code compliance lien. Other Matters of Interest 17.Code Collections. During January 2023, County Attorney and Code Compliance staff collected $35,132.31 in code compliance fines and costs. Cumulatively through N the first four months of FY23, staff has collected $333,071.77 in fines and costs, including after-the-fact fees. A chart showing code collections is attached. 18.Vacation Rental Prosecutions. Two vacation rental cases were heard at the January code hearing before the Special Magistrate. In CE22040002, the Special t Magistrate found the property in violation and issued a one-time fine of $5000. That property is now in compliance. In CE22060026, the Special Magistrate took the case under advisement and has not yet issued a ruling. That property is now in compliance. 19.Miscellaneous.
