ITEM BACKGROUND:
On 8/19/09, BOCC discussed the loss of funds realized by the County resulting from building permit fee
waivers and exemptions. BOCC directed staff to bring a proposal to the Board for consideration at the
September Boce meeting to eliminate and reduce building permit fee waivers and exemptions.

WHEREASt in 2007, the Board of County Commissioners for Monroe County approved
a building permit fee schedule designed to allocate the costs of operating the County Building
Department to the users of the services of that department; and
WHEREAS, waivers and exemptions of permit fees have to be offset with ad valorem
taxes due to Section 553.80, F.S., which limits building permit fees to only those costs associated
with the services rendered in connection with the issuance of a building permit; and
WHEREAS, the liberal exemption and waiver provisions of the County Code have
resulted in the waiver of over $2,000,000 in permit fees during recent years; and
WHEREAS, the Board of County Commissioners for Monroe County finds that it is in
the best interest of the residents and taxpayers of Momoe County to delete the exemptions and
ability to issue waivers of building permit fees;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COl\fMISSIONERS OF MONROE COUNTY, FLORIDA:
SECTION 1. Section 6-108, Monroe County Code, is hereby amended to read:
Sec. 6-108. Fees.
(a) Purpose. The purpose of this section is to establish the authority, schedule, and exemptions
for permitting and related fees.
(b) Authority and fee schedule. Except as specifically established by this chapter, the board of
county commissioners may by resolution establish a fee schedule for, but not limited to, permit
applications, permits, plans examination, certificates of competency, re-inspections, permit
renewals, administrative fees, variance requests, and administrative appeals.
(c) Required. Except as authorized by this chapter, no permit shall be issued without payment
of all appropriate fees. Where a nonrefundable application fee is charged, the fee may be applied
to off-set the total permit fee at the time the permit is issued, except where the application fee
exceeds the total permit fee. In this case, the application fee shall become the total permit fee.
(d) Exemptions. Exemptions only exist as specifically provided by State statute and for
volunteer fire departments. Fees may be e~eBlpted for only those 0Btities and actblities

(f) Refunds. No fees paid for building pennit fees shall be refunded without the approval of the
board of county commissioners upon the recommendation of the county administrator. Permit
application fees are not refundable.

SEC.6-17(e).
WHEREAS~ the State of Florida and all local governments in the Florida Keys
(each subject to Area of Critical State Concern mandates relating to housing
afTordability) recognize the need for affordable housing throughout the state and
particularly in the Florida Keys where developable land for housing is extremely limited
and expensive; and
WHEREAS, the Board of County Commissioners is committed to addressing
critical housing affordability issues facing the Florida Keys; 'and
WHEREAS, the Board of County Commissioners makes the following findings
of fact:
1. The State of Florida and all local governments in the Florida Keys recognize the
need for affordable housing throughout the state and particularly in the Florida
Keys where developable land for housing is extremely limited and expensive.
2. To encourage the creation of affordable housing the Board of County
Commissioners must take innovative actions, such as the waiver or elimination of
building, permitting and other fees.
3. Monroe County Code Sec. 6-27 (d) (2) provides for full exemption from county
building and permit application fees for the construction of affordable housing
projects that are 'forecejving financial assistance from Monroe County."
4. Monroe County Code Sec. 6-27 (e) provides that not-for-profit organizations and

application fees" .
5. A generic waiver for all projects for which waiver would be allowable under the
County Code would provide incentives, or at least diminish the disincentives, for

additional affordable housing in tbe Florida Keys; now therefore

Section 1. It is the intention of the Board of County Commissioners to alw"ays' waive .,. "r", '~~~:"
the building permit and application fees charged by Monroe County for
construction or redevelopment of affordable housing projects for any
applicant that is a not-for-profit organization, with SOl(e) (3) status~ or who
is the lessee of county-owned property and/or who receives financial
assistance from Monroe County for the purpose of constructing or
redeveloping affordable housing projects.
Section 2. The permit application fees for all affordable housing projects which meet
the conditions in section 1, above, and which have been initiated but have
not received their certificates of occupancy are hereby waived effective the
date of execution of this Resolution.
Section 3. Growth Management Division staff is directed to prepare an
amendment to Monroe County Code Sec. 6~27(d)(2) and Sec. 6-27(e} to
routinely implement the above intention of the Board.

regarding the Building Depart Rle.nt. revenues and the appropriate Florida Statute
governing these funds.
Included in this submission is an analysis of the permits that have been issued without
collecting the appropriate permit fees due to either BOCC approval for the individual
project or they were Monroe County Projects which were fee exeulpt per Monroe County
Code. The total of the uncollected permit fees (waived) is $2,303,025.00 as of this count
Florjda Statute 553.80(7) states in part that "Any unexpended balances shall be carried
fotWard to future yea~s for allowable activities or shall be refunded at the discretion of
the local government."

