Resolution 049-2023 -n {r 3 4 5 MONROE COUNTY, FLORIDA 6 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 7 8 RESOLUTION NO. 049 -2023 9 10 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY 11 COMMISSIONERS APPROVING THE REQUEST TO WAIVE THE NON- 12 RESIDENTIAL INCLUSIONARY HOUSING REQUIREMENT FOR 13 REDEVELOPMENT,WITH A CHANGE-OF-USE INCREASING AFFORDABLE- 14 EMPLOYEE HOUSING DEMAND, OF A UNIT LOCATED WITHIN AN 15 EXISTING COMMERCIAL SHOPPING CENTER SITUATED AT 91200 16 OVERSEAS HIGHWAY, TAVERNIER, MILE MARKER 91, LEGALLY 17 DESCRIBED AS A PARCEL OF LAND IN SECTION 33, TOWNSHIP 62 SOUTH, 18 RANGE 38 EAST, TAVERNIER, MONROE COUNTY, FLORIDA, CURRENTLY 19 HAVING PROPERTY IDENTIFICATION NUMBER 00089910-000100. 20 21 22 WHEREAS, on November 16, 2022, the Monroe County Planning and Environmental 23 Resources Department received an application from Ty Harris, P.A., on behalf of Max D. Puyanic as 24 Trustee for Trust No. 201 (the"Developer" or"applicant"), requesting for the Monroe County Board of 25 County Commissioners to waive the Monroe County Land Development Code's inclusionary housing 26 requirement for the Developer's change-of-use of Units No. 19-21, located within an existing shopping 27 center situated at 91200 Overseas Highway, Tavernier ("subject property" or "property"), from 28 "commercial retail' to"commercial recreation"; and 29 30 WHEREAS, the property contains an existing commercial shopping center, and the Developer 31 has proposed to change the use of Units 19-21 from a "commercial retail use" to a "commercial 32 recreation use"; and 33 34 WHEREAS, Monroe County Land Development Code Section 139-1(f)(3)(c.) provides 35 "Redevelopment with a Change in Use Increasing Housing Demand. Each redevelopment project with 36 a change of use increasing housing demand, not exempted by subsection (4), shall mitigate 50% of the 37 workforce housing demand created by the proposed redevelopment by one or a combination of the 38 methods identified in subsection (5). The workforce housing required for nonresidential development 39 when a new use replaces an existing use and increasing housing demand(for example from an industrial 40 use to an office use) shall be calculated based on the square footage proposed for conversion and/or 41 based on the incremental increase in size of the new uses (if any)."; and 42 43 WHEREAS, Monroe County Land Development Code Section 139-1(f)(3)(c.) enumerates that 44 the change of use category of a 6,053 square foot unit from"commercial retail'to"tourist/recreational" 45 generates the need for 0.6 affordable housing dwelling units,which would round up to one(1)affordable 46 housing dwelling unit should the Developer comply with the Monroe County Land Development Code 47 by constructing a single affordable housing dwelling unit either on- or off-site, and that the alternative 48 equivalent fee-in-lieu of providing inclusionary affordable-employee housing is calculated to be 49 $114,916.21; and 1 of 4 I WHEREAS, LDC Sections 139-1(f)(4)(b)(l)-(5.) provide that the Monroe County Board of 2 County Commissioners "may reduce, adjust, or waive the requirements set forth in this subsection (f), 3 based on specific findings of fact, where the BOCC concludes, with respect to" the applicant, that: "Lu. 4 Strict application of the requirements would produce a result inconsistent with the Comprehensive Plan 5 or the purpose and intent of this subsection; C1.) Due to the nature of the proposed nonresidential 6 development, the development furthers Comprehensive Plan policies and the purpose and intent of this 7 subsection through means other than strict compliance with the requirements set forth herein; LD The 8 applicant demonstrates an absence of any reasonable relationship between the impact of the proposed 9 nonresidential development and requirements of this subsection (f); L1.) The strict application with the 10 requirements set forth herein would improperly deprive or deny the applicant of constitutional or 11 statutory rights; or L�j In the event of a declared State of Local Emergency, the BOCC adopts a 12 resolution recognizing that the strict application of the nonresidential inclusionary requirements would 13 not enhance nor protect the health, safety and welfare of the community."; and 14 15 WHEREAS, LDC Section 139-1(f)(4)(b.)provides that any "applicant who believes that he/she 16 may be eligible for relief from the strict application of this section may petition the BOCC for relief 17 under this subsection (f)(4).", requires that any "petitioner for relief hereunder shall provide evidentiary 18 and legal justification for any reduction, adjustment or waiver of any requirements under this section.", 19 and mandates that"petitioner shall use generally accepted principles and methods and verifiable local 20 information and data, and other appropriate materials to support the requested relief."; and 21 22 WHEREAS, on January 18, 2023, the Monroe County Board of County Commissioners held a 23 duly noticed public hearing to consider (D The Developer's request to be excepted from the Monroe 24 County Land Development Code's requirement that he provide inclusionary affordable housing in 25 Monroe County, and the Monroe County Planning and Environmental Resources Department's 26 professional staff presentation and(33,)professional staff report; and 27 28 WHEREAS, based upon the information provided and documentation submitted, the Monroe 29 County Board of County Commissioners hereby makes the following findings of fact and conclusions 30 of law: 31 32 1. Ty Harris, Esq., acting as counsel for the Applicant/Developer, at the above-referenced public 33 hearing, orally asserted the following as a putative basis for relief for the Applicant/Developer: 34 35 36 "One of the first criteria is `Strict application of the requirements would produce a result 37 inconsistent with the Comprehensive Plan or the purposes and intent of this subsection. 