ITEM BACKGROUND:
On 8/15/07 the BOCC approved a planning grant application for the Criminal Justice Mental Health and
Substance Abuse Reinvestment Program to plan, implement or expand initiatives to increase public
safety, avert increased spending on criminal justice and improve accessibility and effectiveness of mental
health and substance abuse treatment services for adults and juveniles in or at risk of entering the
criminal justice system. On 9/19/07, the BOCC approved Resolution No. 314-2007 establishing the
required policy council later known as '"The Monroe County Criminal Justice, Mental Health, and
Substance Abuse Planning Councif'. The Council last met on April 9, 2009 and notified the County on
10/8/09 that the Council may be terminated due to lack of continued funding.

A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA TERMINATING "THE MONROE
COUNTY CRIMINAL JUSTICE, MENTAL HEALTH, AND SUBSTANCE
ABUSE PLANNING COUNCIL" DUE TO LACK OF CONTINUED
FUNDING AND RESCINDING RESOLUTION NO. 314-2007 WHICH
AUTHORIZED ITS ESTABLISHMENT.

WHEREAS, on August 15, 2007, the Board of County Connnissioners approved a
planning grant application for the Criminal Justice Mental Health and Substance Abuse
Reinvestment Program (the "Program") allowing the county to plan, implement or expand
initiatives that will increase public safety, avert increased spending on criminal justice and
improve accessibility and effectiveness of mental health and substance abuse treatment services
for adults and juveniles who are in or at risk of entering the criminal justice or juvenile justice
systems; and
WHEREAS, Session Law 2007-200, which established the Program, required the
establishment of a Mental Health and Substance Abuse Policy Council (the "Council") with a
defined membership; and
WHEREAS, on September 19, 2007, the Board of County Commissioners approved
Resolution No. 314-2007 establishing a Monroe County Mental Health and Substance Abuse
Policy Council, as required and defmed in Session Law 2007-200, known as "The Monroe
County Criminal Justice, A;fental Health, and Substance Abuse Planning Council"; and
WHEREAS, the Council held its last meeting on April 9, 2009; and
WHEREAS, on October 8, 2009 the Council notified the County that the Reinvestment
Grant which funded this Council expired on April 9, 2009 and the Council may now be
terminated due to lack of continued funding; and
WHEREAS, the Council further advised that should additional funding be obtained in
the future, the Council may be re-activated; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
1. The Monroe County Criminal Justice, Mental Health, and Substance Abuse
Planning Council is hereby terminated due to lack of continued funding.
2. Resolution No. 314-2007, which authorized the establishment of The Monroe
County Criminal Justice, Mental Health, and Substance Abuse Planning Council,
is here by rescinded.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY ESTABLISHING A CRIMJNAL JUSTICE
MENTAL REALlH & SUBSTANCE ABUSE POLICY COUNCIL.
WHEREAS, On August 15~ 2007, the Board of County Commissioners approved a planning grant
application for the Criminal Justice Mental Health and Substance Abuse Reinvestment Program (the
"Program") allowing the county to plan, implement or expand initiatives that will increase public safety,
avert increased spending on criminal justice, and improve accessibility and effectiveness of mental health
and substance abuse treatment services for adults and juveniles who are in or at risk of entering the criminal
justice or juvenile justice systems; and
WHEREAS, Session Law 2007-200, which established the Program, requires the establishment
of a Mental Health and Substance Abuse Policy Council (the "Council") with a defined membership;
and
WHEREAS, the Council will make recommendations to, the Board of County Commissioners
regarding the County~s grant submission and planning process; now therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUN'IY, FLORIDA:
Section 1: There is hereby established a Monroe County Mental Health and Substance Abuse
Policy Council (the "Council").
Section 2: The Council shall work with the County budget and detention center offices to make
recommendations to the Board of County Commissioners regarding how the Criminal Justice Mental Health
and Substance Abuse Reinvestment Program may best be implemented within the County.
Section 3: The County Office of Management and Budget and Grant Administration Office will
provide administrative support regarding the application for grants and processing of contracts resulting
from the application process.
Section 4: The Monroe County Detention Center Administrative Offices will administer the grant
funds and provide administrative support to the meetings and functions of the Council.
Section S: There shall be the following members of the Council, with each specified Officer
notifying the County Administrator's Office of a designee should one be appointed to sit in the place of the
specified Officer, where allowed:
A. The State Attorney, or an assistant State Attorney designated by the State Attorney.
B. The Public Defender, or an Assistant Public Defender designated by the Public Defender.
C. A Circuit Judge designated by the Chief Judge of the Circuit.
D. County Court Judge designated by the Chief Judge of the Circuit.
E. Chief Correctional Officer
F. County Sheriff

G. A Police Chief, or person designated by the local police chiefs association
H. Probation Circuit Administrator, or a person designated by the state Probation Circuit
Administrator.

I. The local Court Administrator, or a person designated by the local Court Administrator.

K. Director of any County Probation or Pretrial Intervention Program.
L Department of Juvenile Justice Detention Facility Director.

