13 COUNTY COMMISSIONERS AUTHORIZING THE COUNTY
14 ATTORNEY TO ISSUE A PARTIAL RELEASE OF TWO CODE
15 COMPLIANCE LIENS AGAINST THE VACANT LOT IN DUCK
16 KEY CENTER ISLAND COMMONLY KNOWN AS 104 JAMAICA

21 WHEREAS,in 2016,the Board of County Commissioners(the BOCC)initiated a Density
22 Reduction Program to purchase development rights from owners of private property in anticipation
23 of the State's expected cessation of new development once the current pool of Rate of Growth
24 Ordinance (ROGO) allocations is exhausted; and
25
26 WHEREAS, the subject property (Parcel ID# 00379540-000000)was the subject of code
27 compliance cases where two liens (totaling $626,648.88) have been recorded against the property
28 and its previous owners. The lien for CE16100099 is recorded at Document 2158059,Book 2894,
29 Page 1390. The lien for CE18050099 is recorded at Document 2176250, Book 2914, Page 2415.
30 The liens are against the land on which the violation exists (the subject property) and upon any
31 other real or personal property owned by the violator; and

33 WHEREAS, the County acquired the lot for $5,703.19 when there were no bids for the
34 tax deed sale in 2020 and 2021, and the County paid $2,237.64 to satisfy the remaining tax
35 certificates; and
36
37 WHEREAS, the County paid to demolish the partially built, unsafe structure on the
38 property; and
39
40 WHEREAS, the BOCC created the Disposition Program by Ordinance 001-2022, and
41 approved the sale of the property in Resolution 042-2023 in accordance with that program; and
42
43 WHEREAS, the BOCC finds that a partial release of the liens as to the subject property,
44 while retaining the lien as to other real or personal property of the previous owners, will facilitate
45 the sale of the property; and

2 WHEREAS, the County Code does not provide the County Attorney with the authority to
3 issue a partial release without approval by the BOCC.
5 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
6 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

Section The "Whereas" clauses set forth above are incorporated as findings by the
9 Board.

l l Section 2: The County Attorney is authorized to issue partial releases of the liens
12 recorded at Document 215059, Book 2894, Page 1390 and Document
13 2176250, Book 291 , Page 215. The partial releases shall release the
14 subject property(Parcel 1 #0037950-000000)from the liens,but shall not
15 release the other real or personal property owned by Brian and Misty
16 Reininger.

18 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
19 Florida, at a regular meeting held on the 19`h day of July, 2023.