'So part 38 ofyour Comp. Plan and part ofyour charter[sic]says to protect the health, safety, and general 39 welfare of the citizens of Monroe County. And I would argue that the waiver request that I'm 40 going to make today falls into the general welfare of the citizens ofMonroe County." 41 42 43 2. The Monroe County Board of County Commissioners ("BOCC") specifically rejects, as a matter 44 of law, the claim that the police power constitutes a valid legal basis upon which the BOCC may 45 afford a property owner and/or an applicant non-legislative relief from the Monroe County Land 46 Development Code or Monroe County Comprehensive Plan. See, e.g., Two Marinis LLC v. 47 Islamorada, Village oflslands, Case No. 07-CA-69P (Fla. 16th Jud. Cir. Aug. 31, 2007) (Garcia, 48 J.), at 7-11. It is specifically concluded that the police power forms a basis for the BOCC, as the 2 of 4 I local legislature of unincorporated Monroe County, to legislatively enact local laws and 2 regulations,but where the Monroe County Board of County Commissioners has legislatively set 3 out specific criteria in the Land Development Code or Comprehensive Plan, the BOCC is 4 required to apply only those specific criteria that it had put the public on notice of through its 5 enactment of those ordinances. Id. at 10. 6 7 3. The Monroe County Board of County Commissioners concurs with the following assertions of 8 Monroe County Planning and Environmental Resources Department Senior Director Emily 9 Schemper made during her professional staff presentation: 10 11 "The shopping center is not [already] approved for [a] commercial recreation [use]. It was 12 approved as [a] commercial retail [use]. Which is a different use. So it is an as-of-right use, 13 meaning [the Developer doesn't] have to go through a conditional use permit process, [the 14 Developer]just go[es] through a building permit process, but[the proposed development] does 15 get reviewed for other things that are impacted by that change of use, things like parking, etc., 16 so [professional] staff looks at the shopping center parking lot and makes sure it can 17 accommodate this type of change of use. So, it's not as simple as `It's a shopping center, it has 18 the square footage, anything can go in there.' We always evaluate the changes in uses. 19 20 . . . 21 22 The other uses in that shopping center, and the previous use, are `commercial retail', and in the 23 inclusionary table, `commercial retail' has a lower need created for employee housing than 24 recreational uses.' . . . The recreational [uses] show that they create a higher need for 25 [employee] housing than [commercial] retail [uses]." 26 27 4. Following fact-intensive analysis of the particular application in this specific matter, it is found 28 that the particular application in this specific matter is so unique that the development at issue 29 may fit into one of two categories within the inclusionary table such that an absence of"any 30 reasonable relationship between the impact of the proposed non-residential development and 31 requirements of this subsection (f)" has been demonstrated. 32 33 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 34 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 35 36 Section 1. Recitals and Intent. The foregoing findings of fact and conclusions of law are true and 37 correct and are hereby incorporated as if fully set forth herein. 38 39 Section 2. Non-Reliance by Third-Parties. No person, business entity, or non-profit organization 40 may cite or rely upon this Resolution to enforce or attempt to enforce any third-party 41 theories of relief, claims, entitlements, or benefits. 42 43 44 45 46 47 3 of 4 1 Section 3. The Police Power Does Not Constitute a Lawful Basis Upon Which the Board May 2 Afford an Applicant and/or a Property Owner Non-Legislative Relief from the 3 Monroe County Land Development Code or Monroe County Comprehensive Plan. 4 The Monroe County Board of County Commissioners holds that, as a matter of law, the 5 police power constitutes a source of authority for the BOCC, as the local legislature of 6 unincorporated Monroe County, to legislatively enact local laws and regulations, but 7 where the Monroe County Board of County Commissioners has legislatively set out 8 specific criteria in the Land Development Code or Comprehensive Plan, the BOCC is 9 required to apply only those specific criteria that it had put the public on notice of through 10 its enactment of those ordinances. 11 12 Section 4.