(7) The governing bodies of local governments may provide a schedule of reasonable fees, as authorized by s. 125.56f2) or s.
166.222 and thfs section, for enforcing this part:-These fees, and any fines or investmentearnfng&~related4~ t~.. f~J. shall be
used solely for carrying out the local govemmenfs responsibilities in enforcing the Florida Buildfng Code. When prcwlarng a
schedule of reasonable fees, the total estimated annuaL revenue derived from fees, and the ffnes and Investment earnings
related to the fees, may not exceed the total estimated annual costs of allowable activities. Any unexpended balances shall be
carried forward to future years for allowable activities or shall be refunded at the discretion of the local government. The
basts for a fee structure for allowable activities shall relate to the level of service provided by the local government and shall
include consfderation for refunding fees due to reduced services based on servfces provided as prescribed by s. 553.791, but
not provtded by the tocal government. F~ charged shall be consistently applied.
(a) As used in this subsection. the phrase -enforcfng the Florfda Building Code.' lncludes the direct costs and reasonable
indirect costs associated with review of building plans, bUfldina1nspectfons, reinspections, and building permIt process'ng;
bUilding code enforcement; and fire inspections associated with new construction. The phrase may also Include training costs
associated wfth the enforcement of the Florfda Building Code and enforcement action pertaining to unlicensed contractor
actfvity to the extent not funded by other user fees.
(b) The following actfVitles may not be funded with fees adopted for enforcing the Florida Building Code:
1. Planning and zoning or other general government activities.
2. Inspectfons of publtc bufld1ngs for a reduced fee or no fee.
3. Public information requests, community functions, boards, and any program not directly related to enforcement of the
Florida Building Code.
~. Enforcement and implementation of any other local ordfnance, excluding vatfdly adopted local amendments to the Florfda
Butld1ng Code and excludfng any local ordinance directly related to enforcing the Florida ButLdfng Code as defined in paragraph -_
(a).
(c) A local goverrment shall use recognized managementt accounting, and oversfght practices to ensure that fees, fines, and
investment earntngs generated under this subsection are maintained and allocated or used solely for the purposes described In

WHEREAS, the Monroe County Board of County Commissioners wish to provide the citizens of the
County \vith the best possible service in the most cost effective and reasonable manner; and
WHEREAS, it is in the best inte14ests of the public to charge the true cost for such services, thereby
placing the burden of such costs directly upon those persons deriving the benefit from the services; and
WHEREAS, the Director of Growth Management has demonstrated that the existing fee schedule does
not reflect the true cost of providing the services to the persons requesting the Building Department
services; and
WHEREAS, the Board heard testhnony and evidence presented as to the appropriate fee schedule; and
WHEREAS, the Board concurs with the conclusions and findings of the Growth Management Director;

preparation of official documentation verifying existing development rights and other
processes and services; and
WHERE.AS~ the Board heard testimony and evidence presented as to the
appropriate fee schedule during a public hearing on October 17~ 2007; and,
WHEREAS, the Board of County Commissioners concurs \vith the
recommendations of the Growth Management Ditector;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY FLORIDA:

COUNTY CODE, TO PROVIDE A REASONABLE RECOVERY
OF THE COSTS INCURRED TO THE GROWTH MANAGEMENT
DMSION IN STAFF TIME AND MATERIALS EXPENDED FOR
PROVIDING SUCH SERVICE TO THE 'PARTIES RECEIVING
THE BENEFITS OF THE REVIEW, AND THUS, FURTHER
REDUCING THE BURDEN CURRENTLY BEING BORNE BY

