Cases for Closed Sessions
1. Mark Thompson v. Monroe County and City of Key West, 22-CA-113-K. On
2/24/22, Plaintiff, a former pumpout boat employee sued the County under the
Jones Act for injuries arising during his employment. On 6/1/22, the City of Key
West was added as a party. The County has requested defense and
indemnification from the City pursuant to the terms of an interlocal agreement.
The Court assigned a projected trial date of 12/6/23. Mr. Thompson passed U
away on 1/14/23 due to an unrelated illness. Mediation on 4/28/23 did notzi
result in settlement. The parties have agreed to resume mediation TBD.

2. Galleon Bay Corp. v. Monroe County and State of Florida — 02-CA-595-K. This
takings case resulted in a final judgment in the amount of $480,511. A
Satisfaction of Judgment was issued. The parties are engaged in discovery on
the only remaining issue of attorneys' fees and costs. The County's motion to
compel as to interrogatories was granted on 2/21/23. Vivienne Schleu was
deposed on 2/24/23. A closed session is scheduled for 5/17/23.

New Cases
3. Largo 89, LLC & AJC Berna Properties, LLC v. Florida Dep't of Environmental
Protection & Monroe County, 16th Jud. Cir. Case No. 23-CA-216-P. Plaintiffs are two
business owners of two lots adjacent to terminus of Kay Drive in Key Largo. Plaintiffs
submitted a road abandonment petition to the BOCC in March 2022, citing the desire
to prohibit foot traffic from live aboard boaters anchored offshore. On 3/16/22, the
BOCC denied the petition because it would have violated Section 19-1 of the Code
by cutting off water access. Plaintiffs now sue for declaratory relief including for an
order compelling FDEP to issue a Certificate of Recordable Deed, and on a count of
nuisance. The County is evaluating its response.
Other Cases of Interest at Trial Court Level N

4. Barter v. Monroe County, 16th Cir. 21-CA-418-K. Personal injury case. Plaintiff
alleges he was injured when he laid his scooter down in the street in front of an
oncoming Monroe County Transit bus. Depositions of County employees Sheryl
Graham and Lourdes Francis were taken on 2/23/23. Discovery is continuing.
5. Peter & Olivia Poto v. Monroe County, 22-CA-709-K, quiet title and specific
performance action by buyers of a property where seller had sold development rights
to one lot and entered into a unity of title as part of the County's Less than Fee
program. The County's Motion to Dismiss was heard on 5/2/23; a decision is
pending. U

6. Sunset Garden Estate Land Trust v. Monroe County, 19-CA-460-P. Property owner Q
sued claiming that various state laws including the Right to Farm Act, preempt the
County's land development regulations from applying to its parcel and seeking 2
judicial declarations that its alleged agricultural activities are immune from the 0
County's land development regulations. On 12/1/22, the court granted the County's
motion for leave to file a counterclaim for declaratory and injunctive relief against the
Land Trust. On 1/23/23, the County responded to the plaintiffs' motion for summary
judgment and also filed its own motion for summary judgment on its counterclaim.
The Court heard the plaintiffs' motion for summary judgment on 2/1/23 and the
County's motion for summary judgment on its counterclaim on 3/8/23. The Court
took the matter under advisement and will rule on both at the same time. c0
7. Burke Construction Group, Inc. v. Monroe County, CA-M 19-80 (state court case).
On 7/11/19, Burke Construction Group sued to challenge the County's bid protest
procedure and decisions to award contracts for the Marathon Library and Cudjoe
Fire Station projects to other contractors. The County is engaged in discovery. Jury
trial set for 6/5/2023. The Plaintiff has served a settlement offer, which will be
presented to the BOCC at the 5/17/2023 meeting.

8. Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K. Declaratory Judgment
suit filed by Roy's against County as part of its eviction suit against its tenant. On
10/4/18, the County countersued the trailer park and the park residents, seeking an
injunction prohibiting occupancy at the park until serious fire and life safety issues
have been addressed, and for appointment of a receiver, and a declaratory relief
cause of action to determine whether the owner or tenants are responsible for the
code violations. The park owner has submitted an application to the Planning
Department to redevelop the park for affordable housing. The Planning Commission
hearing was held on 12/14/2022. The public hearing on the owner's application
scheduled for the 1/18/23 BOCC meeting was continued until May 2023.
9. Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc., 17-CA-631-K. The
County sued both SVFD and Wi-Fi to invalidate a lease between SVFD and Wi-Fi N
on the grounds that SVFD had not approved the lease in an open meeting. The
County prevailed and the lease was invalidated. Wi-Fi has a separate suit pending 2
against the SVFD that is holding up the transfer of the property to the County. t
Mediation between Wi-Fi, the SVFD, and the County is ongoing to resolve the
separate claim and the County's judgment for attorneys' fees and costs for
$217,159.86. At Wi-Fi's request, Fortress Secured, LLC submitted a public private
partnership (P3) proposal that would serve as the basis for settlement. On 1/18/23,
the BOCC approved an interim agreement with Fortress Secured, LLC to design,
build and finance a replacement fire station on Sugarloaf Key at the current location
of the Sugarloaf Volunteer Fire Department Station #10. A final agreement would 0
resolve all related claims and result in a transfer of the property to the County. U

10.Burkhardt v. Monroe County, No. 22-cv-10041 (S.D. Fla.); 16th Cir. 22-CA-293-K. On N
4/28/22, Plaintiff filed a Complaint in state court seeking to declare whether Plaintiff
has a right to engage in commercial fishing uses on his Big Pine Key property. The
complaint also sought to invalidate the Habitat Conservation Plan and Incidental
Take Permit issued by LISFWS. On 5/25/22, the County removed the action to
federal court because the litigation presents a federal question. Plaintiff filed an
amended complaint on 12/19/22 that did not raise a federal question. The federal
court relinquished jurisdiction back to the state court on 1/9/23. On 1/17/23, the
County filed its answer to the amended complaint.

Appellate Cases of Interest
11.Ray Rey & Ramille Rey v. Monroe County, 22-AP-2-P. On 3/1/22, the owners filed
a notice of appeal of the Final Order of the Special Magistrate that found them in
violation due to improvements to a nonconforming lower enclosure. Briefing is
complete. Awaiting a ruling or the scheduling of oral argument.
12.Maschal et al. v. Monroe County and FKAA(now known as Crawford et al. v. Monroe
County and FKAA), CA K 19-186/3d DCA 22-754—Suit against Monroe County and
FKAA by 12 individuals seeking similar relief to the Delaney lawsuit, which the
County won. After several attempts to state a claim, the Circuit court dismissed the
case on 4/4/22 when it denied the Plaintiff's motion for reconsideration and granted
the County and FKAA's motion for reconsideration, thus denying the Plaintiff's N
motion to file a supplementary complaint. On 5/3/22, the Plaintiffs appealed to the
Third DCA. Briefing is complete. The Third DCA will hold oral argument on CU
5/12/22 at the Plantation Key Courthouse.

13.Joeandy Herrera & Jessica Herrera v. Monroe County, 21-AP-0007-P. On 9/2/21,
the property owners filed a notice of appeal of the Final Order of the Special
Magistrate that found them in violation for building activity without a permit. The initial
brief was filed on 7/20/22. The County's answer brief was due on 10/29/22.
However, on 10/24/22, the County filed an unopposed motion to stay the appeal,
until the court could rule in the Stone case (below), which involves the same legal
issue. Awaiting a hearing or ruling on the motion. U

14.Steve Stone v. Monroe County, 21-AP-8-P (Third DCA Case No. 3D22-2177). On a
9/2/21, the property owner filed a notice of appeal of the Final Order of the Special
CU
Magistrate that found him in violation for building activity without a permit. On
11/18/2022, the Circuit Court sitting in its appellate capacity issued an opinion,
reversing the Final Order of the Special Magistrate. On 12/19/22, the County filed
an appeal in the Third District Court of Appeal. The County voluntarily dismissed the
appeal on 3/24/23.

15.Keyw Kiwi Corp. v. Monroe County, 22-AP-2-K. On 3/1/22, the owner filed a notice
of appeal of the Final Order of the Special Magistrate that found it in violation of
building activity without a permit. On 3/16/22, the Court entered an order staying c0
the appeal pending the outcome in Stone v. Monroe County (above) because that
appeal also involves a similar statute of limitations issue.

Administrative Law Cases
16.Diane Beruldsen, et al v. Monroe County, DOAH 22-3241 GM. Administrative petition
challenging Ordinance 05-2021, amending Comp Plan to authorize 300 early
evacuation ROGOs that are to be used as exchange for existing affordable ROGOs
was filed on 5/21/21. The reclaimed ROGOs would be used for administrative relief.
The challenge was held in abeyance until a similar challenge to Marathon,
Islamorada, and Key West's ordinance was resolved. When that challenge struck
down Marathon and Islamorada's ordinances, those cities sought a legislative fix.
On 2/29/23, the ALJ entered an order continuing to keep the matter in abeyance until
after the Florida Legislature's 2023 Regular Session. On 3/30/23, Governor
DeSantis signed SB 102 (ch. 2023-17, LOF) into law. Section 42, approves the units
approved by DEO in 2018 as an exception to the 24 hour evacuation rule. On CN
4/27/23, Petitioners filed a notice of dismissal based on the legislation. On
4/28/23, the case was closed and jurisdiction was relinquished back to DEO. CU
17.6-7-8 US 1, LLC v. Monroe County Planning Department. On 5/7/21, the property CL
owner filed an appeal to the Planning Commission of the Department's 4/7/21 letter
of understanding regarding the attempted use of storage/shipping containers at its
Key Largo property in the SC land use district (Property Identification No. 00149430-
000000). The Department determined that the storage/shipping containers used for °
commercial storage at the property were not subject to the property owner's
conditional use approval or building permit for the parcel, are structures that require
a permit and compliance with the Comprehensive Plan, LDC, Chapter 6 of the �?
County Code, the Florida Building Code, local and FEMA flood regulations, and
constitute non-residential floor area as defined in the LDC and are subject to N
NROGO. The owner's appeal of the Department's analysis and conclusions was CU
heard at the Planning Commission's November meeting. The Planning CommissionIt
affirmed on a vote of 3-2. Time for an appeal will start once PC Chair signs

resolution memorializing the vote.

Vacation Rental Cases
18.Coral Hammock Rental, et al. v. Monroe County, 20-AP-11-K; Third DCA Case 3D23-
0145. On 10/29/20, the Special Magistrate heard 47 vacation rental violation cases
arising from Coral Hammock, found 45 properties in violation, and assessed fines of
$224,329, plus costs. Twenty-Six of the 45 property owners found in violation
appealed the final order to the Circuit Court. The appeals were consolidated
for purposes of briefing common issues of law. Extensive briefs were filed and oral
argument was held on 10/13/22 before Sr. Judge James M. Barton II. On 11/18/22,
Judge Barton issued an opinion holding the owners are not prohibited from using
their attached units in the MU district for vacation rentals, reversing the Final Orders,
and instructing that the owners be allowed to apply for a vacation rental permit or
exemption. On 12/27/22, the court denied the County's motion for rehearing or
reconsideration. On 1/25/23, the County filed a petition for certiorari review in the
Third District. The property owners response is due 5/26/23. On 4/27/23, the
trial court denied the property owners' motion for contempt of mandate and to
enforce mandate and granted the County's motion to recall and stay mandate.
19.Lachlan, LLC, et. al. v. Monroe County, et. al., 23-CA-000104-K. On 2/17/23, the
Coral Hammock owners involved in 20-AP-11-K filed a mandamus complaint
seeking to compel the Planning Department to process their applications for °
exemptions to the annual vacation rental permit requirement (the Department
informed the owners that the applications would be held in abeyance pending
certiorari review in the Third District). On 3/17/23, the court ordered the County to �?
respond to the complaint. On 4/20/23, the County filed its answer to the complaint.

