A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, UPDATING THE PERSONNEL POLICIES AND PROCEDURES MANUAL:
SECTION 1.05(C) REGARDING THE CODE OF ETHICS GIFT POLICY; SECTION 2.14 (E)
REGARDING PROMOTIONAL OPPORTUNITIES; SECTION 7.01 (C) REGARDING ANNUAL
LEAVE; SECTION 7.05 REGARDING BEREAVEMENT LEAVE;AND SECTION 8.01 (E)
REGARDING MILITARY LEAVE; AND SECTION 8.01 (K) REGARDING ADMINISTRATIVE
LEAVE; AND SECTION 9.11 REGARDING PROCEDURE FOR IMPOSING DISCIPLINE.
WHEREAS, Section 1.05(C) of the Monroe County Personnel Policies and Procedures
Manual ("Manual") currently states that employees shall not accept any gift, favor or
service from any member of the public, including but not limited to Christmas and/or
birthday gifts in an amount that exceeds an estimated value of$25.00, and shall never
accept any gift, favor or service with the understanding that it was provided in order to
obtain special treatment; and
WHEREAS, Section 1.05(C) is more stringent than Florida Statute § 112.3148 (4),
which states that reporting individuals and procurement employees (as those terms are
defined in the statute) are prohibited from accepting a gift having a value in excess of
$100.00; and
WHEREAS, Monroe County wishes to bring its monetary limits in line with F.S. section
112.3148; and
WHEREAS, County policy currently does not address a situation in which an
employee seeks a voluntary transfer and the acceptance of a position through
promotional opportunities that is set at a lower pay grade, responsibility, and/or pay
rate, and the County wishes to make it clear that any reduction in pay that may
occur as a result of the transfer to a position at a lower pay rate is not grievable; and
WHEREAS, Section 7.01(C)(1) of the Manual currently states that annual leave
may be accumulated up to an amount each year, and the amount varies based on an
individual's weekly scheduled work hours up to a maximum of 480 hours per year
for a 40 hour per week employee, and that any time accumulated in excess of that
amount as of April 1st, will be lost; and the Board of County Commissioners has
approved numerous waivers to this policy due to business circumstances, and an
ongoing policy change would eliminate a need for such waivers; and
WHEREAS, Section 7.05 of the Manual currently states that eligible employees shall be
granted up to four working days off with pay in order to attend a funeral of a member of the
employee's immediate family, and employees often need time off for other related matters such
as grieving, making arrangements, and attending to matters of the estate; and

WHEREAS, Monroe County wishes to amend the funeral/bereavement leave policy in Section
7.05 of the Manual to permit employees to handle related items besides attendance of the
funeral itself, and
WHEREAS,the County policy wishes to amend section 8.01(E)(1) of the Manual in order to
align with Florida Statute § 115.07(2), governing leaves of absence to officers and employees of
the County for military training; and
WHEREAS, Section 8.01(K) of the Manual currently states that the County Administrator may
approve administrative leave for other business-appropriate circumstances, and Monroe County
wishes to amend the language in order to specify and give additional direction on the approval
of such administrative leave; and
WHEREAS, County policy for imposing discipline currently states `the employee may bring
an attorney or qualified representative to assist or advise him', and the County wishes to revise
the wording to read "him or her" in order to make the wording gender-neutral; and
WHEREAS,this Resolution will approve the requested changes to the Personnel Policies and
Procedures Manual that have been voted and approved by the Personnel Policies and
Procedures Committee on December 8, 2022 and January 20, 2023.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, THAT:

1. Section 1.05 Code of Ethics (C) of the Monroe County Personnel Policies and Procedures
Manual shall be amended to read as follows:
C. Employees shall not accept any gift, favor, or service from any member of the public,
including but not limited to Christmas and/or birthday gifts in an amount that exceeds an
estimated value of $25.00 $100.00 per occurrence. Employees shall not accept any gift,
favor, or service with the understanding that it was provided to him/her in order to obtain
special treatment. Elected and appointed officials of the County are subject to the State
Statute for acceptance of gifts.
2. Section 2.14 Promotional Opportunities (E)of the Monroe County Personnel Policies and
Procedures Manual shall be added to read as follows:
E. An employee may aply for and accept a position at a lower pa grade and
responsibility. This will be considered a voluntary transfer and any reduction of pa that
is accepted by the employee shall not be eligible for grievance.
3. Section 7.01 Annual Leave (C) of the Monroe County Personnel Policies and Procedures
Manual shall be amended to read as follows:

C.1 Annual leave may be used on a payday —to—payday basis as it is earned according
to scheduling requirements and may be accumulated up to 60 working days with a
maximum of 480 hours. Any time earned in excess of this amount as of April 1 each year
will be Ie4 paid to the employee at their regular rate of pay. Individual employees are
responsible for monitoring their own leave balance. For example:

4. Section 7.05 Funeral/Bereavement Leave of the Monroe County Personnel Policies and
Procedures Manual shall be amended to read as follows:
A. All employees covered under this policy, including temporary employees, shall be
granted up to four working days off with pay i order-to al4en' ^ fungi ^' in the event of a
death in +I+e an employee's immediate family. Additional time off(over and above the
four working days herein provided) may be approved by the Department Head, and
charged to sick or annual leave. Additionally, the County may require proof of death of a
family member before making payment for leave. The immediate family shall be
construed to mean one of the following: Husband, Wife, father, mother, son, daughter,
sister, brother, uncle, aunt, first cousin, nephew, niece, domestic partner, domestic
partner's father and mother,legal guardian, grandparent or in-laws father-in-law, mother-
in-law, son-in-law, daughter-in-law,brother-in-law, sister-in-law, stepfather, stepmother,
stepson, stepdaughter, stepbrother, stepsister, half-brother, half-sister.
5. Section 8.01 Administrative Leave(E)(1)Military Leave of the Monroe County Personnel
Policies and Procedures Manual shall be amended to read as follows:
LMilitary Leave- Employees who are reserve enlisted personnel in the United
States military, naval service, or members of the National Guard will be granted leave
with full pay during days on which they are engaged in military or naval training. Leave
shall not exceed 1:7 wer4��i 240 working_ hours ours in any one annual period(beginning
October 1 and ending September 30 of the following year). Administrative leave of
absence for additional time shall be without pay and shall be granted without loss of time
or efficiency rating. The employee will not be required to use annual leave or similar leave
(comp time) in lieu of LWOP. Does not include Armory Drills or Multiple Training
Assemblies.
6. Section 8.01 Administrative Leave (K) of the Monroe County Personnel Policies and
Procedures Manual shall be amended to read as follows:

K. County Administrator may also approve administrative leave for other business-
appropriate circumstances (.e. employees 493e„sion while work lace investigation
Examples include but are not limited to: employee suspension
while a workplace investigation is being conducted if recommended by the department
head, an unforeseen extreme personal crisis, and unexpected shutdowns of County
facilities. Employees should discuss their circumstances and make requests with their
Supervisor, Department Head, or Human Resources Administrator.
7. Section 9.11 Procedure for Imposing Discipline (4) of the Monroe County Personnel
Policies and Procedures Manual shall be amended to read as follows:
4. The hearing shall be informal and shall not be in the nature of an evidentiary hearing.
The employee may bring an attorney or qualified representative to assist or advise him or
her, but discovery, cross-examination, and similar legal procedures are generally not
permissible.An employee who wants to engage in discovery,cross-examination, or other
legal procedures must make an advance written application to the hearing officer. The
hearing officer's decision is final.
