ITEM BACKGROUND: This is a proposed settlement in the personal injury case filed by Tommy Alfonso on behalf of Minor T.A. versus Monroe County, 161h Judicial Circuit Case No. 22-CA-108- KW. The parties have reached a settlement in the case by which the County will pay $75,000 to the plaintiff with a complete release of all claims and no admission of liability, conditional upon approval by the Board of County Commissioners. The County Attorney's Office believes that this is a fair and equitable resolution for both sides and recommends approval. The Settlement Agreement will be attached as soon as it is available. E 0 SETTLEMENT AGREEMENT 2 The Parties, TOMMY ALFONSO, as father and Natural guardian of T.A., a minor ("Plaintiff'), and MONROE COUNTY ("County" or "Defendant"), (collectively the "Parties"), E by and through their respective counsels,have reached a settlement agreement subject to approval by the County's Board of County Commissioners ("Board"). The terms of the agreement have been carefully read and are binding and enforceable,and are set forth as follows: 4- 0 I. This Settlement Agreement shall be presented to the Board during the Board's 0 March 22, 2023, meeting. This Settlement Agreement is entered on behalf of both parents individually and as parents and natural guardians of the minor,T.A.,and is contingent upon Board approval and court approval of the settlement. E .2 3. A general release shall be executed in the event the court approves the settlement. The general release shall include indemnification of all claims against the County.