20.Monroe County v. 3M, et al., 16th Jud. Cir. Case No. 22-CA-618-K/2:22-cv-03680-
RMG, consolidated into 2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed
suit against manufacturers of aqueous film-forming foam (AFFF) containing per- and
polyfluoroalkyl substances (PFAS) to recover damages for investigation,
remediation, removal, disposal, treatment and monitoring of water and soil created
by defendants' products. PFAS had been detected at the Monroe County Fire c0
Training Academy on Grassy Key. On 10/7/22, defendants removed the case to the
U.S. District Court for the Southern District of Florida. On 10/26/22, the County's
case was transferred and consolidated with other similar cases in the Multi District
Litigation (MDL) case pending in the District of South Carolina before Hon. Richard
M. Gergel.

21.League of Women Voters of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-
00186, USDC/NDFL, 11th Cir. Ct. App. Case No. 22-11143, Suit against the State
and the Supervisors of Election for all 67 counties challenging SIB 90, elections
legislation enacted in 2021. Consolidated with NAACP of FL v. Sec'y of State Lee,
Joyce Griffin, et al, 4:21-cv-00187, USDC/NDFL, 11 th Cir. Ct. App. Case No. 22-
1114; Florida Rising Together, v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-201,
USDC/NDFL, 11th Cir. Ct. App. Case No. 22-11143;. Harriet Tubman Freedom
Fighters, et al v. Laurel M. Lee, et al, No. 4:21-cv-00-242-MW-MAF, 11th Cir. Ct.App.
22-11133. On 4/27/23, the 11th Circuit Court of Appeals reversed all but one
portion of the trial court's order invalidating SIB 90 but affirmed the invalidation
of the portion that prohibits a person from "engaging in any activity with the .
. . effect of influencing a voter."
22.Vote.org v. Byrd, Joyce Griffin, et al, No. 4:23-cv-00111 (N.D. Fla.). Suit was filed
on 3/16/23 against the Secretary of State and the Supervisor of Elections for
all 67 counties for declaratory and injunctive relief. The suit challenges the
signature requirement in F.S. 97.053(5)(a)8. with regard to one's voter
registration application and whether it needs to be an original "wet signature"
or if a "digital" signature is sufficient and in compliance with the statute. °
Griffin and other SOEs retained outside counsel. The CountyAttorney's Office
is assisting in the defense. A response is due on 5/22/23 by Supervisor Griffin.

Foreclosure Actions U
24.The CountyAttorney's Office is currently prosecuting a total of 31 cases to foreclose
or otherwise enforce on County code compliance liens. The Office is also currently
defending 8 mortgage foreclosure cases, where the County holds an interest in the
property, usually as a result of an inferior code compliance lien.
Other Matters of Interest
25.Code Collections. During April 2023, County Attorney and Code Compliance staff
collected $62,704.99 in code compliance fines and costs. Cumulatively through the
first seven months of FY23, staff has collected $636,336.63 in fines and costs,
including after-the-fact fees. A chart showing code collections is attached.

26.Vacation Rental Prosecutions. Three vacation rental cases were heard at the
April code hearing before the Special Magistrate. In both CE23030005 and
CE23030006, the Special Magistrate found the properties in violation and issued a
one-time fine for the vacation rental charge in the amount of$2500. Those vacation
rental violations are now in compliance. In CE23010050, the property was in
compliance and the owners stipulated to the violation and a one-time fine in the
amount of$7500.
