AGENDA ITEM WORDING: Receipt of monthly report on change orders reviewed by the County
Administrator's Office.
ITEM BACKGROUND: There were five change orders considered and approved by the County
Administrator for the period beginning April 1, 2009 and ending April 30, 2009 for a net credit of
$38,474.20. There were no change order requests rejected by the Engineering Services or Project
Management.
PREVIOUS RELEVANT BOCC ACTION: On September 9, 1998, Ordinance No. 026-1998 was
adopted in order to provide that the County Administrator may approve separate, non-cumulative
change orders for construction projects and professional service contracts in amounts not to exceed
$25,000.00 or 5% of the original contract price, whichever is greater. The BOCC requested a monthly
report of all change orders considered by the County Administrator.

Attached is a proposed change order for B.A.T. Construction, Inc. (Change Order #2 for
the Environmental Wetlands Mitigation, Medical Examiner's Facility is for a no cost time
extension of 25 days changing the completion date from 2/28109 to 3/25109. The time
extension is due to a defay in receiving fencing. They were unaware that they would
have to put in a request for time extension until they were notified by the Engineering
Department accounting for the late request)
According to the ordinance adopted by the Board of County Commissioners. proposed
change orders are to be presented to members of the Board of County Commissioners
prior to approval, assuming they are within the Administrator's prescribed limits. Change
orders not within the Admini$trator's authority are placed on the BOCC agenda.

due to direct purchase of materials through the county to take advantage of tax free
status reducing the overall cost of the project.)

RE: Change Orders
Attached is a proposed change order for AFCO Constructors, Inc. (Change Order #17
for the Murray E. Nelson Government & Cultural Center is for a decrease of $8,132.61.
Monroe County had paid Florida Keys Electric Cooperative Assoc. electric bills from
9/24/08 up to substantial completion 1/09/09. These were the responsibility of the
contractor. )
According to the ordinance adopted by the Board of County Commissioners, proposed
change orders are to be presented to members of the Board of County Commissioners
prior to approval, assuming they are within the Administrator's prescribed limits. Change
orders not within the Administrator's authority are placed on the BOCC agenda.
The Administrator/Deputy Administrator intends to approve this change order on
Monday, April 13, 2009.

Attached is a proposed change order for AFCO Constructors, Inc. (Change Order #18
for the Murray E. Nelson Government & Cultural Center is for an increase of
$245,000.00 for all remaining claims for additional work and claimed credits. Additional
work is detailed on attached as are items for which credits have been claimed. The
amount is a negotiated bulk amount in which most items were adjusted from Qaims by
the contractor or the County. This agreement settles all claims excluding warranties and
includes a waiver of litigation by the contractor.)
According to the ordinance adopted by the Board of County Commissioners, proposed
