AGENDA ITEM WORDING: Approval of a contract with Native Construction Contracting, Inc. for
replacement of the boat ramp and docks at Sunset Point Park.
ITEM BACKGROUND: On May 12, 2009 a bid opening was held for the replacement of the Sunset
Point Park boat ramp and docks. 10 bidders responded with staff recommending the second lowest
bidder as the lowest conforming bidder, as they are licensed both in Monroe County and the State of
Florida. The project will be 75% funded with an FWC grant to a maximum reimbursement of
$139,930.00. The County's obligation is to fund 25% of the Costs.
PREVIOUS RELEVANT BOCC ACTION: Acceptance of FWC Grant Approved by BOCC in
November 2008 and signed by BOCC 19NOV08 and by FWC of 30JAN09.
CONTRACT/AGREEMENT CHANGES: Not Applicable.

SUBJECT: Contractor Recommendation for Sunset Point Boat Ramp Project
Recommendation: Select Native Construction Contracting, Inc. as the contractor for the
Sunset Point Boat Ramp Project.
Basis for Recommendation:
1. The recommended contractor is the second lowest bidder.
2. The recommended contractor is already licensed in Monroe County. The low bidder is not
licensed either in Monroe County or with the State or another entity with which Monroe County
has a reciprocal agreement.
3. The bid documents require submission of proof of licensing and allow for the possibility for
selection of a contractor on a basis other than price.
BACKGROUND:
The bid tabulation (attached) shows the range of bids for the project from $34,950 through
$109,500. The recommended bidder submitted a price of$49,800. The low bidder's submitted
license documents are from Miami-Dade County. He is not licensed in Monroe County and
holds no State licenses. The next two low bidders are both State licensed general contractors
and the second lowest bidder is already licensed and registered in Monroe County. The RFP
documents (an extract of which is attached) require that the bidder submit a "copy of the
appropriate contractor's license and proof that he is properly licensed to conduct business in
Monroe County as a part of the Bid Proposal".

ARTICLE V
BIDDING PROCEDURE
5.1 FORM AND STYLE OF BIDS
A. The Bid Proposal shall be submitted on the forms included in Section 00110 of these Bidding
Documents with the exception of the Bid Bond, which may be submitted in alternate forms as
described in Section 5.3 - B of these Instructions to Bidders. Each of the forms in Section
00110 must be properly filled out, executed, and submitted as the Bid Proposal.
1. Bidders shall photocopy documents included in the Bid Package as being required for
submission of Bids.
2. A person or affiliate who has been placed on the convicted vendor list following a
conviction for public entity crime may not submit a bid on a contract to provide any
goods or services to a public entity, may not submit a bid on a contract with a public
entity for the construction or repair of a public building or public work, may not
submit bids on leases of real property to public entity, may not be awarded or perform
work as contractor, supplier, subcontractor, or consultant under a contract with any
public entity, and may not transact business with any public entity in excess of the
threshold amount provided in Section 287.017, for CATEGORY TWO for a period of
36 months from the date of being placed on the convicted vendor list.
3. All forms contained in Section 00110 - Bid Proposal must be fully completed and
submitted as part of the Bid Proposal.
4. The Bidder is required to submit a copy of the appropriate Contractor's license and
proof that he is properly licensed to conduct business in Monroe County as part of the
Bid Proposal.
B. All blanks on the Bid Form shall be filled in with ink or by typewriter.
C. Where so indicated on the Bid Form, sums shall be expressed in both words and figures, and
in case of discrepancy between the two, the amount written in words shall govern.
D. All Bidders must submit copies of their Contractor's license with their Bid.
E. In order to determine if persons submitting bids are responsible, all Bids must contain the
following information:
1) A list of the person's shareholders with five (5)percent or more of the stock or,if a
general partnership, a list of the general partners; or,if a limited liability company, a list of its
members;
2) A list of the officers and directors of the person;
3) The number of years the person has been operating and,if different, the number of
years it has been providing the services, goods, or construction services called for in the Bid.
4) The number of years the person has operated under its present name and any prior
names;
5) Answers to the following questions regarding claims and suits:
