ITEM BACKGROUND: This property is the subject of two code compliance cases, CE08070095 and CE20010034. The violations cited for case CE08070095 were(a) failure to abide by unsafe buildings code which provides that all unsafe buildings are to be abated by repair and rehabilitation or by demolition and(b) failure to obtain required permit for placement of fill(both compliant). The violations for case CE20010034 are failure to obtain required building permits for: rolling chain link gate, Outdoor hose spigot on front wall, LED Street lights, Outdoor shade structure by boat ramp, Asphalt pavement throughout property, Outdoor lights poles on dock, Boat davits on dock with electric, 2 story porch addition to house with electric, 2 story observation deck with electric/plumbing, Large shed on concrete pad with electric/plumbing, Small shed near RV area with electric, Water/electric RV pedestals, Paver brick walkways/RV pads/Fire ring and large carport next to house; and failure to obtain a permit for landclearing (all components remain non-compliant). As of June 5, 2023, the fines total $35,300.00 for case CE08070095 and will not continue to accrue as this case has come into compliance and fines for case CE20010034 total $146,800.00 and will continue to accrue at $200.00 per day, until compliance is achieved. CE08070095: A hearing was scheduled for September 25, 2008 and counsel was present on behalf of the property owners. The Special Magistrate found the property in violation of a) 64(b) failure to obtain a permit and inspections for a wooden structure and davit pads deeming them unsafe and b) 9.5- 111(1) constructing of shade structure and ordered a compliance date of November 26, 2008. Ruling on a component of violation b) 9.5-111(1) failure to obtain required building permit for the placement of fill was reserved. A subsequent hearing was held on February 26, 2009 and the Special Magistrate found the property in violation of(b) failure to obtain required building permit and ordered a compliance date of March 26, 2009. On or about March 25, 2009, counsel for the property owners 4590 requested an extension and the case was continued to May 28, 2009. On May 26, 2009 a report by a geologist was provided for review and the Special Magistrate gave the County until August 20, 2009 in which to review the report and present any argument thereon. A hearing was held on August 27, 2009 and the Special Magistrate instructed the parties to review the geologists' report and address it in writing by November 4, 2009. The County's lien was recorded on November 1, 2010. This case was not re-visited until a hearing which was scheduled for April 28, 2011 but was ultimately continued, at the request of counsel for property owners, to July 28, 2011. At the July 28, 2011 hearing, the Special Magistrate entered an Order Imposing Fine for violation(b)Permit(s), approval(s) and inspection(s) are required for the placement of fill. The violations were initially deemed compliant on March 1, 2012. The property later failed a follow-up biological inspection, which occurred on January 18, 2017. On July 31, 2017, the property was sold and a hearing for the County's motion for new final order and imposition of lien, motion to authorize foreclosure and/or money judgment proceedings was scheduled for September 28, 2017. Due to Hurricane Irma, it was rescheduled to February 22, 2018. The hearing was held and the new property owner was present. The Special Magistrate found the property was still in violation and granted the County's motion. The County's subsequent lien was recorded on February 26, 2018. The code case is in compliance but remains open for failure to pay outstanding fines and costs. CE20010034 —A hearing was scheduled for September 24, 2020 and the property owner requested to enter into a stipulated agreement. The property owner signed a Stipulation to Code Violation and for time to comply for first time offenses on September 10, 2020. On September 24, 2020, the Special Magistrate approved the stipulated agreement with a compliance date of January 29, 2021. The County's lien was recorded on October 20, 2021. A subsequent hearing was held on July 28, 2022 and the property owner was not present. The Special Magistrate found the property remained in violation and granted the County's motion to proceed with collections. The code case remains open for non- compliance and failure to pay outstanding fines and costs. The Monroe County Property Appraiser lists the Just Market Value at $2,645,234.00. The property is not homesteaded and there are no pending foreclosures actions at this time. There is no mortgage recorded on the property. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and/or writ of execution; 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Release the lien. Special Magistrate (SM) enters a Final. Order imposing a compliance date, fines and/or casts after a finding of violation of Monroe County Code(s) by property owner(violator) or r approving a Stipulated Agreement with an agreed upon compliance date and fine amounts. The Final Order of SM providing the compliance date, and imposing fines and/or costs is provided to the property owner as soon as practicable. Referrals, if not made previously, are made to other agencies in appropriate circumstances. 