EFFECTIVE DATE OF APRIL 284 2007 .
WHEREAS, the Monroe County Board of County Commissioners wishes to
provide the citizens of the County with the best possible service in the most cost effective
and reasonable manner; and
WHEREAS" the Board finds that it would be in the best interest of the general
public to charge the- true cost for development related services, thereby placing the
burden of such costs directly upon those parties deriving the benefit; and,
WHEREASt the Growth Management Director has demonstrated that the
existing fee schedule does not reflect the true cost of providing the services to the parties
requesting services from the Planning and Environmental Resources Department; and
WHEREAS, the updated fee schedule prepared by the Growth Management
Division for providing these services includes the estimated direct oosts and reasonable
indirect costs associated with the review and processing of planning and development
approval applications and site plans, on-site biological reviews, administrative appeals,
preparation of official docwnentation verifying existing development rights, and waivers
and exemptions to inclusionary housing requirements; and
WHEREAS~ after hearing testimony and evidence presented as to the appropriate
fee schedule during a public hearing on April 18, 2007, the Board of County
Commissioners concurs with the reconunendations of the Growth Management Director.

FOR INCORPORA nON INTO THE MONROE COUNTY CODE
OF ORDINANCES; PROVIDING FOR 'SEVERABILITY; AND
PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, the County has a demonstrated and tU-gent need for more affordable
housing;
WHEREAS, the average cost of housing in the County is among the highest in
the State of Florida;
WHEREASt permitting fees add at least $2,000 to the average cost of building a
house; and, ,
WHEREAS, the Board of County Conunissioners of Monroe County recognizes
and is committed to addressing the problem of affordable housing to meet the social and
economic needs of County residents; and,
WHEREAS, Chapter 6, Monroe County Code, does not explicitly authorize the
exemption from Monroe County building application and permitting fees for the
construction of affordable housing projects by for-profit or not-profit organizations that
receive financial support from the County; and,
WHEREAS, the exemption of permitting fees for construction of affordable
housing receiving financial assistance from the County is in the public interest and helps
to make such housing more affordable;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THE FOLLOWING:
Section 1. Section 6-27(d)(2), Monroe County Code is hereby amended to add
subparagraph "d." that reads as follows:

Construction of affordable housing projects, as defined under the Florida
Statutes or chapter 9.5, receiving financial assistance from Monroe

Section 2. Any affordable housing construction project made eligible for a fee
exemption authorized by this ordinance shall be entitled to the fee exemption if the
building permit application for the project was submitted to the Monroe County Building
Department after March 31,2003.
Section 3. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder oftbis ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section S. This ordinance shall take effect immediately, upon receipt of the official
notice from the Office of th,e Secretary of State of the State of Florida that this ordinance
has been filed with said Office. 4
Section 6. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition, or amendment
thereto, and shall be appropriately renumbered to confonn to the unifonn numbering
system of the Code.
Section 7. The Clerk of the Cowt is het:eby directed to forward a copy of this Ordinance
to the Municipal Code Corporation for incorporation into the Monroe County Code of
Ordinances.

WHEREAS, in 2007, the Board of County Commissioners for Momoe County approved
a building permit fee schedule designed to allocate the costs of operating the County Building
Department to the users of the services of that department; and
WHEREAS, waivers and exemptions of permit fees have to be offset with ad valorem
taxes due to Section 553.80, F.S., which limits building permit fees to only those costs associated
with the services rendered in connection with the issuance of a building permit; and
WHEREAS, the liberal exemption and waiver provisions of the County Code have
resulted in the waiver of over $2,000,000 in permit fees during recent years; and
WHEREAS, the Board of County Commissioners for Monroe County finds that it is in
the best interest of the residents and taxpayers of Monroe County to delete the exemptions and
ability to issue waivers of building permit fees;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COl\1MISSIONERS OF MONROE COUNTY, FLORIDA:
SECTION 1. Section 6-108, Monroe County Code, is hereby amended to read;
Sec. 6-108. Fees.
(a) Purpose. The purpose of this section is to establish the authority, schedule, and exemptions
for permitting and related fees.
(b) Authority and fee schedule. Except as specifically established by this chapter, the board of
county commissioners may by resolution establish a fee schedule for, but not limited to, permit
applications, permits, plans examination, certificates of competency, re-inspections, permit
renewals, administrative fees, variance requests, and administrative appeals.
(c) Required. Except as authorized by this chapter, no permit shall be issued without payment
of all appropriate fees. Where a nomefundable application fee is charged, the fee may be applied
to off-set the total permit fee at the time the permit is issued, except where the application fee
exceeds the total permit fee. In this case, the application fee shall become the total permit fee.
Cd) Exemptions. Exemptions only exist as specifically provided by State statute and for
volunteer fire departments. Fccs may be exempted for only those entities and activities
specifically listed bclow:
(1) Conditional cxcnzptions. The following go';emmental entities arc exempt from county
building permit and application fees, but only if the listed cntity does Hot charge the county a fee

