AGENDA ITEM WORDING: Approval to Advertise a Request For Proposals (RFP) for
Food/Beverage Concession Services at Higgs Beach at the location currently known as Salute with
certain conditions due to federal grant issues and Authorization for staff to undertake steps to resolve
those grant issues.
ITEM BACKGROUND: Staff requests approval to advertise a Request for Proposals (RFP) for
Concessions Service at the current Higgs Beach location known as Salute. For reasons explained
more thoroughly below, staff recommends that the RFP contain language that would condition the
operation of a restaurant on the County's ability to successfully resolve certain grant restriction
issues, but if those efforts are not successful, that the vendor convert the restaurant to a snack bar.
Staff also seeks authorization to work with state and federal agencies to resolve the grant issues.
Monroe County currently has a Lease Agreement dating back to 2008 for Higgs Beach
Concession/Restaurant services with 1000 Atlantic Blvd, LLC, which expires on August 11, 2023.
There are no additional renewal terms available under the Lease. Under F.S. 125.35, the /county is
now required to solicit bids for leases of County property to for profit entities.
On December 19, 1983, Monroe County entered into a Land and Water Conservation Project
Agreement with Florida Department of Natural for Higgs Beach County Park. As a result, the entire
parcel is subject to this grant agreement. This grant program contains restrictions against converting
recreational space into non-recreational space. While the grant restrictions allow the County to
operate a "concession stand" that serves the patrons of Higgs Beach, a full-fledged restaurant that
draws customers beyond beach patrons is problematic. Staff has been working with the Florida
Department of Environmental Protection (the modern version of the Department of Natural
Resources) and other agencies to resolve the grant issue. That process may involve the County
going through what's known as the"conversion process" to resolve the grant issue.
Staff seeks approval in this agenda item to advertise an RFP for a concession service at Higgs Beach.
Staff also seeks Board authorization to undertake the necessary steps to resolve the underlying grant
issues.
