Shark Key Narrative
Sean and Amy Kelley purchased the property known as 71 Cannon Royal Drive, Key West,
Florida on January 25, 2005, from Arthur and Deborah Hungerford. The legal description of the
property is contained in the Warranty Deed attached to this narrative. The Kelley's immediately took
steps to develop the property and planned on building their new home for their family and residing
on Shark Key.
Shortly after purchasing the property, the Kelley's interviewed architects and chose Glenn
Gray of Glenn Gray & Associates, Inc. Glenn has designed several houses on Shark Key and both
his demeanor and vision suited the Kelley's. Plans for anew single family residence were completed
in March of 2005 and a permit was immediately applied for. A permit was issued on April 27, 2005
under permit no. 05102073. A copy of the receipt issued by the building department is attached.
The permit was issued prior to the expiration of the ROGO Exemption for this lot.
The Kelley's also began interviewing contractors to build the new home. They received
several bids, but narrowed their choice to two contractors. The two finalists were Chris Dunn and
Brooks Tbommes of Pinewood Enterprises, Inc. Pinewood initially indicated that they could not
begin construction for some time due to their current workload. Therefore, the Kelley's began to
draft a final contract with Chris Dunn. Prior to finalization of the contract, the architect notified the
Kelley's that Pinewood was going to be able to schedule their project and the Kelley's began
discussions with Pinewood. This was particularly appealing because Pinewood was under contract
to construct the home adjacent to the Kelley's. The permit was issued with Pinewood as the
contractor. It was at this time that the Kelley's determined that they needed to relocate due to family
issues. The Kelley's moved in January of 2006 to St. Augustine, Florida.
Given the sever slowdown in the real estate market and their move to St. Augustine, the
Kelley's are unable to financially begin or complete construction of the Shark Key residence at this
time. They diligently pursued the issuance of a permit and construction of the residence. They paid
approximately $15,000 in impact fees and permit fees which will be lost when the permit expires.
It would result in severe financial hardship ifthe ROGO Exemption for this parcel was not extended.
The developer was able to obtain an extension of the ROGO Exemption for several lots on Shark
Key and the Kelley's seek the same extension given to the developer.