1 2. The final Order of the SM is recorded by Code Compliance (CC) as a lien by Code Compliance within 14 days after the compliance date for those cases that have not achieved , compliance. 3. The Final Order of the SM is recorded as a lien by CC within 45 days after the compliance date for those cases that have achieved compliance by the compliance date but have outstanding t costs in excess of$200. 1 i 4. If compliance is not achieved within 75 days of the recording of the lien, then a re-inspection of the property is completed by the Code Inspector assigned to the case. If the property is still not in compliance then a demand letter including the current amount of fines and/or costs is sent to the property owner, 5. If compliance is not achieved within 90 days of'the recording of the lien and/or the lien is not satisfied, then. CC will research the subject property to determine: i. if the subject property is homesteaded; ii. if the subject property is the only property owned by property owner/violator; iii. what efforts, if"any, the property owner has made to achieve compliance; iv. the amount of the lien accrued to date; and v. any other relevant factors, including but not limited to researching the status of the property owner, i.e. any Lis Pendens filed against the property or property owner, any pending or closed foreclosure actions, any open, pending or discharged Bankruptcy petitions. 6. CC staff shall provide a written memo or email to the County Attorney's Office (CAY)with i the results of the research outlined and requested further action, 7. The CAY will review the information provided by CC staff. 8. The CAY will move the SM per F.S. 162.09 for an Order authorizing foreclosure or a money judgment action; and, March 19, 2014 Code Lien Procedure 4595 i. The Code Compliance Liaison (Liaison) will schedule the motion for the next available SM hearing for a Motion for approval to proceed with a foreclosure and/or money judgment action; ii. The Liaison will mail a Notice of Hearing and Notice of Motion prepared by the Liaison and signed by the CAY to the property owner by certified mail noticing the owner of the date, time, place and the substance (collection action, foreclosure and/or money judgment and/or writ of attachment) of the motion; iii. The Liaison will email/calendar a re-inspection request to the assigned Inspector to conduct inspection prior to the next available SM hearing; iv. The Motion hearing is heard by SM on the specified date; v. If SM finds foreclosure or money judgment is appropriate, the Liaison will notice the property owner of the SM's ruling and email/calendar a re-inspection request to the assigned Inspector to conduct an inspection within 30 days of the SM ruling; vi. CAY will seek permission from the Board of County Commissioners to file for foreclosure or money judgment in court; vii. The assigned Code Inspector will continue to monitor the property for compliance through re-inspections every 90 days and attempts to notify the owner by a quick email letter, telephone call or demand letter every 90 days to inform them that the property is not in compliance and fines are running. The assigned Code Inspector will. provide written updates to the CAY every 90 days. 9. Subsequent to the SM's ruling on the Motion, the CAY will place an item on the Commission's agenda seeking the Board's direction and authorization on further enforcement and collection efforts. Potential options for litigation include seeking injunctive relief, a money judgment for the unpaid fines, foreclosure, or other relief. Potential non-litigation options include referral to another agency, allowing liens to accrue, or other relief. 10. If the recommended legal action is referral to another agency, release of lien, or allowing liens to accrue, CAY will send a written memo or email to the Director of Code Compliance outlining recommendation. 11. Once authority is granted by SM and/or Board of County Commissioners, CC will order a title search on non-homesteaded properties, and the assigned Code Inspector will conduct a re- inspection after receipt of the title search. Litigation will commence after the title search is completed and a current re-inspection is completed. The assigned Code Inspector will continue to monitor the property for compliance through re-inspections every 90 days and attempts to contact the property owner by a quick email letter, telephone call or demand letter every 90 days that the property is not in compliance and fines are running. The assigned Inspector will provide written updates to the CAY every 90 days. 12. If the Board decides not to authorize injunction or enforcement litigation, a decision from the Board could include direction to: i. Allow lien to remain filed and accrue interest until sale or refinancing; or ii. Release the lien; or iii. Request CC staff to provide a progress report on compliance efforts annually at the March BOCC meeting. Exception—If a violation poses a serious threat to the public health, safety & welfare then immediate permission to file an action for an inspection warrant, injunction and/or demolition may be sought with BOCC direction. CD Thereafter, Respondents obtained a geologist's report whose gist was the opinion that the fill on Respondents' property had been placed there by natural processes rather than by Respondents. Respondents presented this report to the Special Magistrate at a hearing on May 26, 2009, and he