Your e-mail communication with this office may be subject to public disclosure. 4 Changes to the Monroe County Land Development Code Floodplain Management Ordinance (Ch . 122) March 22 , 2023 PURPOSE: Monroe County has adopted amendments to update various Floodplain Management related provisions, to continue to fulfill the requirements of the National Flood Insurance Program (NFIP), and maintain good standing in the NFIP program,to be consistent with the Florida Division of Emergency Management's State Model Ordinance which is written to explicitly rely on the flood provisions in the Florida Building Code, and to continue to meet the Community Rating System (CRS) requirements and maintain our CRS score and insurance discounts. ❖ NFIP is a federally-subsidized flood damage insurance program administered by the FEMA. The NFIP makes federally-backed flood insurance available in those communities that agree to adopt and enforce floodplain management ordinances to reduce future flood damage. These regulations must meet or exceed the minimum administrative and technical requirements in the NFIP regulations(44 CFR Part 59 and Part 60). ❖ Residents and business owners are eligible to purchase NFIP flood insurance policies in communities that agree to regulate development in special flood hazard areas. These special flood hazard areas are delineated by FEMA on Flood Insurance Rate Maps. ❖ Communities must incorporate NFIP requirements into their zoning codes, subdivision ordinances, and/or building codes or adopt special purpose floodplain management ordinances. ➢ In 2012, State Floodplain Management Office developed a Model Floodplain Management Ordinance for communities, written explicitly to rely on the flood provisions in the Florida Building Code. FEMA approved the Model Floodplain Management Ordinance in 2013. ➢ Since the 2010 edition, the flood provisions of the Florida Building Code (FBC) meet or exceed the minimum NFIP requirements for buildings and structures. Nearly all Florida communities administer local floodplain management ordinances that are written to rely on the FBC to meet the NFIP requirements. ✓ The Community Rating System (CRS) is a voluntary incentive program that recognizes and encourages communities to establish sound programsthat recognize and encourage flood plain management activitiesthat exceed the minimum NFIP requirements. ✓ Monroe County has achieved a Class 3 rating in the CRS that provides a 35% discount on flood insurance premium and in April 2022, will increase annual savings to flood insurance for 14,400 policyholders in unincorporated Monroe County to $7.5 million dollars annually. This is an annual average savings per policyholder of$522.Cumulatively to date, Monroe County has saved policyholders approximately$24 million. Adoption Process For Chapter 122 Amendments ❖ Three Community Meetings— December 2,2021; January 20, 2022; and February 3, 2022 •'• Development Review Committee — February 22, 2022 ❖ Planning Commission—March 23, 2022 ❖ BOCCAdoption— November 15, 2022 ❖ Effective Following DEO Review and Approval— March 7, 2023 Floodplain Management - Market Value: Amendment processing that will remove the 20% addendum offered by the County to MCPA Market Improvement Value for structures subject to Substantial Improvement or Substantial Damage Review. FIRM Date has been changed. 6/15/73 is now codified as our new FIRM date, meaning that a structure must be built prior to that date in order to be considered Pre-FIRM. Replaces old Pre-FIRM date of 1/1/75. Accessory Structure Definition: Updated definition that removes guest houses, mother-in-law suites, or other habitable area from accessory structure consideration in Floodplain Management. Mangrove Stand: Definition added, clearly and concisely defined. Important because of changes that adds flood review to erosion control and coastal structures in VE Flood Zones. Section 122-13: Site Plans and Construction Documents: Mirrors FBC 107.2.6 requiring the submittal of complete construction documents including all required Flood Zone Information (Zone, BFE, DFE) and all Flood Zones and BFE Boundaries clearly identified on plans. Section 122-13(a)(5) and (6): New requirements for permitting fill in ALL Flood Zones including AE. Requires location and delineation of fill, the amount used, and proposed final grades, as well as the source of the fill, compaction specifications, and a document demonstrating by competent substantial evidence that the proposed fill areas are the minimum necessary to achieve the intended purpose. Section 122-13(c): Additional certification requirements added showing no increase in the potential of Flood Damage for altering or removing mangrove stands in Zone V and Coastal A Flood zones. Section 122-15: Required Inspections of Enclosed Area Below Elevated Residential Structures. Continues a program that was required by the County's remedial plan with FEMA. Section 122-16(f): Requires Nonconversion Agreements for ALL new enclosures below DFE to be recorded prior to C.O. Floodplain Management - Variances: An amended and more detailed variance procedure is in place. This includes language that differentiates between AE and VE Flood Zones. Section 122-21: Flood Hazard Warning. A Flood Hazard Warning as shown in this section is REQUIRED on all agreements for Deeds, Purchase Agreements, Leases, or other contracts for sale/exchange/transfer of property. Section 122-25(b)(1)b: Enclosures Below Elevated Buildings. Opaque breakaway construction is no longer permitted in VE Flood Zones. All enclosures are to be constructed of lattice or screening ONLY. Section 122-25(b)(2): This section replaces former LDC Section 122-4(a)(9) providing that legally permitted nonconforming enclosures below DFE permitted before April 12, 2004 are permitted to remain but cannot be improved unless for life safety or to bring the enclosure into compliance with all current regulations. Section 122-25(c): Foundation Requirements: Updates required foundation construction for structures in Monroe County within the scope of the FBC. Section 122-25(d): Limits the size of enclosures in AE Flood Zones to 600 square feet and in VE Flood Zones to 100 square feet. Allows for variances to permit larger enclosures in AE Flood Zones (600-1000 square feet). Requires ALL accessory structures to provide a recorded Nonconversion Agreement. Section 122-27(d) and (ej: Permits fill in Flood Zones, but only under very specific situations. Section 122-31(b): Requires structures sited on a property that has a VE Flood Zone or Coastal A Flood Zone to construct all concrete slabs, parking pads, or enclosure floors to comply with VE Zone Standards.
