All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds, or modifies a provision or an Article of the Agreement, in which case,the provision or Article will be specifically referenced in this Task Order and the amendment, addition, or modification will be precisely described. These additions apply only to the project referenced in this Task Order. This Task Order is effective on the 22nd day of March 2023. WHEREAS, the Tavernier Fire Station 422 requires repairs and general hardening for protection during storms, and WHEREAS, the hardening of Tavernier Fire Station 422 has been facilitated by the Community Development Block Grant (CDBG) Mitigation Program, Critical Facilities Hardening Program; and WHEREAS, the Tavernier Fire Station 422 hardening is funded through the Federally Funded Community Development Block Grant Mitigation Program (CDBG-MIT) Grant Agreement Number I0157. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will provide Environmental Compliance Assessment, Pre-Design, Design Documents and Permitting, and Bid Services and Construction Observation. Services provided shall include: a. Items described in ATTACHMENT A 1 2. In accordance with Article VII, Paragraph 7.1.1 of the Agreement, the County shall pay the Consultant a lump sum total of One Hundred,Thirty-Eight Thousand,Six Hundred, Seventy-Five and 00/100 dollars ($138,675.00) paid on a percent complete basis for the following phases: a. This Agreement is composed of details of the services to be performed. Monroe County shall herein be referred to as the"Client," and CPH, LLC. as the"Consultant." PROJECT DESCRIPTION CPH, LLC. hereby proposes to conduct Professional Consulting services for the above-referenced project. Client proposes to implement repairs and general hardening of the Tavernier Fire Station 422, located at 151 Marine Ave, Tavernier, FL 33070. The hardening of the building will be per the Community Development Block Grant (CDBG) Mitigation Program, Critical Facilities Hardening Program, as outlined in the report for this fire station dated June 15th 2020. SCOPE OF SERVICES The following represents a summary of scope of work services for the Client. Consultant shall provide the professional services described below. Scope of Services consists of four(4) Tasks: TASK A—ENVIRONMENTAL COMPLIANCE TASK B—PRE-DESIGN TASK C—DESIGN DOCUMENTS AND PERMITTING TASK D—BID SERVICES AND CONSTRUCTION OBSERVATION 1 Tavernier Fire Station Hardening BASIC SERVICES TASK A—ENVIRONMENTAL COMPLIANCE CPH shall prepare a report to address The DEO Environmental Assessments, Environmental Review Checklist requirements. The report shall confirm to the DEO and HUD's required format and address the following items. CPH assumes the project alternative for the Fire Station is "no action" for purposes of the report preparation. • CPH shall conduct one (1) field investigation of the subject site, take photographs and coordinate with an on-site representative to obtain information of the site as it pertains to recording documentation required by HUD. • Provide an overview of the event/action that created the need for the project and then a description of the purpose and need for the project to include but not be limited to, general area description where the project is being proposed, proposed funding amounts, provide verification of the Categorical Exclusion. • Communicate with and provide documentation of the contacts and correspondances with federal, state and local agencies. Timeframes of each contact initiated and response time shall be documented. • The report shall be provided in the required DEO format. • For cultural resources State Historic Preservation Office (SHPO) should be consulted and a brief description of the requirements of Section 106 of the National Historic Preservation Act and implementing regulations contained in 36 CFR 800. Describe the project Impacts should address short(during construction)and long term impacts, if any. The contact letter shall provide graphics and information from the Florida Master Site File. Provide a letter received from SHPO regarding the project in the report. The Tribal Directory Assessment Tool (TDAT)will be used to prepare correspondence to the Tribe of jurisdiction including graphics and any materials sent or received from SHPO. • Prepare a brief description of the existing land use and planning (zoning, flood plain encroachment, etc.) as well the communities participation in the National Flood Insurance Program (NFIP) in the area and project site and complete the HUD Floodplain Worksheet. For floodplain issues provide a brief description of EO 11988 and floodplains and any agency consultation, FEMA maps and NFIP community descriptions, as applicable. • Describe any water quality resources issues relative to the project site and complete the HUD Wetland Work Sheet. If applicable, description of the Clean Water Act requirements and state standards and any agency consultation. Describe any measures that can be implemented to mitigate the anticipated impacts. This can include wetlands (EO 11990 and requirements),protected species(plant, animal and aquatic,vegetation wildlife and aquatic resources, areas with special designation, and cultural resources (historical and archaeological). • Describe the sites compliance with the Coast Zone Management Act (CZMA) and complete the HUD Coastal Zone Worksheet. This can includes documentation requirements in Sections 307 (c) and (d) of the CZMA. 2 Tavernier Fire Station Hardening • Describe the sites compliance with the Sole Source Aquifer (SSA) requirements and complete the SSA Worksheet. This can includes documentation requirements in The Safe Drinking Waters Act of 1974, Section 1424 (e) and 40 CFR Part 149. • Regulatory oversight for protected fauna and flora is the responsibility of the U.S. Fish and Wildlife Service (USFWS), Florida Fish and Wildlife Conservation Commission (FFWCC)and the Florida Department of Agriculture and Consumer Services (DACS). The USFWS is the federal agency responsible for protecting the nation's fish and wildlife resources through implementation of the Endangered Species Act of 1973, as amended. ("ESA," 16 U.S.C. 1513-1543). The FFWCC regulate the taking of species listed as endangered or threatened and their nests through Rules listed in 68A-27 Florida Administrative Code. A records review of documented wildlife observations maintained by the FFWCC will be conducted. Other resources used as aids include the following: Official Lists of Endangered and Potentially Endangered Fauna and Flora in Florida (USFWS), the Eagle Nest Locator and the Florida Natural Areas Inventory database identifying rare species and natural communities within the project area. The HUD Endangered Species Worksheet shall be completed. • Describe the project's location relative to Wild and Scenic Rivers and complete the HUD WSR worksheet per the Wild and Scenic Rivers Act of 1968,particularly Section 7 (b)and (c). • Describe air quality standards in the project area,brief description as to whether the project vicinity and surrounding area is in compliance with those standards and complete the HUD Clean Air/Air Quality Worksheet. This may include EPA Air Quality classification of the site with the National Ambient Air Quality Standards (NAAQS). • Regulatory compliance with the HUD Farmlands Protection does not appear to apply to the project site. CPH shall complete the Farmland Protection Worksheet. • Improvements at the site do not appear to impact regulatory compliance with the HUD Environmental Justice per Executive Order 12898. CPH shall complete the Environmental Justice Worksheet. • Improvements at the site do not appear to impact regulatory compliance that require noise abatement pursuant to Noise Control Act of 1972 as amended by the Quiet Communities Act of 1978, 24 CFR Part 51 Subpart B. CPH shall complete the Noise Abatement and Control Worksheet. • Regulatory compliance with the HUD Explosive and Flammable Hazards (aboveground tanks 24 CFR Part 51 subpart C) does not appear to apply to the project site. CPH shall complete the regulatory compliance review by completing the HUD Explosive and Flammable Hazards Worksheet. • Regulatory compliance with the HUD Hazardous, Toxic or Radioactive Materials & Substances (24 CFR 50.3(i)& 58.5 (i)(2))does not appear to apply to the project site. CPH shall complete the regulatory compliance review by completing the HUD Hazardous and Toxic Worksheet. • Regulatory compliance with the HUD Airport Hazards (Clear zones and Accidental Potential Zones; 24 CFR Part 51 subpart D) does not appear to apply to the project site. CPH shall complete the regulatory compliance review by completing the HUD Airport Hazards Worksheet. 3 Tavernier Fire Station Hardening • Describe the sites compliance with the Coastal Barrier Resources Act (CBRA) and complete the HUD Coastal Barrier Resource System Worksheet. This can include documentation requirements in the Coastal Barrier Resources Act, as amended by the Coastal Barrier Improvement Act of 1990 (16 USC 3501). • Describe the sites compliance with Flood Insurance and complete the HUD Flood Insurance Worksheet. This can include documentation requirements in Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 (42 USC 4001- 4128 and 42 USC 5154a). • Provide a paragraph giving information on the grant or public assistance application to address the stated purpose and need, including: Who will be submitting grant application, under which program under which funding is being sought and NEPA requirements. Provide a concise description of all of the alternatives that were fully considered in addressing the purpose and need stated for the project. This assessment will also include those alternatives that were considered but dismissed and the reasons for dismissal. CPH assumes the project alternative is "no action." Provide information on the general setting of the project area(effected environments and potential impacts and alternative considered. 1. A concise description of each affected environment at the project site and possible laws that may apply to that affected environment. 2. The impact(direct and indirect(secondary))of each alternative on that environment (this can include positive impacts, if applicable). 3. Potential mitigative measures 4. Describe land development characteristics, socioeconomic issues, community facilities and services and natural features of affected populations in the project area and how the alternatives will impact the population and any measures that can be implemented to mitigate the anticipated impacts as appropriate. • CPH assumes the County shall provide an updated Title for the project area which must include Early Floodplain notice per 24 CFR 55.20. • CPH assumes the County shall conduct tasks related to publishing or noticing the project to comply with the release of funds • CPH's report shall include documentation for the compliance factors, whether the compliance factor has been met and if mitigation is required. TASK B—PRE-DESIGN B.1 —Topographic and Boundary Survey Perform a Boundary and Topographic Survey of Parcel Identification Number 00479100-000000 (Monroe County Property Appraiser) as per Rule Chapter 5J-17 of the Florida Administrative Code in compliance with the Standards of Practice of Surveying and Mapping of the State of Florida(containing 0.43± acre). ■ 25' topographic grid of site and 5' off-site on adjoining boundary lines where accessible. 4 Tavernier Fire Station Hardening ■ Location of existing visible above ground improvements &visible utilities within scope. ■ Signed and sealed survey. B.2 —FEMA Elevation Certificate Prepare a FEMA Elevation Certificate of Parcel Identification Number 00479100-000000 (Monroe County Property Appraiser). B.3 — Site Visit and Due Diligence CPH shall perform up to two site visits to confirms architectural, electrical, and civil elements prior to proceeding with Task C. BA—Geotechnical Allowance CPH will review design criteria package with the County to determine if above ground or below ground fuel tank will be best for the project. CPH will coordinate with local sub-consultant to perform up to two standard penetration test bores up to twenty feet each for use in design of fuel tank and generator pad. Cost is an allowance not-to-exceed (NTE). CPH shall provide quote for geotechnical services prior to proceeding with this task. TASK C—DESIGN DOCUMENTS AND PERMITTING Design Documents will be prepared in accordance with Monroe County building department standards on 24" x 36" full sized plan sheets, both electronic and hard copy versions. Design includes: • New Elevated Generator and ATS • Fuel Tank • 1 RTU HVAC • Mounting Existing HVAC Units (3) • FPL Coordination for Underground Power Supply • Replace Existing Doors and Windows with Impact Resistant doors and windows • Replacement of Apparatus Bay Overhead Doors with folding doors • Flood Panels to BFE+2 feet and Fill CMU Blocks • Replace Existing interior light Fixtures with LED light fixtures • Thermal Insulation Foam in Apparatus Bay CPH shall prepare the design documents for the above components per the awarded grant and submit 60% set to Monroe County and DEO for review and approval. 5 Tavernier Fire Station Hardening Consultant shall provide signed and sealed documents for permit submittals which may include plans, specifications and / or calculations. Permitting shall include responding to up to two (2) rounds of responses to comments from each agency and up to two (2) meetings. Consultant assumes the below agencies will require permits or submittals for review: • Monroe County Building Department • DEO • FEMA (If Applicable) • FPL or FKEC Consultant shall provide revised Drawings and specifications for modification, clarification or additional documents to comply with requirements for obtaining permits. Meetings required beyond these will be handled as additional service, and billed in accordance with our Standard Hourly Rates. Should there be a potential for denial on an application,the Client will be informed so they may make the appropriate arrangements to retain legal staff to address the denial should it occur. The Client will be financially responsible for any application or filing fee required by the agencies. Any modifications to the plans requested by the Regulatory Agencies pertaining to the design in the previously mentioned plans, required to meet code, will be addressed by CPH as part of these services. Any modifications requested that are not code issues, or modifications requested by the Client will be addressed as additional services and billed at the Standard Hourly Rates enclosed. Any other permits that may arise during the design or review process, and not outlined above,will be handled as an additional service, and billed in accordance with our Standard Hourly Rates. Delivery of final drawings will be in the form of PDF,Hardcopy,or Revvit files. CPH shall provide the necessary sets of sealed construction documents as required for plan reviews and permits by the Building Department. Upon completion of permitting efforts consultant will prepare final plans and bid package including plans, specifications,permits, opinion of construction costs, and bid schedule, for Client use in bidding the project. TASK D—BIDDING SERVICES AND CONSTRUCTION OBSERVATION Consultant will attend one pre-bid meeting and one on-site pre-bid meeting at the Client's request to answer any immediate questions from potential bidders. Consultant will respond to all Requests for Information (RFI) from bidders and issue up to one bid addendum at the request of the Client. Consultant shall review shop drawings, respond to RFIs, issue field change exhibits, and produce plan addendums to address major RFIs. Consultant will coordinate with Contractor on progress of project and perform site visits as needed to verify field conditions. 6 Tavernier Fire Station Hardening Consultant shall review, evaluate, and issue responses to all change order requests. Consultant shall perform substantial walk, generate punch list, and perform final walk of site to certify completion of construction. Consultant will review as-builts, prepare close-out documents, and coordinate with permitting agencies to finalize construction activities. Consultant will limit number of site visits during construction up to a total of six, as needed. Additional site visits during construction will require an extra work authorization. Items Not Included In Scope of Services • Traffic Engineering, Studies or Reports • Weekly Progress Meetings • 3 Dimensional Perspectives or Video Graphics • Expert witness for litigation • Construction staking • Phase I or 2 Environmental Site Assessment • Arborist Reports • Utility/Storm Modifications • Fire Sprinkler System design/modification • Easements, Platting, ROW Modifications • Services resulting from changes made by the County following the completion of specific project tasks that require re-work by CPH • Any other issues not specifically described in this proposal Should work be required in any of these areas, or areas not previously described, CPH will prepare a proposal or amendment, at the Client's request, that contains the Scope of Services, fee, and schedule required to complete the additional work item. The Consultant shall be reimbursed for reproduction of reports, contract documents and miscellaneous items (at actual cost with no markup),travel, and subsistence. Costs shall be limited to a $4,000 not-to-exceed amount. Unused amounts in this allowance shall be credited back to the CLIENT at the completion of the Project. CPH will comply with CLIENT Travel Expense Policy and Guidance. 7 Tavernier Fire Station Hardening COMPENSATION: The below table contains the fee breakdown of each task by CPH. Compensation will be based on Lump Sum fee of $134.675.00, with $4,000.00 in reimbursable expenses, not-to-exceed.