agreed to review it. After reviewing the report and conducting another hearing on August 27, 2009, the Special Magistrate entered an order dated September 3, 2009, in which, among other things, he declined to reconsider the Final Order of March 11, 2009, which Respondents had not appealed, and deferred the imposition of a fine "for some reasonable period of time . . . to in effect allow Respondents to recover the costs of the Report, or some part thereof." The Special Magistrate further gave the parties until November 4, 2009, to file written arguments concerning whether the geologist's report might be useful in determining the extent to which fill should be removed from Respondents' property. The magistrate stated in the order that he would consider any written argument timely filed by the parties and then enter another order "Informing the parties as to how the matter should proceed." Neither party filed a written argument pursuant to the order dated September 3, 2009. Consequently, the Special Magistrate never entered another order informing the parties how to proceed. WANLESS Among other charges, Respondents have been charged in this case with a violation of Section 9.5-11 I(l) of the Monroe County Code (hereinafter referred to as the "Code"), due to the "placement of fill" by Respondents on their property (hereafter referred to as the "Property"). The issue of whether fill had been placed on the Property was first raised before the undersigned on September 25, 2008. After hearing argument of the issue, a ruling on whether Respondents had violated Section 9.5-111(1) of the Code by placing fill on the Property was reserved to give both parties an opportunity to present additional proof on this issue. On February 26,2009, after granting several continuances, the matter came before the undersigned for review. During that hearing, despite having been given five months to gather evidence on the issue, Respondents presented argument through counsel, but no competent substantial evidence concerning the issue of the fill. Counsel continued to argue that the alleged "fill" was "probably" a natural occurrence, but offered nothing but his own assumptions about the issue. Those assumptions were often contrary to the evidence presented by Monroe County and, at time, inconsistent with other representations of counsel. For 4623 ao v example, counsel suggested that Respondents denied placing any fill on the property while N U A F+ 0000 Monroe County, through its code inspector, testified that Mr. Perez admitted he had placed fill rn -e w on the property. u N A Based upon the evidence presented by Monroe County, including photographs of the o property and Mr. Perez's admission against interest, and given the lack of any competent substantial evidence from Respondents, a finding was made on February 26, 2009, that Respondents had violated Section 9.5-111(1), by placing fill on the Property. A Final Order memorializing this decision was entered on March 11, 2009. No appeal was taken of the Final Order by Respondents. When the ruling was announced on February 26, 2009, counsel for Respondents suggested that a geologist report proving that the "fill" was a natural occurrence could be prepared and submitted. The undersigned told counsel that if such a report was submitted proving that the fill was the result of natural conditions and the actions of Respondents, that no penalties would be imposed on Respondents for that violation. The undersigned also stated that he would admit he had made an error and would "make amends." No representation was made, however, that the finding of violation would be reviewed and rescinded. Nor did the undersigned fully consider the implications of considering evidence after making a finding that a violation had been committed. The matter next came before the undersigned for review on May 26, 2009. Five months after the matter had first been heard and three months after finding that Respondents had violated the Code by placing fill on the Property, a Report on Sands on and Adjacent to the Property at 83 Coral Drive Key Largo, Florida (hereinafter referred to as the "Report"), prepared by Dr. Harold R. Wanless, a registered Florida professional geologist was provided by Respondents. The undersigned gave Monroe County until August 20, 2009, to review the 2 4624 Report and present any argument thereon. The undersigned also stated that he would look at U N OD OD .A a+ the report and suggested the possibility of looking at the original finding of violation. o� Consistent with the representation made by the undersigned on February 26, 2009, no fines N la were imposed for the fill violation. o Finally, the matter came before the undersigned at the August 27, 2009, code enforcement hearing. At that time, the parties were informed that the record of this matter would be reviewed by the undersigned, which has been done, and a determination would be made as to how to proceed. After fully considering the matter, it is concluded that no reconsideration of the Final Order finding that Respondents had placed fill on the Property in violation of the Code is appropriate. First, it is concluded that the circumstances of this case do not warrant reconsideration of the Final Order, even assuming that a special magistrate has such authority. See City of Palm Bay v. Palm Bay Greens LLC, 969 So. 2d 1187, 1190 (Fla. 5th DCA 