Monroe County conveys said right-of-way as described above with the following 10 conditions: 11 12 1) Recorded utility easements with KLWTD and FKAA are required to 13 be submitted to the County within 30 days of approval or the right-of- 14 way shall immediately revert back to the County. 15 2) Per the Monroe County Fire Marshal's Office, the following conditions 16 shall apply to the right-of-way: 17 a. An access easement shall be provided for the Monroe County 18 Fire Marshal's Office. 19 b. The right-of-way shall be maintained to the current road width 20 and length for emergency vehicle turnaround. 21 c. The right-of-way shall not be fenced, gated or blocked in any 22 way. 23 d. The right-of-way shall be designated with signage as 'No 24 Parking/Fire Lane'. 25 e. The right-of-way shall never be built upon. 26 27 Section 3. Construction and Interpretation. This Resolution and its interpretation 28 shall be liberally construed and enforced in favor of Monroe County to effectuate its 29 purpose(s) and policy(ies) of the County. The construction and interpretation of this 30 resolution and all Monroe County Comprehensive Plan provision(s), Monroe County 31 Land Development Code and Monroe County Code of Ordinances provision(s) ("Monroe 32 County Code(s) provisions(s)"). Florida Building Code, Florida Statute(s), and Monroe 33 County resolution provision(s) whose interpretation arises out of, relates, or is interpreted 2 of 3 I in connection with this resolution shall be liberally construed and enforced in favor of 2 Monroe County to effectuate its public purpose(s) and policy(ies) of the County, and 3 shall be construed in favor of the BOCC and such construction and interpretation shall be 4 entitled to great weight in adversarial administrative proceedings, at trial, in bankruptcy, 5 and on appeal. 6 7 Section 4. No Liability. Monroe County expressly reserves and in no way shall be 8 deemed to have waived, for itself or for its officer(s), employee(s), or agent(s), any 9 sovereign, governmental, and other similar defense, immunity, exemption, or protection 10 against any suit, cause -of -action, demand, or liability. 11 12 Section 5. Severability. If any portion of this Resolution , or any part or portion 13 thereof, is held to be invalid or unenforceable by any administrative hearing officer or 14 court of competent jurisdiction, the invalidity or unenforceability of such provision, or 15 any part or portion thereof, shall neither limit nor impair the operation, enforceability, or 16 validity of any other provision of this Resolution, or any remaining pert(s) or portion(s) 17 thereof.
