This is NOT a Lien but a statutory requirement and needs to be done as a matter of
law. The sending of this notice should not reflect on the creditworthiness of
CONSOLIDATED ELECTRICAL DISTRIBUTORS, INC. DBA RAYBRO
ELECTRIC SUPPLIES's customer or any other party to the project nor does it
indicate any expected problem in the payment of CONSOLIDATED ELECTRICAL
DISTRIBUTORS, INC. DBA RAYBRO ELECTRIC SUPPLIES's invoices. It merely
informs you that the company identified in the Notice to Owner is supplying
materials, labor or services to the project. It also gives you a general description
of what is being supplied (whether the type of materials and/or type of
work/labor/service).
Before paying your contractor, you must make sure that the person giving this
notice has been paid. You do this by getting a lien waiver from the person
identified in the Notice to Owner.
If you have a construction lender and the lender is paying the contractor, directly,
the lender is responsible for getting the necessary lien waivers. You may wish to
check with your lender to verify that they will be managing these documents in
connection with each payment to the contractor.
This is a very general description of any obligation under Florida Construction
Lien Law. If you have any doubt regarding your rights and/or duties under this
law, you should consult an attorney.
