ITEM BACKGROUND: The petitioners, Steven B. Klett and the Board of Trustees of the Internal Improvement Trust Fund (HTF), have requested abandonment of Carysfort Circle South in order to complete a wetland restoration project. The project consists of the restoration of 1.5 acres of historic wetland and removal of a portion of Carysfort Circle to reconnect tidal flow to the area. The petitioners would also construct a gate at the entrance of Carysfort Circle South to control access for law enforcement purposes. WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways; and WHEREAS, due notice has been published and a public hearing has been held in accordance with Chapter 336, Florida Statutes; and WHEREAS, at said public hearing the Board considered the argument of all parties present wishing to speak on the matter, and considered the renouncing and disclaiming of any right of the County and the public in and to the hereinafter described streets, alley-ways, roads, or highways as delineated on the hereinafter described map or plat; and WHEREAS,the Board has determined that vacation of the said road is for the general public welfare, and conforms to the requirement of Florida Statute Sections 336.09 and 336.10; and NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that it hereby renounces and disclaims any right of the County and the public in and to the following described streets, alley-ways, roads, or highways as delineated on the hereinafter described map or plat, to-wit: "According to the plat thereof, as recorded in Plat Book 7, at Page 12 of the Public Records of Monroe County, Florida , more particularly described by metes and bounds as follows: portion of the 50 foot wide right-of-way corridor of Carysfort Circle, a public street according to the plat of Madeira Village as recorded in Plat Book 7, Page 12 of the public records of Monroe County, Florida. Klett and the Board of Trustees of the Internal Improvement 21 Trust Fund (IITF), have requested abandonment of Carysfort Circle South in order to complete a 22 wetland restoration project. The petitioners would also 24 construct a gate at the entrance of Carysfort Circle South to control access for law enforcement 25 purposes. 26 27 REVIEW: This petition has been reviewed by County staff and written recommendations of no 28 objection were received from Monroe County Engineering Services, Fire Marshal, Code Enforcement, 29 and the Monroe County Sheriff's Office. Letters of no objection have been received from all affected 30 utilities. Florida Keys Electric Cooperative Association (FKEC) has requested the petitioners provide 31 access and an easement for FKEC existing facilities. The petitioners are in the process of providing 32 access and an easement to FKEC; however, the IITF will not grant such an easement until after the 33 abandonment is approved. 34 35 Letters of objection have been received via e-mail from three property owners in the Madeira Village 36 subdivision on Carysfort Circle North. Steve Klett, one of the applicants, sent an e-mail to the property 37 owners of the three residences on Carysfort Circle North explaining the wetland restoration project the 38 State would like to perform through a grant. The opposition to the requested road abandonment comes 39 from the owner of the residence closest to SR 905 and the owner of the residence furthest east from SR 40 905,who also owns the middle residence. 41 42 The requested abandonment of Carysfort Circle South would begin at its terminus with SR 905 and 43 continue east approximately 960 feet and then curving north for approximately 280 feet, ending at the 44 property line of Lot 7, Block 1. The abandonment of Carysfort Circle South would not affect access to Carysfort South Circle Road Abandonment Petition Reviewed by.... , Pagel of 2 I the three residential properties on Carysfort Circle North as Carysfort Circle North has its own access to 2 SR 905. 3 4 MCC 19-1 states: (a)No dedicated and accepted right-of-way in the county can be abandoned where the 5 right-of-way terminates on a body of open water. 6 (b) In all other cases of abandonment, no right-of-way can be abandoned unless there 7 is an agreement to do so by all affected property owners. For purposes of this 8 subsection, an affected property owner is the owner of property which, if the 9 right-of-way is abandoned, will: 10 (1) Have access which is currently used by that property owner eliminated; or 11 (2) Have the only platted access eliminated; or 12 (3) Have the paved area adjacent to that property increased for turn-around 13 purposes; or 14 (4) Be increased in size. 15 (c) The county commission considers these a restriction on the rights of individuals 16 who desire to abandon properties in accordance with Florida Statutes Section 17 336.09. 18 19 The requested abandonment of Carysfort South Circle does not meet any of the criteria cited above and 20 is therefore suitable for abandonment. 21 22 RECOMMENDATION: Staff recommends approval. 23 24 25 26 27 28 29 30 31 32 33 Carysfort South Circle Road Abandonment Petition Reviewed by....... I'm sorry that you can not support the proposed wetland restoration project. I feel the project will not only enhance wetlands and wildlife in the area but would also 10/30/2009 Page 2 of 3 improve community character. There may be a misconception that bringing wetlands closer to the existing houses will increase the chances of flooding and storm surge from hurricanes and tropical storms. This is not the case since the elevations of all the house foundations in the subdivision are higher than the elevation of site proposed for restoration.This site could only be a barrier to storm surge if it was higher than the house elevations - as in a levee. Besides, your property is already bordered on two sides by wetlands. There may also be concerns that more wetlands would mean more mosquitos. The restored area would be part of a tidal wetland and would provide access to fish that would feed on a ny emerging mosquito larvae. In most cases, similar wetland restorations actually reduce the presence of mosquitos. I also believe the restoration would improve the scenic beauty of the area. At the present time the residents of the subdivision gaze out at a wall of exotic Guinea grass and lead tree. With the restoration,the views would be of an unobstructed tidal wetland utilized by a variety of shorebirds and wading and water birds. There are few areas in the Keys that can claim such a view. The proposed wetland restoration will result in your road(Carysfort Circle North)terminating in a dead-end which should help reduce crime in the area.