(2) Pull exemptions. The following cfltities or work are exempt from the county building
pennit and application fees:
a. The count)';
b. Volunteer fire departmcflts;
c. Y olunteer emergency medical departments; and
d. Construction of affordable housing projects, as defined under stute statutes or part II of this
Code, recciving financial assistance from the county.
(e) Waivers. There are no waivers of permit fees except for those projects which have, as of
September 1. 2009. been provided, for financing purposes, certifications that the County waives
permit fees for the construction of affordable housing., Not for profit organizations with
501(c)(3) status from the Internal Re"lenue Service for construction of affordable or low income
housing as defined by state statutes and lessees of count)' owned property for construction on
such property may apply to the board of county commissioners for fee v/aivcrs from the permit
and application fees.
(f) Refunds. No fees paid for building permit fees shall be refunded without the approval of the
board of county commissioners upon the recommendation of the county administrator. Permit
application fees are not refundable.

APPLICA TION FEES FOR THE AFFORDABLE
HOUSING DEVELOPMENTS, PURSUANT TO
MONROE COUNlY CODE, SEe. 6-27(d)(2) AND
SEC.6-27(e).

WHEREAS, the State of Florida and all local governments in the Florida Keys
(each subject to Area of Critical State Concern mandates relating to housing
affordability) recognize the need for affordable housing throughout the state and
particularly in the Florida Keys where developable land for housing is extremely limited
and expensive; and
WHEREAS. the Board of County Commissioners is committed to addressing
critical housing affordability issues facing the Florida Keys; and
WHEREAS, the Board of County Commissioners makes the following findings
of fact:
I. The State of Florida and all local governments in the Florida Keys recognize the
need for affordable housing throughout the state and particularly in the Florida
Keys where developable land for housing is extremely limited and expensive.
2. To encourage the creation of affordable housing the Board of County
Commissioners must take innovative actions, such as the waiver or elimination of
building. permitting and other fees.
3. Monroe County Code Sec. 6-27 (d) (2) provides for full exemption from county
building and permit application fees for the construction of affordable housing
projects that are "receiving financial assistance from Monroe County."
4. Monroe County Code Sec. 6-27 (e) provides that not-for-profit organizations and
" . .. lessees of county-owned property for construction on said property ... may
apply to the Board of County Commissioners for fee waivers from the permit and
application fees" .
5. A generic waiver for all projects for which waiver would be allowable under the
County Code would provide incentives, or at least diminish the disincentives, for
the creation of affordable housing, to include such measures as waiver of
building, permitting and other fees, developers have been hesitant to create
additional affordable housing in the Florida Keys; now therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:

Section 1.

It is the intention of the Board of County Commissioners to alw"ays waive
the building permit and application fees charged by Monroe County for
construction or redevelopment of affordable housing projects for any
applicant that is a not-for-profit organization, with SOl(c) (3) status, or who
is the lessee of county-owned property andlor who receives financial
assistance from Monroe County for the purpose of constructing or
redeveloping affordable housing projects.

Section 2. The permit application fees for all affordabJe housing projects which meet
the conditions in section 1, above, and which have been initiated but have
not received their certificates of occupancy are hereby waived effective the
date of execution of this Resolution.
Section 3. Growth Management Division staff is directed to prepare an
amendment to Monroe County Code Sec. 6:"27(d)(2) and Sec. 6-27(e) to
routinely implement the above intention of the Board.

(c) Fees Required: Except as authorized by this chapter, no permit shall be issued without
payment of an appropliate fee.. Where. nonntfundable application fee II charged, the fee may
be applied to off-Ht the total permit fee at the time the permit is i.sued, except where the
appUcatlon ree exC4led. the totIIl permit fee. In thil ca.., the appllc8tion fee shill become the
total permit fee.
(d) Fee Exemptions: Fe" m~ be exempted for only tho.. entitln and ICtivltiel specifically

