COMMISSIONERS OF MONROE COUNTY, FLORIDA,
ABOLISHING THE LIBRARY ADVISORY BOARD
CREATED BY ORDINANCE NO. 6-1981 AND CODIFIED
UNDER MONROE COUNTY CODE SECTION 15-67
THROUGH 15-72; PROVIDING FOR SEVERABILITY; 0
PROVIDING FOR THE REPEAL OF ALL ORDINANCES 0
INCONSISTENT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE. 0
WHEREAS, the Board of County Commissioners of Monroe County (the "Board"),
Florida,is authorized by Article VIII of the Florida Constitution and Chapter 125,Florida Statutes, U)
to adopt ordinances not inconsistent with general law; and U

WHEREAS, Florida Statute Section 125.01 provides the Board with the authority to
provide libraries for the community and Ordinance No. 6-1981 created an advisory board to
operate and maintain a free public library service within Monroe County; and
WHEREAS, Ordinance No. 6-1981 is currently codified at Sections 15-67 through 15-72
of the Monroe County Code of Ordinances ("the Code"); and

WHEREAS, staff seeks to now abolish the Library Advisory Board established by
Ordinance No. 6-1981 as it is no longer needed for the purpose for which is was established; and
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY 0
COMMISSIONERS OF MONROE COUNTY, FLORIDA AS FOLLOWS: °0

SECTION 1. Ordinance No. 6-1981 creating the library advisory board, and any other
ordinances revising Ordinance No. 6-1981, including but not limited to Ordinance No. 29-1999 i!%
are hereby repealed, as are any other ordinances inconsistent with this ordinance, and the Library
Advisory board is hereby dissolved. Monroe County Code Sections 15-67 through 15-72 are
hereby deleted as follows (deleted text is noted in strikethrough text):

SECTION 2. SEVERABILITY. Should any provision of this Ordinance be declared by 0
a court of competent jurisdiction to be invalid, the same shall not affect the validity of this
Resolution as whole, or any part thereof, other than the part declared to be invalid. If this
Resolution or any provision thereof shall be held to be inapplicable to any person, property or
circumstances, such holding shall not affect its applicability to any other person, property or
a�
circumstances.
SECTION 3. CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict.
SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect upon filing
with the Department of State as provided in Section 125.66(2), Florida Statutes.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County
Florida, at a regular meeting of said Board held on the day of July, 2023.
