AGENDA ITEM WORDING: Approval to initiate litigation against Jean Pierre Francois Sandal, including
but not limited to foreclosing the code compliance liens on his properties located at 1311 and 1317 Calder
Road in Key Largo, which arose out of code compliance cases: CE09050055; CE09030065 and
CE 11020046.
ITEM BACKGROUND: These properties have been the subject of three code compliance cases starting as
early as March 9, 2009, when Code Compliance received a complaint from the neighbors that the properties
were eyesores that were not being maintained. As of the August 15th BOCC meeting, the liens will have
accrued to $686,888.00. The Property Appraiser has revoked the homestead designation for one of these
properties due to Mr. Sandal's claim of homestead in Miami -Dade County, where he lives. The owner has
not attended any of the Code Compliance hearings nor made any effort to clean up either property. At least
one neighbor has expressed an interest in cleaning up the property should he acquire it at a judicial sale held
after foreclosure.
CE09050055: The Special Magistrate found Mr. Sandal in violation of a large shed and fish cleaning table
without required building permits; abandoned vehicles; abandoned vessels; trash and debris; illegal disposal
of abandoned vessels in canal; unsanitary nuisance; no business tax license to rent property; mobile home in
state of deterioration; mobile home floors sagging and shed walls leaning; and unsafe electric, plumbing &
floors. The Special Magistrate also ordered no habitation of the mobile home until it is made habitable and
imposed a fine of $150.00 per day that commenced running on November 26, 2009.
CE09030065: The Special Magistrate found Mr. Sandal in violation of an unsafe unpermitted roof deck and
imposed fines in the amount of $350.00 effective August 28, 2009.
CE11020046: The Special Magistrate found Mr. Sandal in violation of abandoned vehicles; abandoned
vessels; trash and debris; and unsanitary conditions, and imposed daily fines in the amount of $400.00
effective July 13, 2011.

violation(s) may result in the impositon of a fine, not to exceed $1,000
per day per violation for a first violation, $5,000 per day per violation
for a repeat violation, and up to $15,000 per violation if the Special
Magistrate finds the violation to be irreparable or irreversible in nature.
In addition to such fines, the Special Magistrate may impose additional
fines to cover all costs incurred by the local government in enforcing
its codes and all costs of repairs pursuant to subsection (1).

ORDER IMPOSING PENALTY AND AUTHORIZING RECORDING LIEN
This case was heard at public hearing before the Code Enforcement Special Magistrate
on September 24, 2009 at the Monroe County Government Regional Center, located at 2798
Overseas Highway, Marathon, Florida. The Special Magistrate fully considered the evidence
presented at hearing, including testimony of witnesses under oath.
1. The Respondent is the owner of record of property located at:
BK 3 LT 15 CROSS KEY WATERWAY ESTATES SECTION TWO KEY LARGO
(RE #: 00468472-007800).
2. On July 30, 2008, an Order finding Respondent in violation of Sections 110-140.(1),
17-2.(a), 17-2.(b), 21-20.(a), 21-21.(b), 21-76(t) 23-72., 6-27.(b)(2)b, 6-27.(b)(2)d and 6-
27.(b)(2)h. of the Monroe County Code, was entered.
3. Respondent was ordered to apply for a permit for demolition of shed and demolition
or permit for mobile home to be habitable on or before September 17, 2009.
4. The Compliance date for all charges was set for October 30, 2009 and No Occupancy
of shed or mobile home was ordered until made habitable.
5. The Respondent was informed that failure to do so could result in the imposition of a
fine for each Code violation and for each day after the Compliance Date that Respondent is in
violation.
6. As of the September 24, 2009, Respondent had not corrected the Code violations and
was given a new compliance date of November 25, 2009 (hereinafter referred to as the
"Compliance Date"),

ORDERED
1. Respondent shall pay to Monroe County, Florida, a fine in the amount of $100.00
(ONE HUNDRED DOLLARS) for code violations 6-27.(b)(2)b, 6-27.(b)(2)d and 6-27.(b)(2)h
and $ 50.00 (FIFTY DOLLARS) for code violations 110-140.(1), 17-2.(a), 17-2.(b), 21-20.(a),
21-21.(b), 21-76(f) and 23-72., for each day the violation remains uncorrected beginning
November 26, 2009 and the costs of the prosecution and investigation of this matter.
2. MONROE COUNTY MAY RECORD A CERTIFIED COPY OF THIS ORDER IN
THE PUBLIC RECORDS, WHICH SHALL THEREAFTER CONSTITUTE A LIEN
AGAINST THE LAND ON WHICH THE VIOLATIONS EXIST AND UPON ANY OTHER

PROPERTY APPRAISER:
Column 1. Tax Year/Date Tax Due: Insert the tax year and the date the tax was due for that year, usually November 1.
Column 2. Value Exemption: The amount of taxable value on which the exemption was applied.
Column 3. Amount of Tax Exempted: The amount of tax due on the taxable value exempted in column 2
Column 6. Assessment Limitation Value: The amount of taxable value on which the assessment limitation was
applied. To calculate this amount subtract the limited assessed value (capped value) from the just value
shown on the tax roll for each year.
Column 7 Tax Due from Wrongful Assessment Limitation: The amount of tax due on the taxable value limited in
column 2.
Column 4 & B.
Penalty on Tax Exempted: Penalty on Assessment Limitation: This is 50 percent of the tax under Section
196.011(9)(a) and 196.161(1)(a)(b), F.S. Penalty is not due on property appraiser clerical mistakes. Section
193.155(9),196.161(1)(b); rule 12D-8.0064(3)(d). If penalty is not due, property appraiser should enter zero
in columns 4, 5, 8 and 9.
TAX COLLECTOR:
Column 5.
Interest on Tax Exempted: Interest is 15 percent of the tax per annum running from the due date, usually
November 1, until paid. Section 196.011(9)(a) and 196.161(1)(a), F.S. If penalty is not due in column 4, then
enter zero in this column.
Column 9.
Interest on Assessment Limitation: Interest is 15 percent of the tax per annum running from the due date,
usually November 1, until paid. Section 193.155(9), F.S. If penalty Is not due in column 8, then enter zero in
this column.
Column 10,
TOTAL: Sum of Columns 3+4+5+7+8+9.
TOTAL DUE
Column 10 totals plus fees and costs.
Notice: The distribution of funds collected pursuant to Section 196.011(9)(a) or 196.161(1)(a), Florida
Statutes, shall be as follows: Fees and costs will be returned to the party initially expending said
fees or costs. Taxes, penalties and interest shall be distributed based upon millage that was in
effect for the year of the assessment