(1) Conditional exemption.: The following governmental entitin are ex.mpt from
county building permit and application fe... but only if the lilted entity doe. not charge
the county a rea (including an Impact fee) for development, environment. or Similar
permits, or for right-of-way use: '
a. The State of Florida Including the South Florida Water Management Ol.kict;
b. The United SIa"';
c. Municlp&lftIes wholly Ioc8ted within the county;
d. City Electric SYltem;
e. Florid. Keys Electric Co-op; and
f. Florida Keys Aqueduct Authority.
(2) Full exemptions: The feUowlng entities or work are exempt from the county building
permit and application fee.:
a. Monroe County;
b. Volunteer fire departments;
c. Volunteer emergency medical departments; and,
d. Conllructlon of affordable houllng projects, 8. defined under the Florida
Statute. or chapter 9.5. receiving financial...lltance from Monroe County.
(e) Fee Waw8I3: Not~for...prufit organization. with 501(cX3) statu, from the lntemal Revenue
Service far construction of affordable or low income houllng as defined by Florida Statute. and
18I18es of county-owned property for construction on Mid property may apply to the board of
county commi..ioners for fee waivers from the permit and application feel.
(f) Fee Refunds: No feel paid for building permit feel shall be refunded without the approval
of the board of county commilaloners upon the recommendation of the county administrator.

As requested by Ms. Tina Boan, Budget Director, please find attached the inibrmation
regarding the Building Department revenues and the appropriate Florida Statute
governing these funds.
Included in this submission is an analysis of the permits that have been issued without
collecting the appropriate permit fees due to either BOCC approval tor the individual
project or they were Monroe County Projects which were fee exempt per Monroe County
Code. The total of the uncollected permit fees (waived) is $2,303,025.00 as o1'tl1is count.
Florida Statute 553.80(7) states in part that "Any unexpended balances shall be carried
fonvard to future years for allowable activities or shall be refunded at the discretion of
the local government."

17) The governing bodies of local governments may provide a schedule of reasonable fees, as authorized by s. 125.56(2) or s.
166.222 and this section, for enforcing this pare-These fees, and any fines or investmentearnfngs,related"to th~feesJ shall be
used soleLy for carrying out the local government's responsfbHities in enforcing the Florida Building Code. When provTd'(ng a
scheduLe of reasonable fees, the total estimated annual revenue derived from fees, and the fines and investment earnings
related to the fees, may not exceed the total estimated annual costs of allowable activities. Any unexpended balances shall be
carried forward to future years for allowable activities or shall be refunded at the discretion of the local government. The
basis for a fee structure for allowable activities shall relate to the level of selYice provided by the local government and shall
include consideration for refunding fees due to reduced services based on services provided as prescribed by s. 553.791, but
not provided by the local government. Fees charged shall be consistently applied.
(a) As used in this subsection, the phrase "enforcing the Florida Building Code" includes the direct costs and reasonable
indirect costs associated with review of building plans, building inspections, relnspections, and building permit processing;
building code enforcement; and fire inspections associated with new construction. The phrase may also include training costs
associated with the enforcement of the Florida Building Code and enforcement action pertaining to unlicensed contractor
activity to the extent not funded by other user fees.
(b) The following activities may not be funded with fees adopted for enforcing the Florida Building Code:
1. Planning and zoning or other general government activities.
2. Inspectfons of public buildings for a reduced fee or no fee.
3. Public information requests, community functions, boards, and any program not directly related to enforcement of the
Florida Building Code.
4. Enforcement and impLementation of any other local ordinance, excluding validly adopted local amendments to the Florida
Building Code and excluding any local ordinance directly related to enforcing the Florida Building Code as defined in paragraph
(a).
(c) A local government shall use recognized management, accounting, and oversight practices to ensure that fees, fines, and
investment earnings generated under this subsection are maintained and allocated or used solely for the purposes described in
paragraph (a).

WHEREAS, the Monroe County Board of County Commissioners wish to provide the citizens of the
County with the best possible service in the most cost effective and reasonable manner; and
WHEREAS~ it is in the best interests of the public to charge the true cost for such services, thereby
placing the burden of such costs directly upon those persons deriving the benefit from the services; and
WHEREAS, the Director of Growth Management has demonstrated that the existing fee schedule does
not reflect the true cost of providing the services to the persons requesting the Building Department
services; and
WHEREAS, the Board heard testimony and evidence presented as to the appropriate fee schedule; and
WHEREAS, the Board concurs with the conclusions and findings of the Growth Management Director;