The following shall be appointed by the Board of County Commissioners:
N. Director of a Mental Health Treatment Program, or a person designated by the Director.
O. Director of a Substance Abuse Treatment Program, or a person designated by the Director
P. A representative of a county-wide Homeless Program.
The following shall be appointed by the state DCF, District Alcohol, Drug Abuse and Mental
Health Supervisor:
Q. A representative of the state Substance Abuse Program Office and Mental Health Program
Office.
R. A Primary Consumer - Mental Health services.
S. A Primary Consumer - Substance Abuse Services.
T. A Family Membe.r.of a Primary Consumer__
Section 6: The members shall serve terms until a successor qualifies, and if requiring specific
appointment or designation, the successor is so appointed or designated.
Section 7: This Resolution shall become effective on the date written below.

meeting of said Board held on the 19th day of September, A.D., 2007.

Resolution No. 314-2007 to create the Criminal Justice Mental Health & Substance
Abuse Policy Council; and approval of the persons named to serve on the council from the

Abra,
We had hoped that there would be some "reorganizing" of funds on the state level that would
result in funds being available again for Criminal Justice, Mental Health and Substance Abuse
Reinvestment Act programs. However the Legislature did not act on this. Therefore, I think the
Committee may be closed. If the Legislature makes funds availble next year for this purpose.
We can request the Board of Commissioners to assign a new committee at that time.

The meeting was called to order at 2: 10 P.M. by Chairman Chief Tommy Taylor.
A motion was made and passed to approve the minutes from the February
meeting and from the March 2009 meeting.
L. Tennyson provided a financial report to the Council. C. Shaw requested
that Council members submit their remaining In-Kind Match forms, so that final
determinations may be completed for the submission of the final report for the
grant.
The Monroe County Criminal Justice, Mental Health and Substance Abuse
Diversion Strategic Plan was reviewed for final approval. Minor additions /
corrections were recommended. A motion was made and passed to approve the
Strategic Plan as amended.
L. Tennyson reported on upcoming funding opportunities which will be
coordinated through the Monroe County Grants Office. Byrne Grant applications /
proposals will be accepted through her office. She will be sending out materials
relating to these in the near future. C. Shaw discussed the grants available through
SAMHSA.
As the Reinvestment Grant is expiring on April 9, 2009. This is the last
Council meeting. C. Shaw indicated that should additional funding be obtained, the
Council may be re-activated at a later date. She thanked the Council members for
their commitment and support of the Project. Chief Taylor, Chairperson, also
thanked the Council Members. The meeting was adjourned at 3: 15pm.

Monetary resources available to help keep mentally ill out of jail
TALLAHASSEE, Fla. (August 8, 2007) - Florida counties will
soon have access to money to help keep their mentally ill
citizens out of jail. The passage of HB 1477 during the 2007
MENTAL legiSlative session created the Criminal Justicet Mental Health
HEAL TN and Substance Abuse Reinvestment Grant Program. The
CORPORATION program allots $3.8 mfUion in grants to assist counties in
redudng the number of individuals with substance abuse
disorders and mental illnesses in local jails and state prisons.
The program requires the Florida Substance Abuse and Mental Health Corporation to establish a
statewide grant review committee to review the applicants. The Florida Substance Abuse and
Mental Health Corporation is charged with making recommendations annually to the Governor
and the Legislature on polictes designed to improve coordination and effectiveness of the state's
publicly funded mental health and substance abuse systems.

187 Section 3. Criminal Justice, Mental Health. and Substance
188 Abuse Reinvestment Grant Program requirements. --
189 (1) The Substance Abuse and Mental Health Corporation
190 Statewide Grant Reyiew Committee. in collaboration with the
191 Department of Children and Family Services. the Department of
192 Corrections, the Department of Juvenile Justice, the Department
193 of Elderly Affairs, and the Office of the State Courts
194 Administrator, shall establish criteria to be used by the
195 corporation to review submitted applications and to select the
196 county that will be awarded a l-year planning grant or a 3-year

199 the county meets the establiahed criteria.
200 ~ Ca) The a~plicatian criteria for a i-year planning grant
201 must include a requirement that the applicant. county or counties
:202 have a strategic plan to initiate sV'stemic change to identify
203 and treat individuals who have a mental illness, substance abuse
204 disorder, or co-occurring mental health and substance abuse
205 disorders who are in, or at risk of entering, the criminal or
206 juvenile justice systems. The I-year plannin~ STant must be used
,
207 to develop effective collaboration efforts among partici~ants in
208 affected governmen~al agencies, including the criminal,
209 juvenile, and civil justice systema, mental health and substance
210 abuse treatment service providers, transpo:rtation programs, and
211 housing assistance programs. The coll~ration efforts shall be
212 the basis for developing a ~roblem-solving model and strategic
213 plan for treating adults and juveniles who are in. or at risk of
214 entering> the criminal or juvenile justice system and doing 60
215 at the earliest point of contact, taking into consideration
216 public safety. The planning grant shall include strat~ies to
217 divert individuals from jUdicial cOII1nitment to C01llllUJlity-hased
218 ~ervice programs offered by the Department of Children and
219 Famil~ Services in accordance with BS. 91.6.13 and 916.17,
220 Florida Statutea.
221 (b) The application criteria for a 3-year i~lementation
222 or expansion grant shall require information from a county that
223 demonstrates its completion of a well-established collaboration
224 plan that includes public-private partnership models and the
