Wood AGENDA ITEM WORDING: Approval of Amendment One to September 6,2005 Interlocal Agreement (ILA) between Monroe County and the Florida Keys Aqueduct Authority (FKAA). ITEM BACKGROUND: The September 6, 2005 ILA replaces all earlier agreements and the lease agreement authorizes a $5M advance for project expenses. The ILA does not specify how the MSTU funds are to be used. Under the previous agreement, the MSTU funds were disbursed to FKAA. The purpose ofthe MSTU Ordinances was to fund the provision of municipal services associated with the administration, planning, and development of wastewater and reclaimed water projects within the MSTU. Monroe County requests the MSTU revenue be used to fund County expenses associated with the advancement of wastewater systems within the MSTUs. PREVIOUS RELEVANT BOCC ACTION: On September 6,2005, Monroe County entered into an ILA with FKAA for wastewater systems in Duck Key, Long Key, and the Lower Keys. On January 25, 2006 the BOCC approved the levy ofMSTU special assessments in Fiscal Year 2007 in the following sewer areas: Duck Key, Conch Key, Baypoint, Big Coppitt, Cudjoe-Sugarloaf, and Big Pine Key. CONTRACT/AGREEMENT CHANGES: Amendment One provides that MSTU revenue may be used to fund Monroe County administration, planning, and development costs associated with and incurred in advancing wastewater and reclaimed water projects within the respective MSTU. Any surplus MSTU funds will be dispersed to FKAA for administration, planning, and development costs associated with and incurred in advancing wastewater and reclaimed water projects within the respective MSTU.