OTHER FEE SCHEDULES INCONSISTENT HEREWITH;
PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Monroe County Board of County Commissioners wishes to
provide the citizens of the County with the best possible service in the most cost effective
and reasonable manner; and
WHEREAS, the Board finds that it would be in the best interests of the general
public to charge the true cost for such services, thereby placing the burden of such costs
directly upon those parties deriving the benefit from such services; and,
WHEREAS, the Growth Management Director has demonstrated that the
existing fee schedule does not reflect the true cost of providing services to the parties
requesting services from the Planning and Environmental Resources Department; and
WHEREAS, the updated fee schedule prepared by the Growth Management
Director for providirig these services includes the estimated direct costs and reasonable
indirect costs associated with the review and processing of planning and development
approval applications and site plans, on-site biological reviews, administrative appeals,
preparation of ofiicial documentation verifying existing development rights and other
processes and services; and
WHEREAS, the Board heard testimony and evidence presented as to the
appropriate fee schedule during a public hearing on October 17,2007; and,
WHEREAS, the Board of County Commissioners concurs with the
recommendations of the Growth Management Director;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY FLORIDA:
Section 1. Pursuant to Section 9.5-21, the following schedule of fees to be charged by
the Growth Management Division for the filing of land development permit,
land development approvals, land development orders, and appeal
appli'1otions, and requests for technical services or ofiicial letters attesting to
development rights recognized by the County shall be implemented:

3. Hearing fees; payment of half the cost of the hearing officer, which is $66
per hour. County is charged $132 per hour by DOAH.
4. Subject to technology fee of $20.
Section 2. Any other fees schedules or provisions of the Monroe County Code
inconsistent herewith are hereby repealed.
Section 3. The Clerk of the Board is hereby directed to forward one (1) certified copy of
this Resolution to the Division of Growth Management.
Section 4. This Resolution is effective November 1, 2007.

A FEE FOR REVIEWING APPLICATIONS FOR EXEMPTIONS
AND WAIVERS TO THE INCLUSIONARY HOUSING
REQUIREMENT IN SECTION 9.5-266 OF THE MONROE
COUNTY CODE, TO PROVIDE A REASONABLE RECOVERY
OF THE COSTS INCURRED TO THE GROWTH MANAGEMENT
DIVISION IN STAFF TIME AND MA TERlALS EXPENDED FOR
PROVIDING SUCH SERVICE TO THE PARTIES RECEIVING
THE BENEFITS OF THE REVIEW, AND THUS, FURTHER
REDUCING THE BURDEN CURRENTLY BEING BORNE BY
THE TAXPAYERS AT LARGE; PROVIDING FOR AN
EFFECTIVE DATE OF APRIL 28. 2007
WHEREAS, the Monroe County Board of Connty Commissioners wishes to

HOUSING CONSTRUCTION PROJECTS RECEIVING COUNTY
FINANCIAL ASSISTANCE; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY CODE
OF ORDINANCES; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the County has a demonstrated and Urgent need for more affordable
housing;
WHEREAS, the average cost of housing in the County is among the highest in
the State of Florida;
WHEREAS, permitting fees add at least $2,000 to the average cost of building a
house; and,
WHEREAS, the Board of County Commissioners of Monroe County recognizes
and is committed to addressing the problem of affordable housing to meet the social and
economic needs of County residents; and,
WHEREAS, Chapter 6, Monroe County Code, does not explicitly authorize the
exemption from Monroe County building application and permitting fees for the
construction of affordable housing projects by for~profit or not-profit organizations that
receive financial support from the County; and,
WHEREAS, the exemption of permitting fees for construction of affordable
housing receiving financial assistance from the County is in the public interest and helps
to make such housing more affordable;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THE FOLLOWING:
Section 1. Section 6-27(d)(2), Monroe County Code is hereby amended to add
subparagraph "d." that reads as follows:

"d. Construction of affordable housing projects, as defined under the Florida
Statutes or chapter 9.5, receiving financial assistance from Monroe

Section 2. Any affordable housing construction project made eligible for a fee
exemption authorized by this ordinance shall be entitled to the fee exemption if the
building permit application for the project was submitted to the Momoe County Building
Department after March 31,2003.
Section 3. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section 5. This ordinance shall take effect immediately upon receipt of the official
notice from the Office of the Secretary of State of the State of Florida that this ordinance
has been filed with said Office. '
Section 6. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition, or amendment
thereto, and shall be appropriately renumbered to conform to the uniform numbering
system of the Code.
Section 7. The Clerk of the Court is hereby directed to fonvard a copy of this Ordinance
to the Municipal Code Corporation for incorporation into the Monroe County Code of
Ordinances.
