Construction Staging Area At Property Located At 77 Sirius Lane, Geiger Key(Real Estate#
00146530-000000), Related To A Canal Restoration Project(Canal#475).
ITEM BACKGROUND:
The applicant has requested a special permit to utilize the subject property 77 Sirius Lane for a
temporary construction staging area. The staging area would facilitate a canal restoration project being
carried out by Monroe County.
This project is part of the Water Quality Improvement Program being funded by Monroe County for
Canal Restoration Demonstrations. The Scope of Work for Canal#475 located along Vega Lane in
Geiger Key consists of installation of a two (2) submerged 24" X 38" reinforced Class IV elliptical
culverts to hydraulically counect Canals #475 and#470. The lack of flushing within the canal system
has caused a degradation of the water quality below FDEP dissolved oxygen standards. The culverts
will increase the turnover rate for the waterbodies that has shown to be successful at achieving the
FDEP water quality standards for dissolved oxygen.
The BOCC has the authority to approve temporary construction staging areas in accordance with MCC
§6-3. A special permit may be granted by resolution by the BOCC to allow a property to be used as a
construction staging area for an off-site project. The BOCC shall hold a public hearing on the request
for a temporary construction staging area and shall issue a resolution granting, granting with conditions
or denying the request. The resolution shall take effect on the date of enactment by the BOCC.
Applicability. A temporary construction staging area for an off-site project is a permitted activity in any
land use (zoning) district,provided it is approved by a special permit and meets the criteria set forth in
MCC §6-3. This special permit shall approve the temporary construction staging area location and use
and shall not override or substitute for any other provision of the Florida Building Code and Monroe
County Code that require an additional type of building permit, certification or approval.

Criteria. Approval of such a special permit shall be granted only if the following criteria are met:
(1) The temporary construction staging area shall serve a project being carried out in the vicinity of the
construction staging area:In compliance.
The proposed staging area is adjacent to the canal(Canal#475) and serves the canal restoration project.
(2) The temporary construction staging area shall serve a project being carried out by a governmental
agency: In compliance.
The canal restoration project is being carried out by Monroe County, Florida.
(3) The temporary construction staging area shall not be located in a tier I designated area: In
compliance.
The proposed staging area is located on a property that is in a tier III designated area.
(4) The property subject to the request shall be posted and surrounding property owners within 300 feet
shall be notified in writing at least 15 days prior to the BOCC public hearing, with the notice located so
it shall be easily visible from all public streets and public ways abutting the property: Compliance to be
determined prior to public hearing.
Planning & Environmental Resources Department staff shall carry out the notification as required.
(5)Prior to establishment of the temporary construction staging area, a special building permit
approving any associated temporary structure shall be issued in accordance with MCC §6-112: In
compliance.
The proposed staging area will not have any structure requiring a building permit other than temporary
structures permitted in accordance with §6-112 (fencing).
(6) No clearing or filling shall occur to accommodate the temporary construction staging area: In
Compliance.
The proposed staging area would be located on a vacant lot that is developed. No native vegetation is
proposed for clearing.
(7) Other than fencing, no temporary structure associated with a temporary construction staging area
shall be located in any required setback: In compliance.
According to the plans submitted with the application, other than fencing, no structure or storage will be
located in a required setback.
(8) The temporary construction staging area shall be compatible with existing uses on surrounding
properties, as determined by the BOCC. If necessary,prior to issuance of a special permit allowing the
temporary construction staging area, the board may attach conditions to any special permit approval to
1. avoid substantial harm to public health or safety;
2. avoid substantial harm to, or impairment of the normal use of, a public place; and/or
3. avoid substantial harm to the environment.
Depending on the nature and anticipated duration of the use, as a condition of approval to the special

permit, the board reserves the right to:
1. Provide a deadline for termination of the construction staging area;
2. Limit the hours of operation;
3. Limit the type of equipment and materials on the site;
4. Require fencing, landscaping and/or other screening to limit potential visual and noise impacts of
the use on adjacent property owners; and
5. Require surface water management improvements to the affected site:In compliance.
(9) The property shall be restored to its prior condition: Compliance to be determined upon termination
of the staging area.
The BOCC reserves the right to attach such conditions to any special permit approval at the July 19,
2023 public hearing.

35 with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a
36 property to be used as a construction staging area for an off-site project. The BOCC shall hold
37 a public hearing on the request for a temporary construction staging area and shall issue a
38 resolution granting, granting with conditions or denying the request. The resolution shall take
39 effect on the date of enactment by the BOCC.

41 Applicability. A temporary construction staging area for an off-site project is a permitted
42 activity in any land use (zoning) district,provided it is approved by a special permit and meets
43 the criteria set forth in MCC §6-3. This special permit shall approve the temporary construction
44 staging area location and use and shall not override or substitute for any other provision of the
45 Florida Building Code and Monroe County Code that require an additional type of building
46 permit, certification or approval.

I Criteria. Approval of such a special permit shall be granted only if the following criteria are

4 (1) The temporary construction staging area shall serve a project being carried out in the
5 vicinity of the construction staging area: In compliance.
6
7 The proposed staging area is adjacent to the canal (Canal 4 475) and serves the canal
8 restoration project.
9
10 (2) The temporary construction staging area shall serve a project being carried out by a
11 governmental agency: In compliance.
12
13 The canal restoration project is being carried out by Monroe County, Florida.
14
15 (3) The temporary construction staging area shall not be located in a tier I designated area: In
16 compliance.
17
18 The proposed staging area is located on a property that is in a Tier III designated area.
19
20 (4)The property subject to the request shall be posted and surrounding property owners within
21 300 feet shall be notified in writing at least 15 days prior to the BOCC public hearing,with
22 the notice located so it shall be easily visible from all public streets and public ways
23 abutting the property: Compliance to be determined prior to public hearing.
24
25 Planning & Environmental Resources Department staff shall carry out the notification as
26 required.
27
28 (5)Prior to establishment of the temporary construction staging area, a special building permit
29 approving any associated temporary structure shall be issued in accordance with MCC §6-
30 112: In compliance.

32 The proposed staging area will not have any structure requiring a building permit other
33 than temporary structures permitted in accordance with §6-112 (fencing).
34
35 (6) No clearing or filling shall occur to accommodate the temporary construction staging area:
36 In Compliance.

38 The proposed staging area would be located on a vacant lot that is scarified. No native
39 vegetation is proposed for clearing (removal).

41 (7) Other than fencing, no temporary structure associated with a temporary construction
42 staging area shall be located in any required setback: In compliance.

44 According to the plans submitted with the application, other than fencing, no structure or
45 storage will be located in a required setback.

1 (8) The temporary construction staging area shall be compatible with existing uses on
2 surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a
3 special permit allowing the temporary construction staging area, the board may attach
4 conditions to any special permit approval to
5 a) avoid substantial harm to public health or safety;
6 b) avoid substantial harm to, or impairment of the normal use of, a public place; and/or
7 c) avoid substantial harm to the environment.

9 Depending on the nature and anticipated duration of the use, as a condition of approval to
10 the special permit, the board reserves the right to:
11 a) Provide a deadline for termination of the construction staging area;
12 b) Limit the hours of operation;
13 c) Limit the type of equipment and materials on the site;
14 d) Require fencing, landscaping and/or other screening to limit potential visual and
15 noise impacts of the use on adjacent property owners; and
16 e) Require surface water management improvements to the affected site: In
17 compliance.

19 The BOCC reserves the right to attach such conditions to any special permit approval at
20 the July 19, 2023 public hearing.

22 (9) The property shall be restored to its prior condition: Compliance to be determined upon
23 termination of the staging area.

1 WHEREAS, an application was filed for a special permit allowing a temporary construction
2 staging area at property located at 77 Sirius Lane,Geiger Key,approximate Mile Marker 11 (Oceanside

5 WHEREAS, the property is legally described as Block 7 Lot 29 Geiger Mobile Homes,
