ITEM BACKGROUND: When Islamorada incorporated, County conveyed rights-of-way in their jurisdiction to the new municipality via a statutory deed. This ROW has not yet been conveyed to the municipality, which has requested transfer in a letter dated Feb, 9, 2009. PREVIOUS RELEVANT BOCC ACTION: Conveyance of rights-of-way to Islamorada on May 12, 1999. Abandonment of portion of platted ROW in resolution No. 106-1981. FBN 336122 Office of County Attorney P.O.Box 1026 Key West, FI. 33041-1026 QUITCLAIM DEED Public Road THIS INDENTURE, Made this 15th day of April. 2009, by and between the Board of County Commissioners for Monroe County. Florida, Party of the First Part, whose address is 500 Whitehead Street, Key West, FI. 33040, to Islamorada, Village of Islands. Party of the Second Part. WITNESSETH WHEREAS, Unnamed Road was dedicated in a survey recorded at Plat book ?, Page 51 of the Official Records of Monroe County Florida, as a publie road; and WHEREAS, on May 12, 1999, the Party of the First Part did convey to the party of the Second Part a statutory deed conveying roads lying in the new municipality of Islamorada, Village of Islands, but the Unnamed Road which is the subject of this deed was not included in said conveyance; and WHEREAS, in order to transfer the road to the municipality in which said road is located, the party of the First Part must convey quitclaim the road hereinafter described to the Party of the Second Part without consideration. NOW, THEREFORE, THIS INDENTURE WITNESSETH: That the Party of the First Part does hereby remise, release and quitclaim unto the Party of the Second Part, and assigns, forever, all the right, title and interest of the Party of the First Part to the property herein described to be used solely for public road purposes, all that certain land situate in Monroe_County, Florida, viz: A 20 Foot Access Road Dedicated Across Plat of Survey of Roger L. and Sarah Albury and Alec De Brocq Property, platted at PB 2, p. 51, excepting that portion previously abandoned by Monroe County Resolution No. 106~1981 (See Exhibit A, attached hereto and made a part hereof, showing Plat) TO HAVE AND TO HOLD, the said premises and the appurtenances thereof unto the Party of the Second Part.
