AGENDA ITEM WORDING: Approval to amend the agreement and exercise the fIrst renewal
option of the contract with. U. S. Water Services Corporation for operation and maintenance of the
wastewater treatment plant at the Marathon Government Center
ITEM BACKGROUND: The contract presently contains language in Paragraph 2, item D. regarding major
component failure or system breakdown which needs to be c1arilied and on August 31, 2009, the current
contract with u. S. Water Services Corporation will expire. The original contract dated July 16, 2008, was for
one year, with two one-year options to renew. Staff recommends amending the contract and exercising the first
renewal option to renew the contract for an additional one-year period in accordance with Paragraph 5 of the
contract.
PREVIOUS RELEVANT BOCC ACTION: On July 16,2008, the BOCC approved award ofbid
and execution of the contraCt with U. W. Water Services Corporation to operate and maintain the
wastewater treatment plant at the Marathon Government Center.
CONTRACT/AGREEMENT CHANGES: Clarify language in Item 2, D. and renew contract to
commence on September 1, 2009 and tenninate on August 31, 2010, to include an increase in cost by the CP1-U
of. I % as follows: Monthly Operation and Maintenance charges shall increase from $850.56 per month to
$851.4] per month. Repairs during normal working hours beyond the $500.00 limit shall increase from $75.00
per hour 10 $75.08 per hour. Emergency service calls for overtime hours shall increase from $112.50 per hour
to $112.62.

The contract presently contains language regarding major component failure or system breakdown
in Paragraph 2, item D. which needs clarification, and on August 31, 2009, the current COntract
with U. S. Water Services Corporation will expire. The original contract dated July 16, 2008, was
for one year and provides for two one-year options to renew. Staff re<:ommends amending the
contract and exerCising the first renewal option to renew the contract for an additional one-year
period in accordance with Paragraph 5 of the contract.
I hereby request approval to amend the agreement and exercise the first option to renew the
contract with U. S. Water Services Corporation for the operation and maintenance of the
wastewater treatment plant at the Marathon Government Center.
