The project is funded by a FDEM-HMGP grant(75%) and Local Match (25%). County portion will be paid by one cent infrastructure sales surtax. This First Amendment to the Agreement for Professional Architectural and Engineering Services dated August 17, 2022, ("Agreement") is made and entered into this 22nd day of March 2023,by and between Monroe County ("County") and Bender & Associates Architects, P.A. ("Consultant"), in order to amend the Agreement as follows: WHEREAS, the parties entered into an Agreement on August 17, 2022, for the Consultant to provide professional architectural and engineering services for the facility assessment and design of wind-retrofits at 10 County buildings ("Project"); and WHEREAS, the County desires to amend the Agreement to add additional services including Demolition and Patching for Investigative Testing and revise the Cost Estimating Services. NOW THEREFORE, in consideration of the mutual promises contained herein, the parties hereby agree as follows: 1. In accordance with Article III of the Agreement, Consultant shall provide the following additional services: a. Demolition and Patching for Investigative Testing • Perform Demolition and Patching for Investigative Testing on the 10 buildings. This testing is required to confirm that there is adequate reinforcement in the masonry walls to be able to support the window and doors under the project's required wind loads. FEMA guidelines require that the capacity of the exterior walls, particularly non-load bearing walls and particularly in buildings older than 1990, be substantiated. • The testing described above will require the removal of any materials covering the concrete or masonry units themselves. This testing can be done from the interior or exterior surface of the wall in many cases, but in either case requires the removal of any materials covering the masonry units themselves. For masonry walls which have an outer brick veneer over a concrete masonry backup (Ellis Building, Courthouse rear addition)the testing must be done from the inside with direct access to the concrete masonry. 2. In accordance with Article II, Section 2.1 of the Agreement, Attachment A, Paragraph 2.4 Cost Estimating Requirements is amended to read the following: 1 2.4 COST ESTIMATING REQUIREMENTS 1.1 Baseline Cost Estimates 1.1.1 The CONSULTANT will Provide a Cost Estimate for each of the 10 buildings when the drawings are 100% complete. The COUNTY will consider any project cost estimate recommendations and review with CMAR if this method is utilized. 1.2 Cost Estimate Updates 1.2.1 The CONSULTANT will update estimates if changes are made to the 100% complete drawings, or an error is identified by the COUNTY or CONSULTANT. The final Opinion of Probable Cost will be in a format suitable for submittal as a Phase I deliverable by the COUNTY to HMGP's technical review team. 3. Pursuant to Article VII, Section 7.1.1 of the Agreement is amended to reflect the new Total Not-To-Exceed Amount of One Million Two-Hundred Ninety-Three Thousand Nine- Hundred Fifty-Six and No Cents ($1,293,956.00). 4.
