ITEM BACKGROUND:
Jackie Valledor on behalf of NVJ Multiservices, Inc., a for-profit corporation, has submitted an
application to the Monroe County Planning and Environmental Resources Department
("Department") requesting for the Monroe County Board of County Commissioners ("BOCC,
"Monroe County", or the "County") to voluntarily renounce, vacate, and abandon a portion of the
public right-of-way connected to Lime Drive identified below, which is located within the Pamela
Villa subdivision (approximate mile marker 102).

Location of the Requested Abandonment
The subject portion of public-right-of-way, a platted and dedicated alleyway, is located between
Lots 11 and 12 within Block 5 of the Pamela Villa subdivision (Plat Book 3, Page 125, Official
Records of Monroe County, Florida).
This applicant has requested for the Monroe County Board of County Commissioners to approve
this public right-of-way abandonment in order to enlarge its setbacks to make legally conforming
a non-conforming building it owns on Lot 12. That building currently sits on the property line
itself.
In the image below, the portion of right-of-way requested for abandonment is shown in the
applicant's property (Lot 12) is shown in 14haiie:

This right-of-way abandonment petition has been reviewed by Department staff and all utilities and
relevant parties have stated that they have no objection(s) at this time, so long as the following
conditions are met:
Florida Keys Electric Cooperative (FKEC)
• A Letter of Coordination dated November 15, 2022 states Comcast has no objection
to the right-of-way abandonment request. No utility easement or relocation is
required.
Key Largo Wastewater Treatment District(KLWTD)
• A Letter of Coordination dated July 22, 2022, states KLWTD has no objection to the
right-of-way abandonment request. No utility easement or relocation is required.
AT&T
• A Letter of Coordination dated May 31, 2022, states AT&T has no objection to the
right-of-way abandonment request. No utility easement or relocation is required.
Comcast
• A Letter of Coordination dated April 6, 2022, states Comcast has no objection to the
right-of-way abandonment request. No utility easement or relocation is required.
Florida Keys Aqueduct Authority (FKAA)
• A Letter of Coordination dated May 12, 2022, states FKAA has no objection to the
right-of-way abandonment request, and no utilities located within the area of
abandonment. No utility easement or relocation is required.
Monroe County Fire Marshal
• Letter of Coordination dated March 9, 2022.

• Although no objections were stated, it was noted that emergency access to all
adjacent properties by this alley shall not be hindered by the abandonment of this
roadway.
Monroe County Code Compliance
• Letter of Coordination dated June 24, 2022.
• The Monroe County Code Compliance Department has no objection at this time.
Monroe County Sheriff's Office
• Letter of Coordination dated June 28, 2022.
• The Monroe County Sheriffs Office has no objection to the proposed road
abandonment at this time.
Monroe County Engineering Department, dated June 9, 2022
• Letter of Coordination dated June 9, 2022.
• The Monroe County Engineering Department states that the proposed abandonment
of the north end of the alley way does not meet the requirement that public rights-of-
way be abandoned only at the terminal portion of the road, however, Monroe County
Code Section 19-1(e)(1) may apply:
(e) A right-of-way maybe abandoned only at the terminal portion of the road and in its
full width unless one of the following applies:
(1) An adiacent lot owner has on the platted right-of-way or within a setback a
substantial structure which predates the Special Session Law 59-1578 pertaining
to maps,plats and right-of-way.
If the applicant (NVJ Multiservices Inc.) can legally establish that the above-referenced
building currently sitting on the property boundary line itself does meet MCC Section 19-
1(e)(1), the Engineering Department does not have a concern or objection to this
application.
According to the Senior Director of the Monroe County Planning and Environmental
Resources Department, the area this application has requested abandonment of(outlined
in orange below) could possibly be considered the terminal portion based upon the prior
abandonment of the alley to the immediate north, across Lime Drive. BOCC Resolution
No. 263-1986 was adopted by the BOCC on August 22nd, 1986, and renounced and
disclaimed the alley in that location (outlined in red below).

Pursuant to Monroe County Code of Ordinances 19-1(d), all right-of-way abandonments shall
comply with the Monroe County Code(s) and standard engineering requirements for road, turn-
around, and fire-rescue access. If required for safety purposes, as determined by either the Monroe
County Fire Marshal and/or the Monroe County Engineer, a dedicated turn-around area shall be
shown on the submitted survey and shall be agreed to in writing and constructed with payment by
the property owner(s)requesting abandonment.
Monroe County professional staff accordingly find that this application meets the requirements
under MCC 19-1 to approve a Resolution setting a public hearing for April 19, 2023, at the
Marathon Government Center, 2798 Overseas Highway, Marathon, Monroe County, Florida.

5 Section 3. Construction and Interpretation. This resolution and its interpretation shall be
6 liberally construed and enforced in favor of Monroe County to effectuate its public purpose(s) and
7 policy(ies) of the County. The construction and interpretation of this resolution and all Monroe County �
8 Comprehensive Plan provision(s), Florida Building Code, Florida Statutes, and Monroe County Code(s)
9 provision(s)whose interpretation arises out of,relates to,or is interpreted in connection with this resolution
10 shall be liberally construed and enforced in favor of Monroe County to effectuate its public purpose(s) and
11 policy(ies) of the County, and shall be deferred in favor of the BOCC and such construction and
12 interpretation shall be entitled to great weight in adversarial administrative proceedings,at trial,bankruptcy,

15 Section 4. No Liability. Monroe County expressly reserves and in no way shall be deemed
16 to have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign, governmental, and

17 any other similar defense, immunity, exemption, or protection against any suit, cause-of-action, demand, u

20 Section 5. Severability. If any provision of this resolution, or any part or portion thereof, is
21 held to be invalid or unenforceable by any administrative hearing officer or court of competent jurisdiction,
22 the invalidity or unenforceability of such provision, or any part or portion thereof, shall neither limit nor
23 impair the operation, enforceability, or validity of any other provision of this resolution, or any remaining
24 part(s) or portion(s) thereof. All other provisions of this resolution, and remaining part(s) or portion(s)
22556 thereof, shall continue unimpaired in full force and effect.
