Approval for County to move to intervene in TAMPOA v. City of Key West, CA K 06-55.
ITEM BACKGROUND:
The City of Key West is currently in litigation with the Truman Annex Master Property Owners
Association (TAMPOA) over ownership of and access to use a portion of Southard Street in Key West.
Specifically, TAMPOA is seeking to prohibit the use of Southard Street for ingress to the City owned
property on the other side of Truman Annex. The County has an interest in the outcome of the
litigation since Southard Street is the only avenue for accessing overflow parking areas for the Jackson
Square Courthouse Complex. The overflow lots are located on the City property on the other side of
Truman Annex. Continued access to those parking areas is vital to the County since many employees of
the BOCC and various Constitutional Officers utilize those lots every day. Long term access to those
parking areas will only become more critical once the renovations to the Jackson Square complex are
completed. At that point, the Public Defender's office and other entities, for which the County
currently rents office space, are slated to move into the Jackson Square complex.
If intervention is authorized by the BOCC and granted by the Court, in house legal staff would represent
the County thereby minimizing any costs involved. Apart from staff time, costs could be incurred for
transcripts, subpoenas, and other similar expenses associated with litigation.
