AGENDA ITEM WORDING: A Public Hearing to consider approval of a Resolution establishing
the final per month Solid Waste Collection Service Rates for commercial property in the various Solid
Waste Collection Franchisee Areas, for Fiscal Year 2024.
ITEM BACKGROUND:
The County's four Franchise Agreements allow for an annual Consumer Price Index (CPI) adjustment to
the commercial collection rates. The CPI adjustment is capped at 5% for the collection rates and at 4%
for the Disposal rates. The commercial rates for Fiscal Year 2023-2024 (October 1, 2023, to September
30, 2024, are being increased by 5% for collection and 4% for disposal in accordance with the
commercial collection rate cap on the CPI adjustments per the Franchise Agreements and the Haul-out
Agreement.
The Commercial Collection, Disposal and Recycling Rates were initially established in the Amended
and Restated Solid Waste and Recycling Collection Franchise Agreement between Monroe County and
Waste Management of Florida, Inc. (WM), Marathon Garbage Services, Inc. (MGS), Keys Sanitary
Services (KSS) and Ocean Reef Club, Inc. (Ocean Reef). Each year, as per the Agreement, the
commercial and recycling rates are adjusted by the Consumer Price Index.
The County published notice on June 17, 2023, of the proposed commercial rates and notice of the July
18, 2023,public meeting to adopt the final 2023-2024 Commercial and Recycling rates.
PREVIOUS RELEVANT BOCC ACTION:
The BOCC approved the Amended and Restated Solid Waste and Recycling Collection Franchise
Agreements between WM, MGS, KSS on May 21, 2014, and Ocean Reef on August 20, 2014.
The BOCC at its April 21, 2021, meeting directed for the commercial rates to be uniform and for staff to
implement uniform commercial rates among the Franchisee.

The BOCC at its May 19, 2021, meeting approved an Amendment to the agreements with WM, MGS,
KSS, and Ocean Reef to implement uniform commercial rates.

A RESOLUTION ADOPTING THE FINAL PER
MONTH SOLID WASTE COLLECTION, DISPOSAL, AND
RECYCLING SERVICE RATES FOR COMMERCIAL PROPERTY
IN THE VARIOUS SOLID WASTE COLLECTION
FRANCHISE AREAS FOR FISCAL YEAR 2023/24.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA
as follows:
Section 1. Pursuant to the solid waste collection agreements entered into between the County as
Franchisor and the solid waste collectors as Franchisees, the solid waste service rates for
commercial property, as defined in Sec. 21.46, Monroe County, are hereby adjusted in each
district, on a per month basis as follows:
