AGENDA ITEM WORDING: Public Hearing to consider approval of a resolution adopting the Final
Duck Key Security District Non-Ad valorem special assessment rates for fiscal year 2023-2024 and
approval of Non-Ad Valorem Assessment Roll Certificate to be provided to Tax Collector by
September 15, 2023.
ITEM BACKGROUND:
The Resolution adopting the Final Duck Key Security District Non-Ad Valorem Special Assessment
Rates for Fiscal Year 2023-2024 keeps rates at the current rates of$292 per improved lot and $28 per
unimproved lot. The Duck Key Security District Advisory Board(DKSDAB) at its May 2, 2023
meeting voted to recommend for the special assessments to not be increased and to remain at $28 for
unimproved lots and from $292 for improved lots. The Board at its May 17, 2023 meeting passed
Resolution No. 182-2023 adopting the Tentative Rates.
Also attached for approval is the Certificate of Non-Ad Valorem Assessment Rolls, which is to be
provided to the Tax Collector by September 15, 2023.
The Duck Key Security District was established in 1992. The ordinance (ordinance 005-1992)
establishing the Duck Key Security District allows a ten percent (10%) increase over the previous year
or increases to no more than $300.00 per improved lot or $30 per unimproved lot without the need for a
referendum. The initial special assessment was set at $200.00 per improved lot and $20.00 per
unimproved lot and was increased by 10% for the first time for FY 17, raising the assessment to
$220.00 per improved lot and $22 per unimproved lot. The rates were again increased by 10% (it is
slightly less for round number purposes) for FY 18, raising the assessment to $242 per improved lot and
$24 per unimproved lot. The special assessment for FY 19 was increased and approved at $266 per
improved lot and $26 per unimproved lot. The special assessment for FY 20 was increased and

approved at $292 per improved lot and $28 per unimproved lot. The special assessment for FY 21
remained the same at $292 and $28. The special assessment for FY 22 remained the same at $292 and
$28. The special assessment for FY 23 remained the same at $292 and $28. The special assessment
rates may only be increased up to $300 for improved lots and $30 for unimproved lots in accordance
with the Ordinance.
The final special assessment rate for FY 24, as recommended by the advisory board, is $292 per
improved lot and $28 per unimproved lot.
PREVIOUS RELEVANT BOCC ACTION:
The BOCC established the Duck Key Security District in 1992 and adopted Ordinance No. 005-1992.
The BOCC enacted Ordinance No. 012-1994 June 16th, 1994.
The BOCC enacted Ordinance No. 001-2009 January 28, 2009.
The BOCC enacted Ordinance No. 016-2014 September 17, 2014.
The Board approved Resolution No. 119-2016 adopting the tentative rate of$220 per improved lot and
$22 per unimproved lot for FY 2016-2017 on May 24th, 2016 and Resolution No. 168-2016 adopting
the final rate at a Public Hearing held at its September 12th, 2016 meeting.
The Board approved Resolution No.122-2017 adopting the tentative rate of$242 per improved lot and
$24 per unimproved lot for FY 2017-2018 on May 1 Oth, 2017 and Resolution No. 228-2017 adopting
the final rate at a Public Hearing held at its September 27, 2017 meeting.
The Board approved Resolution No. 135-2018 adopting the tentative rate of$266 per improved lot and
$26 per unimproved lot for FY 2018-2019 on May 16, 2018 and Resolution No. 266-2018 adopting the
final rate at a Public Hearing held at its September 4, 2018 meeting
The Board approved Resolution No. 125-2019 adopting the tentative rate of$292 per improved lot and
$28 per unimproved lot for FY 2019-2020 on May 22, 2019 and Resolution No. 232-2019 adopting the
final rate at a Public Hearing held at its September 5, 2019 meeting.
The Board approved Resolution No. 109-2020 adopting the tentative rate of$292 per improved lot and
$28 per unimproved lot for FY 2020-2021 on May 20, 2020 and Resolution No. 231 -2020 adopting the
final rate at a Public Hearing held at its September 3, 2020 meeting.

The Board approved Resolution No. 170-2021 adopting the tentative rate of$292 per improved lot and
$28 per unimproved lot for FY 2021-2022 on May 19, 2021, and Resolution No. 268-2021 adopting the
final rate at a Public Hearing held at its August 18th, 2021, meeting.
The Board approved Resolution No.139-2022 adopting the tentative rates of$292,per improved lot and
$28 per unimproved lot for FY 2022-2022 on May 18, 2022 and Resolution No. 238-2022 adopting the
final rate at a Public Hearing held at its August 17, 2022 meeting.
The Board approved Resolution 182-2023 adopting the tentative rates of$292,per improved lot and
$28 per unimproved lot for FY 2023-2024 on May 17, 2023.

FINANCIAL IMPACT:
The annual Duck Key security assessment is based on the number of improved or unimproved lots contained within the
Duck Key Security District. The total annual assessment revenue to be collected within Duck Key for the upcoming fiscal
year is estimated to be$124,656.00.
The annual assessment rates for the fiscal year beginning October 1,2023 (remain the same as the current year) at$292.00
per improved lot and$28.00 per unimproved lot.

1. The Board hereby adopts the following final non-ad valorem special assessment rates for the
Duck Key Security District for fiscal year 2023/2024:
$292.00 per improved lot;
$28.00 per unimproved lot.
2. The Board hereby directs the Monroe County Clerk to transmit this executed Resolution to
the Monroe County Property Appraiser and Monroe County Tax Collector.

properly assessed so far as I have been able to ascertain; and that all required

COLLECTION OF DUCK KEY SECURITY SERVICES SPECIAL ASSESSMENTS
Notice is hereby given that the County Commission, Monroe County, Florida will conduct a public hearing to
consider reimposing security services assessments for the Fiscal Year beginning October 1, 2023, against certain
improved and unimproved properties located within Duck Key, to fund the cost of security services provided to such
properties and to authorize collection of such assessments on the tax bill.
The public hearing will be held at 9:00 A.M., on July 19, 2023, at the Marathon Government Center, 2798 Overseas
Highway, Marathon, Florida 33050. The public can also attend the Public Hearing via Communication Media

All affected property owners have a right to appear at the hearing and to file written objections with the County
Commission within 20 calendar days of the publication date of this notice. Pursuant to section 286.0105, Florida
Statutes, notice is given that if a person decides to appeal any decision made by the County Commission with
respect to any matter considered at this hearing, such person will need a record of the proceedings and may need
to ensure that a verbatim record is made, including the testimony and evidence upon which the appeal is to be
made. In accordance with the Americans with Disabilities Act, persons needing a special accommodation or an
interpreter to participate in this proceeding should contact the County Administrator's Office, between 8:00 A.M.
and 5:30 p.m., at (305) 292-4441, at least 48 hours prior to the date of the hearing. If hearing impaired, dial 711"

The annual Duck Key security assessment is based on the number of improved or unimproved lots contained within
the Duck Key Security District. The total annual assessment revenue to be collected within Duck Key for the
upcoming fiscal year is estimated to be $124,656.00 The annual assessment rates for the fiscal year beginning
October 1, 2023 (remain the same as the current year)at$292.00 per improved lot and $28.00 per unimproved lot.
Copies of the legal documentation for the assessment program will be made available upon request, by contacting
the County Attorney's office at (305)292-3470, Monday through Friday, between 8:30 a.m. and 5:00 p.m.

The assessments will be collected on the ad valorem tax bill to be mailed in November, 2023, as authorized by
section 197.3632, Florida Statutes. Failure to pay the assessments will cause a tax certificate to be issued against
the property which may result in a loss of title.
The proposed Final Assessment Resolution may be inspected by the public at the Monroe County website by
viewing the agenda packet for the July 19, 2023, Monroe County Commission meeting, which will be posted as of