2007)(code enforcement board's final order not subject, under statute, rule or code provision, to motion for rehearing). Respondents were given ample time to provide evidence to counter that presented by Monroe County and did not do so until long after the case first arose, a decision on the issue was made, and the time to appeal that decision had passed. Secondly, it is concluded that nothing in the representations made by the undersigned to Respondents warrants reconsideration of the Final Order on this issue. The first representation to Respondents was that the undersigned would not impose fines on Respondents if they presented a report proving that no fill was placed on the property. Nothing in that representation can reasonably be found to have caused Respondents to forego their right to appeal the Final Order on the issue. 3 4625 wo Xo st n As to the suggestion made by the undersigned at the May 26, 2009, hearing that he c co� CD would go back and look at the finding of violation if a report was filed, it is concluded that the v co 11� r statement was ill advised, at best. It is also concluded that the statement, taken in its most favorable light to Respondents, did not cause them prejudice. Again the time to appeal the February 26, 2009, decision finding Respondents to have placed fill on the Property. Finally, there is the Report itself. Having reviewed it again, it appears that the finding that fill was placed on the Property and the Report are not necessarily inconsistent, especially in light of the admission of Julio Perez to Code Inspector White that he indeed placed some fill on the Property and some of the photographs admitted in this case. While the Report appears to substantiate a naturally occurring process is, at least in part, responsible for material being added to the Property, given Mr. Perez's admission, it is also appears that, at least in part, "fill" is responsible for some of the material being added to the Property. To the extent that this conclusion is correct, the Report would only support a finding that "experts" should determine the extent to which fill has been placed on the Property (which should be removed) and the extent to which material was naturally placed on the Property (which need not be removed). It appears that, while no reconsideration of the Final Order entered on the fill issue is appropriate, the Report may be useful in determining the extent to which material must be removed, in any, to bring the Property into compliance. This use of the Report would allow a fair and equitable resolution of the problem without disturbing the finality of the decision on this issue made on February 26, 2009. One final issue needs to be addressed. While representations made by the undersigned should not have been relied upon to forgo an appeal of the fill issue Final Order, the representation made to Respondents during the February 26, 2009, hearing that no fines would be imposed if a report was filed, can be viewed as having caused Respondents to incur the 4 4626 expense of preparing the Report. That prejudice can and will be eliminated by adhering to the representation concerning the imposition of fines, despite the fact that it was ill advised because the imposition of fines may be the only way to force Respondents to bring the Property into compliance. Therefore, for some reasonable period of time, no fine will be imposed on Respondents on the fill issue to in effect allow Respondents.to recover the costs of the Report, or some part thereof. Respondents must understand, however, that it may become necessary in the future to impose fines for the fill violation, especially in light of the fact that no fines have been imposed for this issue since February 26, 2009, and the fact that the Report may be of benefit to Respondents in determining the appropriate steps to take in correcting the fill violation. SITE DATA: These are lots with an older residence on them. I believe I went to this lot in the past (when a different owner had it) for rip rap on the shoreline. At my visit today I noticed a line of rip rap boulders (new, no algae on them) and some pieces of cut piles (trash & debris/construction debris) had ad been placed about 20 feet waterward of where I estimate the mean.high water line is on the lot. There also ,appeared to be a great deal more sand on the beach than when I was there before. An application, # 00-3-3973 for "puffing sand in beach" (ATF) was received 9/6/2000. VIOLATION: Violations exist of the following: 8-30 trash & debris (the cut pieces of pile) 9.5-111 permit needed for rip rap and fill (sand is fill in a wetlands) 9.5-345 (m) mangroves and submerged lands environmental design criteria (3) "no fill shall be permitted in any natural waterbody." RECOMMENDATION: Issue NOV. An ATF permit is not possible; the materials (rip rap, pile pieces and sand) must be removed. The rip rao MIGHT be permitable, but only if it is placed at or above the mean high water line and BOTH the US Army Corps of Engineers and State of Florida Dept. of Environmental Resources give permission to the owner. (Monroe County cannot permit docks or rip rap without these other two agencies permits first.) A I must be called to reinspect the property once the rip rap, piles and sand are removed, I can be reached most afternoons at (305) 852-7100. Please enclose a copy of this memo with you NOV.
