Approval of a resolution confirming support for and authorizing staff to expediently pursue the
amendment of Monroe County's Land Development Regulations to revise the existing transient unit
redevelopme:nt procedure and to clarify multi-room unit construction regulation.
ITEM BACKGROUND:
At a special meeting of the BOCC in February regarding Working Waterfront regulations Staff was
directed to review municipal codes within Monroe County for a better approach to transient
redevelopment methodologies. Following this review, Staff is recommending a modified "Marathon
Model" which will allow multi-room units with a conversion ratio based on the number of bedrooms
proposed. This resolution confirms the support for this approach, provides direction to staff and
notifies the Florida Department of Community Affairs of the County's intent. This model for transient
redevelopment has been reviewed and approved by the DCA for use in the City of Marathon.

A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS CONFIRMING SUPPORT AND AUTHORIZING
ST AFF TO EXPEDIENTL Y PURSUE THE AMENDMENT OF
MONROE COUNTY'S LAND DEVELOPMENT REGULATIONS TO
REVISE THE EXISTING TRANSIENT UNIT REDEVELOPMENT
PROCEDURE AND TO CLARIFY MULTI-ROOM UNIT
CONSTRUCTION REGULATION
WHEREAS, Section 101-1 of the Monroe County Code establishes the definition of a room, hotel or
motel as:
Room, hotel or motel means a unit in a public lodging establishment
as defined by F.S. 9 509.013(4 )(a) intended for transient lodging only
for periods not exceeding 30 days. Transient occupancy shall
conform to the definition contained in F.S. 9 509.013(12) as to
transient occupancy. For the purposes of density restriction under
this chapter:
(1) Hotel or motel room may be a single room or a suite and may
include a kitchenette but no more than 1 1/2 bathrooms and one
bedroom and one other living area.
(2) All entrances to a hotel or motel room shall share the same key
or means of controlling access so that the hotel or motel room as
defined herein is not divisible into separately rentable units.
(3) Suites containing more than one bedroom and 1 1/2 baths may
be constructed; however, each bedroom/bath combination shall be
considered a hotel/motel unit.
and;
WHEREAS, Policy 101.2.6 of the Monroe County Comprehensive Plan calls for a moratorium on new
transient development until December 2006; and
WHEREAS, Section 138-23 of the Monroe County Code established a moratorium on new transient
allocations through RaGa until December 31, 2008; and
WHEREAS, Staff is drafting a proposed amendment to address transient needs for RaGa allocations
and subsequent development, therefore zoning is in progress; and
WHEREAS, the BaCC recognizes the need for transient unit redevelopment and desires a more
incentivized method of allowing suite type unit development containing up to three (3) bedrooms; and
WHEREAS, pursuant to BOCC direction Staff has reviewed transient redevelopment regulations in
effect for the City of Key West, the City of Marathon and the Village of Islamorada and recommends a
modified approach similar to the City of Marathon; and
WHEREAS, the "Marathon Model" is based on a traffic study which indicates that with each
additional room beyond one (I) there is a 70/0 increase in impact in a transient setting~ and
WHEREAS, the "Marathon Model" was adopted by the City of Marathon through City Ordinance
2004-017 and approved by the Florida Department of Community Affairs on February 24, 2005;
NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of County Commissioners:
Section 1: The Growth Management Division is instructed to make the needed revisions to the Monroe
County Code to facilitate a modified approach to transient redevelopment allowing for suite type units
with a convt:rsion which approximates that a one (1) bedroom unit may be transferred or redeveloped
on site as a two (2) bedroom unit at a ratio of 900/0 or as a three (3) bedroom unit at a ratio of 85%. This
conversion ratio will allow a facility with 100 single bedroom units to redevelop on site or transfer the
existing units as two (2) bedroom units for a total of 90 units or as three (3) bedroom units for a total of
85 units.
Section 2: The Growth Management Division is instructed to amend the necessary sections of the
Monroe County code and the Monroe County Comprehensive Plan to denote transient hotel/motel
density as units consisting of rooms.
