ITEM BACKGROUND: Sealed bids were opened on October 14, 2009 in the Purchasing Office;
Oshkosh Corporation was the only respondent (tabulation sheet is attached), base bid: $232,701.00.
Monroe County's specification required bidders to provide separate unit prices for additional
equipment with the County reserving the right to purchase any, all or none of the additional equipment
and to increase or decrease quantities as it so chooses; it is staffs recommendation to purchase all of
the additional equipment in the amount of $85,046.01 for a total contract price of $317,747.01.
PREVIOUS RELEVANT BOCC ACTION: Approval on May 20, 2009 of Joint Participation
Agreement QPA) with the Florida Department of Transportation to fund the purchase of aircraft rescue
fire fighting equipment for Florida Keys Marathon Airport. JPA provides 50% funding for the
equipment with a total project cost of $354,000.00. Florida Keys Marathon Airport Enterprise Fund
will be the source of the local match.

That the Contractor, for the consideration hereinafter fully set out hereby agrees with the
OWNER as follows:
WHEREAS, the parties hereto, for the consideration hereinafter set forth, mutually agree as
follows:
I. That the Contractor, shall furnish all materials, and perform all of the work in the manner
and form as provided by the following enumerated Instruction to Bidders, Form of Bid
Proposal, General Provisions, Special provisions, Technical Specifications, Form of
Contract, Drawings and Addenda, which are attached hereto and made a part hereof, as
fully contained herein, for the construction of:
Quick Response Vehicle
Aircraft Rescue Fire Fighting Vehicle
on Ford F550 Crew Cab
300 Gallon Pump Module Quad -Agent
2. That the Contractor shall commence the work to be performed under this agreement on a
date to be specified in a written order of the OWNER and shall fully complete all work
hereunder and deliver the completed vehicle within one -hundred twenty (120) calendar
days from the Notice -to -Proceed.
3. The OWNER hereby agrees to pay to the Contractor for the faithful performance of the
agreement, subject to additions and deductions as provided in the specification or
proposal in lawful money of the United States as follows:
Approximately Three Hundred Seventeen Thousand Seven Hundred Forty Seven and
01 1100 Dollars ($ 317,747.01) in accordance with lump sum and unit prices set forth in
the proposal.
4. All specifications have been read and carefully considered by the Contractor, who
understands the same and agrees to their sufficiency for the work to be done. Under no
circumstances, conditions, or situations shall this Contract he more strongly construed
against the OWNER than against the Contractor. Any ambiguity or uncertainty in the
specifications shall be interpreted and construed by the OWNER, and his decision shall
be final and binding upon all parties.
5. This Agreement may be executed in any number of counterparts, each of which shall be
regarded as an original, all of which taken together shall constitute one and the same
instrument and any of the parties hereto may execute this Agreement by signing any such
counterpart.
IN WITNESS WHEREOF the parties hereto have executed this Agreement on the day and date
first written above in four (4) counterparts. each of which shall, without proof or accounting for
the other counterparts, be deemed an original contract.
