FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND BENDER &ASSOCIATES ARCHITECTS, P.A.
FOR THE EAST MARTELLO FORT HURRICANE IAN REPAIRS
In accordance with the Agreement for Professional Architectural and Engineering Services, made
and entered into on January 18,2023, ("Agreement"),between MONROE COUNTY, ("County")
and BENDER & ASSOCIATES ARCHITECTS, P.A., ("Consultant"), where professional
services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the
fee for professional services for each individual study under the contract does not exceed
$500,000.00 ("Agreement").
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order
amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically
referenced in this Task Order and the amendment, addition, or modification shall be precisely
described.
This Task Order is effective on the 13th day of March 2023.
WHEREAS, on September 27, 2022, the eye of Hurricane Ian passed 70 miles west of Key West
resulting in storm surge, flooding, and high winds impacting County-owned properties; and
WHEREAS, the Key West East Martello Fort sustained multiple damage to the property and
structures, necessitating repair.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the
parties agree as follows:
1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the
Consultant will provide design services through construction administration to facilitate
the repairs to the East Martello Fort and Grounds.
Damages sustained include:
• Electrical panel inside fort on exterior east wall damaged — door blown open and
substantial amount of salt water sprayed inside. Replace panel.
• Light fixture above front entrance door damaged.
• Custom art piece needs repairs.
• Sally port gate was under salt water—need to strip and repaint.
• Sod: Around 30% of the sod is damaged and requires replacement.
• The handicapped door control stopped working and needs to be repaired/replaced.
Though not submerged, the large exterior control is damaged and not functional.
• A wood framed entry landing inside the fort lost a guardrail on the right side. The
guardrail needs to be replaced.

• One (1) window facing the courtyard was damaged at the north casemates. Water
intrusion occurred in the museum space. Window and exterior top framing board need
to be replaced and painted.
• The sump pump in the fort's citadel stopped working and needs to be replaced. Work
will include:
o Trace/locate the existing pipe.
o Flush out the existing pipe.
o Test/check the existing pipe for leaks.
o Replace and/or repair the existing pipe, if required.
o Replace the existing pump with a new pump of consistent motor size.
• The existing drainage structures in the parking lot are silted up and require cleaning
out.
Services provided shall include:
• Field Measurement of the damages sustained.
• Construction Drawings and Technical Specifications —as required for permitting.
• Permitting Assistance—including Historic Architecture Review Commission(HARC)
and the City of Key West Building Department.
• Bidding Support Services—including attending pre-bid meeting and responding to pre-
bid Requests for Information (RFI).
• Construction Administration Services —including jobsite meetings,responding to RFI,
Payment Application review/approval, and assistance with closeout documents.
2. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay the
Consultant a lump sum total of Thirty-One Thousand,One Hundred, Sixty-Five and 00/100
dollars ($31,165.00)paid on a percent complete basis for the following phases:
a. Existing Conditions and Design Drawings - $10,908.00 upon completion of site
visit, document review and approval by the Director of Project Management.
b. Construction Documents - $10,908.00 upon document review and approval by the
Director of Project Management
c. Bidding Phase- $ 1,558.00 upon completion
d. Construction Phase Contract Administration - $7,791.00 upon completion
All other Terms and Conditions of the Agreement remain unchanged and in full forces and effect.
